Barry Morphew has made a return to the Alamosa County court as he once again faces charges of murder.

Appearing calm and collected, Morphew was dressed in a cream sweater paired with light-washed jeans. He was accompanied by his legal team, David Beller and Jane Fisher-Byrialsen. Supporting him from the first row were his daughters, Mallory and Macy.

Attorney David Beller entered a plea of not guilty on behalf of Morphew.

Asserting his innocence in the case of his wife’s death, Morphew chose to waive his right to a speedy trial. Both his defense team and the prosecution acknowledged the extensive data involved, agreeing that more time is necessary for thorough preparation.

The judge has scheduled the start of Morphew’s jury trial for October 13, with expectations that it could extend for as long as six weeks.

Barry Morphew was originally charged with the murder of his wife in May 2021, but the case was dropped days before trial, after the judge barred prosecutors from calling key witnesses to the State’s case, for failing to follow rules for turning over evidence.

Former 11th Judicial District Attorney Linda Stanley was later disbarred by the Colorado Supreme Court for
significant ethical misconduct. Stanley made inappropriate comments in the media and even improperly investigated the judge in the case.

Her actions compromised the Morphew prosecution and led to disciplinary action.
