In a separate high-profile case, convicted double murderer Mackenzie Shirilla has been dealt another defeat in court after the Ohio Supreme Court refused to reconsider its decision not to take up her latest appeal.

Shirilla, now 21, is serving two concurrent sentences of 15 years to life in prison for the deaths of her boyfriend, 20-year-old Dominic Russo, and their friend, 19-year-old Davion Flanagan. Prosecutors said Shirilla deliberately crashed her Toyota Camry into a brick building in Strongsville, Ohio, in 2022.

According to court records, Chief Justice Sharon Kennedy rejected Shirilla’s motion for reconsideration after her defense team urged the state’s highest court to revisit its June 23 decision declining to review the case.

“It is ordered by the court that the motion for reconsideration in this case is denied,” Kennedy wrote.

Tuesday’s decision leaves intact a lower-court ruling that Shirilla’s postconviction challenge was filed one day too late.

Shirilla’s attorneys have argued that the missed deadline resulted from confusion over the filing timeline, including a calendar mistake involving the 2024 leap year.

The postconviction challenge sought to raise claims that Shirilla received ineffective assistance of counsel, including an argument that her trial lawyers failed to adequately investigate evidence that she suffered from Postural Orthostatic Tachycardia Syndrome, or POTS.

Her attorneys have argued that the condition could have caused Shirilla to lose consciousness before the crash and potentially explain why she failed to brake before impact.

The defense previously said the condition was only “cursorily referenced” at trial despite Shirilla and her family allegedly putting her attorneys on notice about it.

The latest court decisions, however, have focused on whether Shirilla’s postconviction petition was filed on time rather than the merits of those arguments.

Under Ohio law, a postconviction petition must generally be filed within 365 days after the trial transcript is filed in the court of appeals. The court determined that the relevant transcript was filed Oct. 24, 2023, making the deadline Oct. 23, 2024.

Shirilla filed her petition on Oct. 24, 2024, the 366th day.

Shirilla argued that the clock should have started later, when juvenile bindover transcripts were filed, and also pointed to the 2024 leap year. The appellate court rejected both arguments, finding that the statute refers to the “trial transcript,” not supplemental juvenile-hearing transcripts, and that the law provides 365 days, not a calendar year.

Her attorneys later asked the Ohio Supreme Court to review the case. The state’s highest court declined to accept jurisdiction June 23 before Shirilla’s legal team asked the justices to reconsider that decision.

Shirilla’s case has received renewed public attention following the release of Netflix’s “The Crash.”

Shirilla was convicted in 2023 after a bench trial of four counts of murder, four counts of felonious assault and two counts of aggravated vehicular homicide.

Prosecutors argued at trial that Shirilla intentionally drove into the building to end her toxic relationship with Russo and that Flanagan was an unintended victim who happened to be in the car.

Evidence presented in the case included surveillance video, vehicle “black box” data and evidence that Shirilla’s car was traveling nearly 100 mph without braking before the crash, according to WOIO.

Shirilla has maintained that the crash was not intentional.

Her convictions were upheld on direct appeal in 2024.

Joy Behar has finally found a buyer for her Hamptons estate, though the sale came in at roughly half of the ambitious price she first put on the property.

Behar, best known as the longest-running co-host on The View, purchased the four-bedroom Sag Harbor home in 2016 for $4.75 million.

The 83-year-old television veteran first listed the historic Hamptons property in November 2024, entering the market with a steep asking price of $10.95 million.

After months on the market, Behar closed the sale on August 28 for $5.65 million — about $5.3 million below her original ask, according to Realtor.

Built in 1903, the 4,500-square-foot residence includes four and a half bathrooms and has been updated with modern comforts, including a separate guest cottage.

‘This house is over 100 years old — I’m almost as old as this house!’ she joked in 2021 to Hedges. ‘But it’s a beautiful house, it has bones, and it has history.’

The Daily Mail has contacted a representative for Behar for comment. 

Constructed and decorated to radiate an air of classic Northeastern elegance, the property now also boasts a heated swimming pool.

The home’s walls are lined with plenty of windows enabling natural light to stream into the building, which is nestled in a summer playground for the New York elite.

Behar’s own love affair with the Hamptons dates back to her college days in the 1960s, when she and her sorority sisters rented a vacation home there one summer.

‘I love the Hamptons,’ she raved. ‘There is no better place. To me, it resembles Provence more than any other place I’ve been, and I like it more than Provence.’

When the time came for her to snaffle up her own bit of Hamptons real estate, she had been starring on The View for the better part of two decades.

However, the manor she hoped for was not the one she eventually bought, but an adjacent house that she discovered was out of her price range.

‘I was looking at the one next door, a brand-new big house, that was too much money. I asked the broker: “Can you find out if he wants to sell this house?” The owner said: “Only at top dollar and as is.” I took it,’ she confessed.

Behar, who married her second husband Steve Janowitz in 2011 after a 29-year romance, began her bid to sell the house eight years after making the purchase.

Her listing agents Ed Gaetjens and John Wines have now admitted that the initial $10.95 million asking price had been too high.

They gradually whittled the price down until by December 2025 they had arrived at $5.95 million – but three months later, they went back up to $6.995 million.

‘We had started much higher, at an aspirational price, then came down to a realistic number,’ Wines explained of the $6.995 million decision.

Wines and Gaetjens explained that the $1 million price hike was partly motivated by the $11.25 million sale of a nearby home – albeit one that had been updated with more extensive renovations than those Behar had undertaken on her house.

‘The comp next door, that house went for a lot of money, a lot more than any of us thought it would go for,’ Gaetjens revealed.

‘We told Joy that, we’re not just taking [her listing] to take it again; we want to think outside the box on this. We just need to be a little more proactive, a little more visual, a little more telling about how things could be.’

Their tactic was to ensure that the stage was set for the new owners to begin a modernizing remodel without Behar actually having to revamp the house herself.

Wines and Gaetjens devised plans with the help of architects, obtained the planning permissions that would be needed and determined the price tags for the renovations.

‘A lot of people don’t have vision, they don’t see what the house could be. What we’re trying to do is make it more palatable. We’re all but doing [the renovation] for them is really what it comes down to,’ said Wines.

‘At $6.99 million, it’s still a steal because there’s so much room in there.  We have a legitimate comp next door that allows us to say: “Here’s what a turnkey house is worth.” We know that this house will give a buyer great equity, we’re just trying to find the easiest path for someone to accomplish that.’

He added, however, that in the event that ‘there isn’t a buyer at this price, I think we will probably find an avenue to have it renovated and sell it at the higher price.’ 

Wines’ contention was that ‘if we were to move forward and actually do the renovations, the price wouldn’t be $6.99 million, it would be $12 million.’ 

Federal authorities said Tuesday they arrested a Brazilian national living in the U.S. illegally who is accused of strangling a woman to death inside her Massachusetts home.

U.S. Immigration and Customs Enforcement identified the suspect as 43-year-old Flavio Alcantara Dias, who officials say entered the country unlawfully from Brazil and was later released into the United States during former President Joe Biden’s administration, despite prior arrests for driving under the influence and aggravated assault.

“Alcantara Dias illegally entered the United States in April 2019. In October 2024, an immigration judge granted Alcantara Dias’ motion to terminate his immigration hearings based on a technicality, bringing his immigration case to an end despite his criminal history and unlawful presence in the United States. He was then released into the country by the Biden administration,” the Department of Homeland Security said in a statement.

DHS also emphasized the role of local cooperation with federal immigration authorities, saying, “The safest way to arrest and remove criminal illegal aliens from our streets is by lodging arrest detainers. 7 of the top 10 safest cities in the United States cooperate with ICE. We are urging the Framingham Police Department to participate in a controlled transfer of this criminal illegal alien to get him out of our communities once and for all,” according to the statement.

“Our message is clear: if you come into our country illegally and break our laws, we will find you, we will arrest you, and we will deport you,” DHS added.

Middlesex County Assistant District Attorney Thomas Brandt recounted a 911 call Dias made after an altercation with the 33-year-old Brianna Connolly in her home last week.

“He states very clearly, ‘Can I have police? A homicide just happened here right now,’” Brandt told the courtroom, according to Boston 25 News.

“He then states, ‘I ended up killing a woman by mistake.’ He says, ‘I went crazy and suffocated her later on, says that he strangled her,’” Brandt said, noting that Dias had been speaking Portuguese.

Brandt said Dias had told police on the call that he and Connolly had been doing drugs inside her home and got into an argument because he wanted to have sex and she did not.

Dias claimed he fell asleep and woke up to find Connolly not breathing. Brandt added that police observed that Connolly had “blood marks on her forehead and also on the back of her head,” in addition to a “fabric-y cord around her neck.”

Olivia Rodrigo marked a major week on Tuesday night, following the success of her Daisy Chains Festival with a stripped-down, intimate performance at the Grammy Museum. The appearance celebrated the debut of the museum’s new exhibition, “Olivia Rodrigo: the cure unraveled.”

The new Grammy Museum exhibit highlights the creative world behind Rodrigo’s “the cure” music video, from her third and most recent album, “you seem pretty sad for a girl so in love.” Known for its striking handmade aesthetic, “the cure” unfolds inside a crafted hospital setting and features miniatures, animatronic heart puppets and stop-motion animation. The video was directed by Cat Solen and Jaime Gerin, with production design by Liam Moore.

Visitors will be able to view Rodrigo’s nurse costume along with original props, handmade sets and storyboards used to build the video’s distinctive visual style. The exhibition also includes behind-the-scenes photography and interactive photo opportunities designed for fans to step inside the world of “the cure.”

Guests at Tuesday’s event received an early preview of the exhibit ahead of its Sept. 2 public opening. A larger expansion is planned for early fall 2026, while the current installation is scheduled to remain on view through Feb. 22.

“I grew up going to the Grammy Museum, and their mission is especially important to me, so it’s a full circle moment to be able to work with them on this exhibit,” Rodrigo said. “It’s the perfect place to feature ‘the cure’ music video pieces that mean so much to me, as well as some incredibly special items from the past decade that we’re later adding that I’ve never shown before. I can’t wait for you all to see them in person!”

Goelz also explained, “It’s this really special moment to not only see the hand-crafted work up close, but also to, you know, do a little, pretending you’re Olivia. Get your photos in the music video, maybe sing along. You know, you can also see all the different props from the video that were made by hand, by artists up close. We really love to look at the creative process, so we get to see Olivia’s process and all these amazing contributors.”

An Ohio man accused of damaging Vice President JD Vance’s Cincinnati residence earlier this year pleaded guilty Tuesday in federal court, authorities said.

William D. DeFoor, 26, was accused of causing tens of thousands of dollars in damage on Jan. 5 after using a hammer to break several windows at Vance’s home, which was unoccupied at the time.

According to the U.S. Attorney’s Office for the Southern District of Ohio, DeFoor admitted to committing acts of physical violence against government officials or property, along with willfully injuring or depredating U.S. government property.

DeFoor’s defense attorney previously said the incident was not driven by politics and noted that he has struggled with mental health issues. Court records also show DeFoor has faced prior criminal cases that involved findings of mental incompetency.

“Perpetrators like DeFoor, who put that freedom at risk, particularly through violent, destructive actions, will, like here, be vigorously prosecuted,” U.S. Attorney Dominick S. Gerace II said in a statement Tuesday.

According to court documents, DeFoor was detained around midnight after Secret Service agents observed him near the front fence of Vance’s protected residence. Vance and his family were in Washington, D.C., at the time of the incident.

While wielding a hammer, DeFoor reportedly breached the property line at the driveway and proceeded to target an unmarked federal law enforcement vehicle blocking the driveway entrance. DeFoor used the weapon to strike the driver’s side window three times, prosecutors said.

As Secret Service agents responded, DeFoor ignored all commands to stop and drop the weapon, according to charging documents.

He then used the hammer to break large, historic glass windows across the front of the home, officials said.

The attack reportedly damaged components of an enhanced security system located on each window. The equipment was owned by the U.S. government and valued at more than $28,000, prosecutors said.

Secret Service agents and Cincinnati police officers eventually detained DeFoor after he tried to flee on foot.

Gerace on Tuesday further condemned the violence, saying assaults against U.S. officials will be prosecuted.

“Acts of violence directed against our political leaders, their families or property, have no place in our society and will not be tolerated. Our elected leaders, at all levels of government, must be permitted to carry out their duties free from threats, vandalism and other forms of violence,” Gerace said.

According to court records, DeFoor has a history of mental health issues in Hamilton County spanning more than two years.

FBI sources previously told Fox News that when DeFoor was arrested, he demanded to be called “Julia.”

In April 2023, DeFoor was charged with trespassing at University of Cincinnati Health Psychiatric Emergency Services after police said he refused to leave the premises. He was ruled incompetent to stand trial, and the case was later dismissed.

The following year, DeFoor was charged with two counts of vandalism after windows at a Hyde Park business were broken. The case was referred to a mental health docket, with treatment ordered in lieu of conviction.

Hamilton County Court later approved an application granting DeFoor’s mother legal guardianship after finding him incompetent by reason of mental illness.
