Proposed Legislation Seeks Death Penalty for Convicted Child Rapists

On Monday, Tennessee lawmakers approved a controversial bill that could introduce the death penalty as a potential punishment in certain child sex abuse cases.

House Bill 1454, if enacted, would permit prosecutors to seek the death penalty in specific child sexual assault scenarios. These cases include those involving victims under the age of 4, situations where the perpetrator held a position of authority or trust, offenders who are already registered sex offenders, and instances of incest. According to WRCB, the Tennessee General Assembly passed House Bill 1454, putting the decision in the hands of Governor Bill Lee, who will determine whether it becomes law.

The bill’s sponsor, Tennessee Representative Greg Martin, stated that the legislation builds upon measures Governor Lee enacted last year.

“This bill provides guidance for district attorneys and prosecutors on handling child rape cases, especially those with aggravated circumstances,” Martin elaborated.

However, opponents and critics of the bill said the United States Supreme Court has already barred the death penalty in cases where the victim did not die. Hamilton County District Attorney Coty Wamp noted that they were prevented from using a similar 2024 statute to pursue the death penalty against Stephen Rapaport, who pleaded guilty in January to various child sex crimes. WTVC reported that Rappaport was filmed raping a child.

“A situation where parents might have to sentence another child or a niece or nephew or a brother to death… that’s what creates an under reporting on child sex crimes,” Senate Democratic Caucus Press Secretary Brandon Puttbreese pointed out to the news station, referring to a possible issue with the bill.

If signed, House Bill 1454 will take effect on July 1.
