Mom Faces Charges for Assaulting Child and Partner Over Relationship Drama: DA Reports

Inset: Emma Spencer (Kenosha County Sheriff’s Office). The apartment complex in Wisconsin where Emma Spencer is accused of assaulting her young daughter and boyfriend (Google Maps).

A teenager from Wisconsin, frustrated with feeling like the third wheel in a relationship with her boyfriend and another woman, reportedly vented her frustration on her 2-year-old daughter. Authorities allege she hit the child in the face as the toddler played with a teddy bear.

Emma Spencer, 17, from Kenosha, is also accused of attacking her boyfriend due to anger about their “polyamorous relationship,” as outlined in a criminal complaint reviewed by Law&Crime.

The complaint describes how Spencer voiced her insecurity by claiming her boyfriend preferred the other woman and lamented that no one loves her. In response, her boyfriend attempted to comfort her, saying, “If I didn’t love you, why would I have a kid with you?” and gestured towards their daughter. It was then that Spencer allegedly slapped the toddler and grabbed her by the face, causing the child to cry.

Prosecutors stated that on Tuesday, July 7, Spencer’s boyfriend confronted her about the incident, questioning why she had struck their daughter. Spencer allegedly replied that she regretted having the baby, saying she never wanted to be a mother, according to the complaint.

After allegedly attacking their daughter, Spencer set her sights on her boyfriend and started “punching him repeatedly in the chest” after mounting him on their bed, according to prosecutors. The other female in the relationship witnessed both attacks and told investigators that Spencer struck the boyfriend around eight to 10 times before she stopped, the complaint says.

During an earlier incident, Spencer allegedly punched her boyfriend in the groin. She also threw a can of Mountain Dew at him, the complaint says.

After being called to the apartment where Spencer and her boyfriend lived, police spoke to the other female in the relationship and learned that they had only been a “throuple” for three days — with the female moving in with them, according to the complaint.

Spencer and her boyfriend had been together for three years.

“The defendant had recently started dating [the female] approximately one week prior and brought her into the home three days ago for a three-way relationship, which was a mutual decision between the defendant and [the boyfriend],” the complaint explains. “The defendant began having conflicting feelings about the three-way relationship and wanted to take a break. She and [the boyfriend] had been arguing throughout the day about the relationship and their feelings.”

Spencer’s boyfriend told her that she “disregarded people’s feelings and mentally hurt people, which triggered her anger,” according to prosecutors. Spencer allegedly claimed she “blanked out” before attacking her boyfriend and child.

“The defendant described having mental health issues for years, specifically with her ‘grip on reality,'” the complaint says. “The defendant had started seeing a therapist two to three weeks prior, meeting once per week. The therapist wanted to prescribe medication, but the defendant’s mother refused to provide consent.”

When Spencer attacked her daughter, the little girl was “toddling around walking and playing with her teddy bear,” according to the complaint. Police reported a “small scratch” on the child’s nose that appeared old, but there were no other visible injuries.

In Wisconsin, 17-year-olds are automatically charged as adults regardless of the severity of the crime they allegedly committed. They are prosecuted in adult court and held at adult county jails.

Spencer has been charged by the Kenosha County District Attorney’s Office with felony child abuse, misdemeanor battery domestic abuse and disorderly conduct domestic abuse. She is being held at the Kenosha County Jail.

Family Pursues Legal Action After Toddler Mistakenly Declared Dead and Found Alive in Morgue

0

A family is contemplating legal proceedings after a 1-year-old child, initially declared dead at an Arizona hospital, was discovered alive in the morgue.

The child’s parents might face child abuse allegations after confessing to marijuana use and neglecting supervision during a Super Bowl gathering. The child, Vincent Fiordilino, was found unresponsive in a swimming pool, prompting first responders to transport him urgently to a hospital, where he was mistakenly pronounced dead.

The family is preparing to take legal action against Dignity Health Mercy Gilbert Medical Center and the attending physician, known as Dr. Toosi. As reported by AZFamily, bodycam footage captured Dr. Toosi declaring the child deceased at 6:20 p.m., only for the mother and a nurse to soon observe signs of life.

According to a police report reviewed by a local news source, Vincent was still showing potential life signs, as indicated by the movement observed in his chest and stomach area.

When this information was brought to Toosi, the report states, the doctor responded “arrogantly” and said, “he was the doctor, he has the medical degree, he went to medical school for a reason, and to let him do his thing.”

Medical officials later found the child breathing and carrying a pulse just before midnight at the morgue. He was then flown to Phoenix Children’s Hospital, where it was confirmed he was suffering from severe medical issues related to the near-drowning.

According to a GoFundMe drive set up for the boy, Vincent’s kidneys, lungs and liver began shutting down after he arrived at Phoenix Children’s Hospital. An MRI initially identified two small areas of potential brain damage, but later testing reportedly found no brain damage. The fundraiser says Vincent continues to require extensive therapy, ongoing medical monitoring and treatment as he recovers.

Neither Toosi nor the parents have been charged with a crime in relation to the incident. Toosi’s attorney declined to comment on the issue when contacted by AZFamily.

According to AZFamily, a Dignity Health spokesperson said the hospital conducted a review following the incident.

“This is a heartbreaking situation. We immediately conducted a thorough review of all aspects of the care that was provided to learn what happened and to make meaningful changes to strengthen our care,” the spokesperson said in a statement. “Out of respect for the patient’s privacy, we cannot discuss details. We continue to work with the family and their representative. Patient safety and exceptional care is our highest priority.”

Trump to Petition Supreme Court for Rehearing on Birthright Citizenship Debate

0

President Trump has announced plans to request the U.S. Supreme Court to reconsider its recent decision that invalidated his executive order on birthright citizenship. The high court struck down the policy just last week.

In a statement posted on Truth Social, Trump referred to the ruling as a “miscarriage of justice” and expressed his determination to seek a rehearing from the Supreme Court. He emphasized the ruling could potentially endanger America unless it is overturned.

In a decision made on the last day of its term, the Supreme Court dismissed the executive order, which was one of Trump’s initial actions as president. The order stipulated that for a child born on U.S. soil to automatically gain citizenship, at least one parent must be a U.S. citizen or have permanent legal status.

The decision was backed by Chief Justice John Roberts, alongside conservative Justice Amy Coney Barrett and the liberal Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson. Their ruling underscored that the 14th Amendment unequivocally guarantees citizenship to nearly all children born in the United States.

In his detailed 26-page opinion, Chief Justice Roberts highlighted, “Citizenship, then and now, was the right to have rights — to freely participate in our political community. The Framers of the Fourteenth Amendment extended that promise to ‘every free-born person in this land.’”

Justice Brett Kavanaugh disagreed with the majority’s decision on whether the order violated the 14th Amendment but voted to block the policy under federal law mirroring its language.

Justices Clarence Thomas, Samuel Alito and Neil Gorsuch dissented. In his 39-page dissent, Alito wrote the court “made a serious mistake” in upholding birthright citizenship.

While losing parties can ask the high court to rehear cases, the justices rarely grant the request.

Steve Vladeck, a professor at the Georgetown University Law Center, said in 2024 that the high court has not agreed to any rehearing of a ruling in an argued case since 1965 and has not agreed to a plenary rehearing since 1956.

“Instead, the principal significance of rehearing petitions with respect to merits rulings today is how they affect the timing of the remand to lower courts,” Vladeck wrote on his “One First” Substack.

Under federal law, losing parties must petition for the rehearing of a judgment or decision by the high court within 25 days of its entry, unless the court or a justice shortens or extends that timeframe.

“The time for filing a petition for the rehearing of an order denying a petition for a writ of certiorari or extraordinary writ will not be extended,” the law states.

Florida Mayor Clarifies Use of Police Vehicle

0

In a breathtaking twist of events, a Florida mayor has found himself in hot water after being discovered driving a police vehicle and deploying its flashing blue lights to secure a VIP-like passage through traffic. This incident has raised eyebrows far beyond the sunshine state’s borders.

Recently unveiled body camera footage reveals the moment when Hialeah Mayor Bryan Calvo, age 28, is pulled over by a Miami police officer. The encounter occurred after Calvo allegedly executed an improper left turn in the upscale area of Coconut Grove, Miami, around 11:30 a.m. on June 14.

What appeared at first to be a routine traffic stop quickly became more serious when Officer Yasmani Gonzalez spotted that the black Chevrolet SUV Calvo was navigating was equipped with flashing red and blue police lights, a feature typically reserved for law enforcement vehicles.

The officer, his curiosity piqued, asked pointedly, “Is this a police car? Is this your personal?” The confrontation was captured in the footage, highlighting the striking nature of the scenario.

Calvo, unfazed, responded, “I’m an elected official,” noting that his role as mayor is non-partisan. This remark, however, did little to clarify why he had access to such a vehicle and the authority to use its emergency features.

The response did little to impress the officer.

‘You turned on your police lights,’ the officer told him. ‘That’s a criminal offense, and I can easily take you to jail.’

The tense roadside exchange continued as the officer delivered a reminder that holding an elected office position does not entitle him to lawless behavior.

Mayor of Hialeah since last November, Bryan Calvo, 28, allegedly activated the emergency lights on his unmarked Hialeah Police Department vehicle while sporting an unauthorized Hialeah Police shirt, during a traffic stop in Coconut Grove on June 14

According to Florida statute, vehicles are generally prohbited from displaying blue lights visible from the front unless the vehicle is specifically authorized under state law, such as certain law enforcement or emergency-response vehicles

‘I don’t care if you’re the mayor,’ Gonzalez slammed. ‘If you’re not a police officer, don’t activate police lights.’

The officer then warned Calvo that he was driving a police vehicle despite not being a sworn law enforcement officer.

Gonzalez proceeded to threaten jail time, saying, ‘that right there could be a third-degree felony.’

However rather than making an arrest, the officer issued Calvo two citations – one for the improper left turn and another for having prohibited emergency lights on the vehicle.

Court records show the mayor has pleaded not guilty to both violations. It also remains unclear whether Calvo is still driving the SUV.

The footage has also launched fresh questions over why the city’s mayor was driving a police-issued SUV equipped with functioning emergency lights.

Florida law generally limits the use of blue lights to authorized emergency vehicles and does not provide a specific exemption for mayors. Although municipalities may authorize rare vehicle assignments or equipment for operational purposes, local policies do not supersede state law.

Driving a city vehicle equipped with police-style equipment could be interpreted as the impersonation of a police officer, even if emergency lights were not activated and is a third-degree felony punishable by up to five years in prison and a $5,000 fine.

Persistently denying any wrongdoing, Calvo has insisted the SUV belonged to the Hialeah Police Department and that the emergency equipment had been installed long before he took office.

In a statement he penned, ‘One citation relates to a traffic maneuver and the second concerns equipment that was installed on a vehicle owned by and registered to the Hialeah Police Department, a vehicle that was refitted before I took office and before the vehicle was assigned to me.’

The blue lights incident was not Calvo’s first run-in with the law.

In July 2023, while serving as a Hialeah council member, Calvo was stopped by a Hialeah Police officer for allegedly failing to stop at a traffic signal while driving a red Tesla, according to Hialeah Police Department records.

The case bore a civil penalty of $277. However, Miami-Dade Clerk of Court records reveal the case was swiftly dropped at the request of the citing officer.

While the earlier citation did not involve allegations as serious as those raised during the June stop, the repeat run-in is likely to fuel mounting scrutiny over the driving conduct of one of South Florida’s highest-profile elected officials.

The Daily Mail has reached out to the Miami Police Department and the City of Hialeah Mayor’s Office for comment.

DOJ Action Prompts Minnesota to Revoke Controversial Race-Based Grant

0

The Minnesota Department of Health (MDH) has opted to pause a race-specific grant initiative following the commencement of a compliance review by the U.S. Department of Justice (DOJ), as announced by the DOJ on Tuesday.

According to the DOJ, this grant program, known as the Capacity Strengthening Initiative, was designed to include only organizations that served communities of color. It offered “strategic consideration” and prioritized proposals from organizations headed by leaders from these communities.

Furthermore, the DOJ claimed the program favored distributing more funds to communities identified as “Black or African American” and “nonwhite Latino(a).”

The Grant Portal, an independent third-party source, described the 2023 Capacity Strengthening Grant as aiming to bolster the effectiveness of metropolitan and rural community-based and faith-based groups that assist communities of color, American Indians, LGBTQIA+ individuals, and people with disabilities.

The strict race-based language, Assistant Attorney General Harmeet K. Dhillon of the Justice Department’s Civil Rights Division explained, was a violation of the Civil Rights Act.

“Recipients of federal dollars cannot decide who benefits from those funds on the basis of race, color, or national origin,” Dhillon said in a DOJ statement. “The Department appreciates that the State of Minnesota has recognized this foundational principle and has repealed the statute governing the program.”

MDH withdrew the grant program after the DOJ initiated a review based on Title VI of the Civil Rights Act, the DOJ statement claimed. Title VI prohibits any recipient of Federal financial assistance — a group that includes MDH — from discriminating on the basis of race, color, or national origin.

Trump’s Controversial NATO Comments Overshadow Surprising Message of Unity

0

In a surprising turn, US President Donald Trump extended a warm gesture to NATO allies at the conclusion of a significant summit, a stark contrast to his earlier criticism regarding their handling of his confrontations with Iran.

This sudden shift from hostility to a more friendly posture happened within mere hours, showcasing the broad spectrum of emotions often displayed by the unpredictable US leader.

“It was truly phenomenal. The sense of unity in that room was incredible, really harmonious—it was quite something,” Trump remarked to journalists following the private gathering of 32 leaders during the NATO summit held in Turkey’s capital, Ankara.

“This summit was enormously successful.”

Within the confidential confines of their meeting, Trump assured his fellow leaders of the US’s commitment to the alliance, expressing, “We want to stay together with you,” according to a source familiar with the discussion who spoke to Agence France-Presse (AFP).

That sentiment was reflected in the final declaration in which NATO leaders reaffirmed their “ironclad commitment” to the mutual assistance clause enshrined in Article 5 of the alliance treaty.

European leaders showcased their surging defence spending at the summit as they looked to convince Trump they’re making good on a pledge to ramp up budgets — and take more responsibility for their own security.

“I’m returning to Germany with the sense that we have made a major contribution: that NATO is holding together, that it is becoming stronger, and that it is becoming more European,” said German Chancellor Frederich Merz.

But the day had not begun well with Trump lashing out over NATO allies’ failure to back his Iran campaign just before the session, threatening to cut trade with Spain, and insisting he still wants NATO member Denmark’s territory of Greenland.

“I’m very upset with NATO… because of what they did with Greenland, and… because of the fact that they didn’t want to help us with the number one state sponsor of terror, that’s Iran,” he said.

Bark worse than bite

Once Trump came face-to-face with the leaders behind closed doors, his tone changed markedly, according to the source who attended the talks.

“There is a strong contrast between what Trump says in public and what he actually says inside,” he told AFP.

And he made no further mention of Spain or Greenland.

Afterwards, Spanish Prime Minister Pedro Sanchez insisted that ties with Washington were “very positive”.

Estonian Prime Minister Kristen Michal said that Trump moderated his tone in the session, telling AFP he had given a “kind of constructive message… that Europe must step up, invest more in defence”.

“So it was kind of a good mood with sort of constructive messages,” he said.

Lithuanian Foreign Minister Kestutis Budrys said Trump’s outbursts should not necessarily be read as a sign of the alliance fragmenting.

“I wouldn’t see in it an indicator that we are somehow weakening NATO, and that the transatlantic bond is not there,” he told AFP.

“I think we should dramatise things less.”

Boost for Ukraine

Stalled efforts to halt the Ukraine war were also back on the agenda, with Trump pledging to give Kyiv “the right to make” Patriot air-defence missiles as he went into talks with Ukraine’s Volodymyr Zelenskyy on the sidelines of the summit.

“We’re going to give a licence to you to make Patriots. That’s pretty cool, right,” Trump told Zelenskyy, whose forces have been struggling to shoot down Russian ballistic missiles as supplies of crucial US-made Patriot interceptors run low.

Despite Moscow’s heavy bombardments in recent days, Kyiv appears to be turning the tide by stabilising the front line and conducting strikes deep into Russia — strikes that Trump said could help end the war.

“It’s an escalation, but it’s also an escalation that can help lead to an end,” he added, repeating his belief that both Zelenskyy and Russia’s Vladimir Putin wanted to strike a deal to halt the fighting.

Also in the final NATO declaration, Europe and Canada pledged to keep military support flowing to Ukraine to the tune of 70 billion euros ($115 billion) a year in both 2026 and 2027.

Before leaving Ankara, Trump held talks with Syrian President Ahmed al-Sharaa who is seeking to rebuild the country’s international image as it emerges from years of civil war.

‘Much stronger’

Keen to avoid a new confrontation with Trump, NATO allies unveiled tens of billions in new arms contracts on Tuesday as proof they are making strikes on efforts to take the burden off the US for Europe’s protection.

NATO chief Mark Rutte insisted the alliance was emerging stronger from the summit in Turkey — despite the disagreements.

“I always felt that families where sometimes you have a heart-to-heart and sometimes you fight each other a bit are much stronger,” he said.

In an Instagram post celebrating the release, Jolie shared that the nectar was inspired by the ancient understanding of water as “a symbol of renewal, ritual, and transformation” and that they wanted ingredients to feel “historic and revered.”

While the price may be off-putting, there is a membership workaround that gets guests “free” Sacred Water.

For the aspirational, an annual base-level “Select” Erewhon membership is relatively reasonable at $100 and includes tonic bar perks such as free Sacred Water.

As with most things sold at Erewhon, influencers are all over it, and the drink is eliciting both reverie and rage.

“Wow,” exclaimed Lydia Grace, an LA-based chef on Instagram. She described the drink as “floral coconut water” and called out the green cardamom for elevating the flavor profile.

“Ok, obsessed, $12 water, make it my new routine,” raved influencer Annie Sharp in another social video.

Among other influencers who tried — and loved — the Kool-Aid is flight attendant and fitness coach Troy Manandic.

“I totally get why they call this Sacred Water,” he said in an Instagram post that reads like a sponsored religious conversion, “This flavor is like nothing I’ve ever had; it’s super light and so hydrating. I never thought water could taste this good.”

Despite some rave reviews, many commenters were less convinced.

“What a scammmmm,” one wrote.

“They are bulls—ting all the richies to spend their money on nothing special,” added another.

“Not worth it, but yet again, everything in that store isn’t worth it,” quipped someone else.

The nectar of the 1 percent is available now through the end of September at all Erewhon locations in Los Angeles, so get the good while you can, folks.

Erewhon, which started in the 1960s as a niche health food store and has since grown into a cultural phenomenon, is no stranger to price controversy.

In 2024, the store caught heat for the price of ice as the luxury market was peddling a bag of eight large, Penny Pound Ice “ballz” for a staggering $32.

Erewhon has also been ridiculed for its $20 strawberries and $11 bone-broth hot chocolate.

Of late, Erewhon also partnered with Simplehuman, the premium home brand best known for its sleek, high-tech trash cans and sensor makeup mirrors, to launch a limited-edition beverage called, wait for it, Liquid Steel.

Also, $12, the Liquid Steel smoothie is inspired by the stainless steel used in the brand’s iconic trash cans and kitchen accessories.

It blends coconut water, watermelon, and lime with electrolytes, creatine, collagen, magnesium, and potassium — a combo designed to support hydration, recovery, and daily performance.

Charlie Kirk’s Family Lawyer Urges Judge to Unveil Crucial Evidence

Charlie Kirk’s family, represented by their attorney, passionately appealed to the judge during Tyler Robinson’s preliminary hearing. They sought the release of an uncut video from his lover’s police interview.

Today, it is anticipated that the court will hear a partially-censored audio recording. This features Lance Twiggs, aged 23, who was Robinson’s transgender former roommate and partner, discussing Kirk’s murder, which occurred on September 10.

The recorded interview took place in April in Utah. However, the judge mandated the redaction of 15 minutes to prevent influencing potential jurors. The specifics of the omitted content are unknown.

The defense has contested the idea of playing the entire recording, arguing it could be perceived as a confession, thus jeopardizing Robinson’s right to a fair trial.

In a dramatic turn of events on Wednesday, Jeffrey Neiman, attorney for the Kirk family, broke his silence to urge the judge to unveil the complete, unaltered footage.

‘I’ve been very hesitant to speak up at these proceedings,’ he said. ‘But I want to be clear on the Kirk family’s position is on all of this.

‘The Kirk family believes strongly that if it is admitted in this preliminary hearing, it should be made public for the world to see. No redactions.’

He continued, ‘To not be transparent, to not be open, to not let the world see what happened will create doubt and distrust in the judicial system, and that’s not what anybody wants.

‘That’s not what any of us believe should happen here and we’d ask the court to consider the position of the family and making this decision.’

On Thursday, the judge ruled that only part of the recorded testimony will be played in court and some audio would only be played for those in attendance, while some other exhibits would not be visually displayed to the gallery at all.

Following Neiman’s impassioned plea to the judge, Erika Kirk also issued a scathing legal filing pressing the importance of ‘transparency’ in the case.

‘To not be transparent here, to not be open, to not let the world see what happened, will create doubt and distrust in the judicial system,’ Neiman reiterated in the filing.

Graf said he viewed the Twiggs interrogation footage in its entirety, and while part of it would be withheld, he would consider the entire video in his determination of whether prosecutors can bring Robinson to trial.

Twiggs was vaulted into national infamy after prosecutors alleged that Robinson left his roommate and lover a handwritten confession after assassinating Kirk, and texted him about plans to hide the murder weapon.

Authorities said Twiggs quickly cooperated with investigators and offered his DNA for testing, as well as providing text messages from Robinson in which the alleged murderer said he believed Kirk ‘spread too much hate.’

Prosecutors pushed to release Twiggs’ police interview video as they allege Robinson assassinated Kirk because he was upset over the influencer’s conservative political views.

The video led to a lengthy back-and-forth as Robinson’s defense attempted to block Twiggs’ recorded statements and force the suspect’s former lover to testify in-person, which would have allowed him to be cross-examined.

On Wednesday, Utah District Judge Tony Graf said he would allow the video to be played, but 15 minutes of the video would be redacted.

The footage to be played in court was taken in Twiggs’ second police interview in April 2026, but the suspect’s roommate was also interviewed in the aftermath of the shooting in September 2025 as well.

Twiggs was granted limited immunity in the case, meaning his statements in the police interview cannot be used against him by prosecutors.

Twiggs was living with Robinson in a townhouse in St. George, Utah at the time of Kirk’s assassination. Twiggs has not been charged with any crime related to the assassination.

The 23-year-old went into hiding following the assassination and was not seen for five months, until the Daily Mail tracked down the elusive roommate in Texas in February.

Those who knew Twiggs before the shooting say he was kicked out of his strictly Mormon home when he was 18 over disagreements over religion, drugs and gaming, but he appeared to have reconciled with his family after Kirk’s assassination.

In the aftermath of the shooting that shocked the nation, prosecutors say Robinson sent a number of texts to Twiggs, including one telling him to look under his computer keyboard to find a handwritten confession note.

The note read: ‘I had the opportunity to take out Charlie Kirk and I’m going to take it,’ according to court filings.

When Twiggs responded in disbelief and asked how long Robinson had been planning the shooting, he responded, ‘A bit over a week, I believe’, prosecutors said.

Robinson said he believed Kirk ‘spread too much hate,’ and texted Twiggs about his rush to flee the scene and contain evidence, according to court filings.

‘If I am able to grab my rifle unseen, I will have left no evidence,’ Robinson allegedly wrote.

‘Going to attempt to retrieve it again… I might have to abandon it and hope they don’t find prints.’

Authorities said when they found Robinson’s rifle, they discovered unspent shell casings engraved with political messages, including one that read, ‘Hey Fascist! CATCH!’

In his alleged texts, Robinson referenced these engravings, writing: ‘If I see ‘notices bulge uwu’ on Fox News I might have a stroke.’

Robinson capped off his messages by warning Twiggs, ‘Don’t talk to the media please… if any police ask you questions ask for a lawyer and stay silent,’ the filings said.

Authorities said Twiggs showed the messages to investigators when questioned, and has cooperated with the case.

Twiggs also voluntarily provided a mouth swab of his DNA to help the investigation, which has been raised in Robinson’s pre-trial hearings this week as his DNA was found on a towel wrapped around the alleged murder weapon.
