Attorney John P. Guidry II (@orlandodefenseattorney) captioned his TikTok video: “Here’s a brief rundown for folks accused of petit theft or shoplifting here in Florida.”

If you’re accused of shoplifting or theft for the first time, Guidry said the case will likely go well.

“It’s gonna take some work,” he said.

But part of that is hiring a good attorney.

Going to court alone could result in a bad result that includes probation, community service, and classes, Guidry said.

The outcome could also include a theft on your record which could prevent you from getting a job in the future.

Guidry said this is most common among people who show up to court to face the prosecutor alone without legal representation.

And while prosecutors can be nice, Guidry said “these folks don’t have your best interest at heart.”

“I don’t recommend you just doing this alone.”

Guidry said this could be especially damaging for people with immigration issues.

“Do not enter a plea on this without getting an attorney to help you out,” he said.

Guidry also shared good news for those facing first-time theft charges.

“Most first offenders are given a shot at a diversion program,” he explained.

That program usually includes a class on theft and results in the charge being dropped.

But Guidry cautioned offenders to make sure the case doesn’t end there.

“Make sure your attorney finishes the job by expunging your record,” he said.

Otherwise, the charge will come up on background checks which can impact you throughout life.
