Florida Deputies Report Shooting Incident Following Service Denial Dispute at McDonald's

DAVENPORT, Fla. (WFLA) — A late-night altercation at a Florida McDonald’s took a violent turn when an employee shot a customer during a dispute over service refusal.

In the early hours of October 12, Peter Story, 19, and Nicholas Jones, 18, attempted to order at a McDonald’s in Davenport, roughly 35 miles from Orlando, but were turned away due to high demand. According to reports from the Polk County Sheriff’s Office, this denial sparked the incident.

The disagreement escalated between the two customers and Yoan Soto, 21, the drive-thru employee. Allegedly, Story and Jones threatened to “beat his a–” and waited in the parking lot for Soto. They proceeded to the restaurant’s lobby to continue their confrontation.

Efforts by the store manager to calm the situation proved unsuccessful as Story and Jones refused to exit the premises. According to the arrest report, the manager overheard comments about firearms, specifically mentions of a “30 clip” and “switches.”

The arrest report said Soto went into the break room and grabbed a gun from a backpack. He left the restaurant through the back door and reentered through the lobby, approaching the two men from behind.

A struggle ensued and the gun fired, striking Story in the neck. His injury was considered non-life-threatening. The men then left the restaurant.

PCSO said Soto put the gun in his waistband, grabbed his backpack and picked up the spent shell casing “telling an employee that ‘it belonged to him,’” before leaving the restaurant.

Deputies found the casing and the clothing Soto was wearing at the time of the incident while searching his home, according to the arrest report. PCSO said he admitted to removing that piece of evidence from the site of the shooting.

Soto was charged with tampering with physical evidence. Story and Jones were charged with disorderly conduct and trespassing.
