Girl, Six, Crushed To Death By Decayed Tree- What Happened?

Today, a local government was fined £280,000 for safety violations after a young girl was killed by a dying tree that the council had neglected to remove.

Six-year-old Ella Henderson was playing ballerinas with classmates in the playground of Gosforth Park First School in Newcastle when a large piece of a dead, decaying willow tree fell on her while she was playing amid gusts of wind that reached 32 mph.

The catastrophe happened on September 25, 2020, and while the other kids scurried out from under the tree, Ella was struck squarely by the largest and heaviest portion, killing her the next day.

Today, her grieving parents Vikki and Neil Henderson told South Tyneside Magistrates Court they expected their daughter to be safe when they dropped her off at the school gates that morning.

Scores of tributes were left outside the gates of Gosforth Park First School following the tragedy, which was investigated by the Health and Safety Executive (HSE)

After the disaster, which the Health and Safety Executive looked into, numerous memorials were put outside the gates of Gosforth Park First School (HSE)

After the hearing, Mr. and Mrs. Henderson stated: “We are beyond devastated to hear of the several occasions that this conclusion might and should have been changed.

“No family ever should have to experience what we are.”

We believe that better education and knowledge on which trees are suitable for school playgrounds and the size they are allowed to grow to is necessary. We hope that lessons will be learned from this.

Newcastle City Council, which was contracted to maintain the trees on its premises, admitted failing to ensure the safety of Ella and others at the school under the Health and Safety at Work Act.

The court heard that the tree had been identified as showing signs of decay by a qualified arborist as early as February 23, 2018, when a further inspection was ordered.

However these were carried out by a less qualified team and as a result, the danger posed by the tree, which stood at the very edge of the playground, was missed.

It meant the willow, which had a 35 degree lean and significant decay to its stem, remained standing when it should have been safely felled.

James Towey, prosecuting for the Health and Safety Executive, told the court: ‘The tragic and untimely death of six-year-old Ella Henderson, a Year Two pupil at Gosforth Park First School, happened on September 25, 2020.

Vikki Henderson, the mother of Ella (pictured) said: 'We now live with a complete hole in our lives. Having a six-year-old who loves life and wakes up every morning with, "What are we doing today, Mummy?" to suddenly this life, is just indescribable'

MOTHER’S AGONY: ‘WE NOW LIVE WITH A COMPLETE HOLE IN OUR LIVES’

Ella Henderson

Ella Henderson

‘Up until September 25, 2020, we had the perfect life. There was not one thing we would have changed. We had two happy, healthy little girls who were just the best of friends and life was amazing.

We now live with a complete hole in our lives as a result of having lived that life. It is simply unimaginable to have a six-year-old who loves life and asks, “What are we doing today, Mummy?” every morning, loving everything we did and everywhere we went, and then suddenly have this life.

“It breaks my heart to take her big sister places now knowing how much she would adore everywhere we go and taking pictures without her.”

“It’s not just the big things like birthdays, holidays, and Christmas; it’s all the little everyday things like not washing her clothes, not buying her toys or clothes but knowing what she’d love, not setting her place at the table, or not making a reservation for a table for four at a restaurant,” the author said.

‘Going to restaurants and being constantly asked “just one child” and having the empty chair at a table for four. Staying in a cottage and instead of her sharing a room together with her sister, there is now an empty bed. It’s just a constant reminder, not that we will ever need one, that she’s not here.

‘Seeing everyone’s life move on and their kids and her friends getting older while we stay still; always with a six-year-old who will never get her front teeth is devastating.

‘When you lose a child you live two lives. The one you should be living and the life you have to live.

‘Knowing how happy we would be and what we would have done in the last two years compared to the life we’ve had to live couldn’t be further apart.

‘The hardest part is that all we did was what every other parent does every day. She should have been so safe at school and knowing that I’m the only one who doesn’t get to pick their child up every day is just the worst feeling.

‘When I pass schools on the way somewhere and hear that innocent noise of children playing, I think, that was all she was doing. She was just playing ballerinas with her friends.

‘Life is so unfair, and she was so loved and had so much to give this world. As her reception teacher said, “The world is a much sadder place without Ella in it”.

‘Every single part of our lives has changed. Getting up every morning, knowing it’s another day without her and another day she’ll miss.

‘I read something online that sums up this life and it said, “When you died my heart was torn in two. One side is filled with heartache and the other died with you”.’

‘It was towards the conclusion of lunchtime that Ella was playing with her friends in the playground when a large section of a willow tree that stood on a grassed area adjacent to the playground collapsed and fell directly onto several children.

‘All of them, apart from Ella, were able to climb out from under it and they suffered only superficial injuries.

‘But because of the large piece of tree that fell onto Ella, staff were unable to effect a rescue immediately.

‘She was rescued by the emergency services and taken to hospital. It is most sad that in the early hours of the following morning she lost her life. The cause of death was given as crush asphyxia.’

Ella’s parents Neil and Vikki, who have another daughter Abi, watched proceedings via video link, but Mrs Henderson made a statement which was read to the court.

She said: ‘The hardest part is that all we did was what every other parent does every day.

As her reception teacher said, “The world is a much sadder place without Ella in it.”

Mr Towey outlined the council’s failure in its duty of care to the court.

He said the tree needed a further examination by an expert with the highest qualification from Lantra, a body responsible for training arborists and other land-based practitioners.

Mr Towey said: ‘A detailed inspection was carried out by a specialist employed by the council some two and a half years earlier and signs of decay were identified on the tension side of the stem with further decay in the cavity.

‘Further services were carried out by operatives of a lower standard on Lantra.’

Flowering fungii on the bark of the tree should have been ‘a red flag’ that it was decaying but the danger was missed.

The original report from the qualified arborist was also sent to the wrong email addresses in school and was not received by the head for more than two years.

Mr Towey said: ‘There is evidence of the system not working as it should have done in making sure suitably qualified people were carrying out the correct inspection at the correct time.

‘Reports were badly communicated to the school and to other schools in the Gosforth area.

‘The weather on the day had an impact but the failure to carry out a further detailed investigation into the tree’s condition made the failure of the tree foreseeable.

‘The arboriculture team failed to identify the level of decay in the tree, if they had done the tree would likely have been felled.’

Ben Compton, KC, for Newcastle City Council, said: ‘I want to acknowledge the terrible loss that Ella’s parents and family have suffered. Their statement made hard reading, even to the most battle weary lawyer.

Nothing I can say will be comforting, but I do want to send my sincere sympathies to them and for the shortcomings that have been quite accurately detailed by the prosecution on behalf of the council.

“The council swiftly entered a guilty plea; it is encouraging to see a thorough admission of the facts at the earliest opportunity. These shortcomings are well acknowledged.

He said that an expert with a professional Lantra degree should have conducted a second evaluation of the tree but that the request for that inspection had not been detailed enough regarding the danger the tree posed.

Staff and pupils at the Newcastle school were offered support following the girl's death

After the girl’s passing, the Newcastle school’s faculty and students received support.

The epidemic forced the council to postpone a complete evaluation of its arboricultural services, which involve keeping track of people and reviewing reports, that was scheduled for 2020.

It is another terrible feature of this case, he said, because one would have hoped that it would have been discovered at that time.

Newcastle City Council was given a punishment of £280,000 and an additional £8,201 in costs by District Judge Zoe Passfield.

Newcastle City Council requested a 15-month payment period, which was approved.

The judge described how one of the examinations of the decayed willow tree – identified in court as Tree 11 – by the council team had lasted for just one minute.

Judge Passfield said: ‘One survey appears to have been completed in only one minute, suggesting the bare minimum visual inspection took place despite the original inspection finding signs of decay in 2018.

Floral tributes were left outside Gosforth Park First School in Newcastle after Ella's death

After Ella’s passing, floral tributes were left in front of Gosforth Park First School in Newcastle.

The council properly inspected the other trees on the property, but Tree 11 was strangely missed.

She said that at the time of the disaster, the recommended examination by a fully qualified arborist was 13 months overdue, and because the degradation had not been properly reported, no one at the school was aware of the threat it posed.

The council stated that a profit-making company would have received a £600,000 fine for the identical violation.

The judge did advise her to keep in mind that the council was in charge of providing services to the general public when determining the penalties.

She decided to base the sum on the £18.8million annual budget of the Operations and Regulatory Services Department, responsible for tree management in the city.

The judge said she agreed the council’s level of culpability was ‘medium’.

Chief Executive of Newcastle City Council, Pam Smith, said: ‘Ella’s death was a devastating tragedy, and our hearts go out to her family and friends.

While we take our health and safety obligations extremely seriously, we completely acknowledge that there were flaws in our procedures, which is why we seized the chance to enter a plea of guilty at the earliest moment. We take note of the judge’s remarks from today and agree wholeheartedly with the ruling.

“Right away after the occurrence, we reviewed our protocols, and as a result, we have implemented additional measures to ensure that something similar never occurs again.

“We would like to extend our deepest sympathies and unreserved apology to Ella’s family for their unspeakable loss.”

Victorian Illnesses- What Are The Signs And Symptoms Parents Should Look Out For?

Due to an increase in instances, parents are being encouraged to watch out for symptoms of a Victorian sickness.

According to US specialists, waning immunity is thought to be the cause of the comeback of diseases like the mumps.

The study is released at a time when instances of additional Victorian ailments are on the rise.

The spread of viruses that cause scarlet fever is increasing in the UK.

Medical professionals also cautioned that since children were kept indoors during the Covid epidemic, this could be due to a lack of immunity.

Before the MMR vaccination was created, mumps, a potentially fatal viral infection, was often contracted by youngsters.

The World Health Organization (WHO) reports that in 2021, 15 million additional children worldwide failed to receive their second dosage and that approximately 25 million youngsters missed their first vaccination.

Measles infections have also been increasing recently in the US, with an epidemic in Ohio infecting over 80 kids.

According to specialists from the University of Georgia, children should receive a routine booster to protect them from these diseases.

By the age of 18, 33% of persons had lost their immunity from vaccinations, according to doctors’ research in the Proceedings of the National Academy of Sciences.

The Centers for Disease Control in the US reports that as of January 5, 2023, a total of 322 mumps cases were recorded by 42 jurisdictions in 2022.

According to the CDC, mumps cases have risen steadily since 2006.

According to data from the UK Health Security Agency, there were 1,123 instances of mumps in the UK in the second quarter of 2022, up from 880 cases in the first quarter.

What Are The Signs And Symptoms Parents Should Look Out For?

The NHS states that symptoms of mumps usually develop 12 to 25 days after becoming infected with the mumps virus.

Guidance states that the signs to look out for include:

  1. Swelling of glands
  2. Pain and difficulty swallowing
  3. headache
  4. joint pain
  5. feeling sick
  6. dry mouth
  7. mild abdominal pain
  8. feeling tired
  9. loss of appetite
  10. a high temperature

According to doctors, one in six occurrences of the mumps will go undetected.

However, the UKHSA’s most recent data indicates that scarlet fever rates are also increasing, in addition to mumps infections.

There have been 35,616 notifications of scarlet fever so far this season (from 19 September to 1 January).

While cases in that season started to rise at a different point, this compares to a total of 4,192 at the same point in the year during the most recent comparable high season in 2017 to 2018.

Overall over the years of 2017 and 2018, there were 30,768 notifications of scarlet fever.

Invasive strep A cases have increased as well; 34 kids in the UK have now passed away from the condition.

Strep A infections are transferred through close contact with an infected individual, according to recommendations.

Then they can spread from a wound or through sneezes and coughs.

A Group A bacteria called Streptococcus, or Streptococcus pyogenes, can produce a minor sickness.

This can include tonsillitis, cellulitis, and scarlet fever, a flu-like condition that typically affects youngsters and can be deadly if not treated quickly with antibiotics. It can also involve sore throats and skin infections.

The bacteria can occasionally cause invasive Group Strep. a condition that may be deadly or life-threatening.

Symptoms of invasive strep and scarlet fever you need to know

There are four key signs of Group Strep A to watch out for, according to the NHS. These are:

  1. A fever (meaning a high temperature above 38°C)
  2. Severe muscle aches
  3. Localised muscle tenderness
  4. Redness at the site of a wound

The invasive version of the disease happens when the bacteria break through the body’s immune defenses.

This can happen if you’re already feeling unwell or have an immune system that’s weakened.

The NHS says that when it comes to scarlet fever, your child will most likely start off with cold-like symptoms.

  1. high temperature
  2. sore throat
  3. swollen neck glands
  4. rash 12-48 hours after initial symptoms. This usually starts on the tummy and then spreads
  5. white coating on the tongue
  6. red cheeks

In seven hospitals throughout the UK, six in England and one in Wales, the contaminated milk was used to feed some premature newborns.

According to The Sun, the milk was also distributed to 35 clients via the company’s online store.

According to the Food Standards Agency, tests showed milk provided by NeoKare Nutrition had high amounts of hazardous metal. This metal can be particularly detrimental for young children (FSA).

The list of hospitals affected has not been made public, but the NHS has informed the parents of the children who received the milk products.

Lead poisoning, according to the World Health Organization (WHO), can lower children’s IQs and promote antisocial behavior.

The FSA stated that even though the product was recalled, the lead levels in the milk were not deemed to be seriously hazardous.

According to NeoKare Nutrition, the risk of youngsters consuming contaminated milk products is “minimal.”

“It’s likely that the exposure to lead from these products only lasted a short while.

The company stated on its website that “adverse effects from lead often develop from repeated exposure over a prolonged period of time.”

Both the FSA and Trading Standards have advised all products sold by the company to be withdrawn and recalled as a precaution.

A small number of customers who purchased the affected products online have been notified by the pharma company.

The recall notice affects four products that had been available to purchase online. They include:

  • MOTHER’S MILK FORTIFIER (MMF) POWDER 10 x 1g, food for special medical purpose, supplied to NHS Hospitals only for use predominantly in clinical trials involving preterm babies, not available for retail sale
  • PASTEURISED HUMAN BREAST MILK (PHBM) POWDER 6g (supplied direct to customers online)
  • 70CAL LIQUID FROZEN 15ml and 50ml, (supplied to the NHS Hospitals and supplied direct to customers online)
  • PASTEURISED HUMAN BREAST MILK (PHBM) LIQUID FROZEN 50ml (supplied direct to customers online)

A naturally occurring metal in the environment is lead.

Due to its presence in soil and water, it is found in many foods at extremely low quantities.

Due to lead’s presence in food, everyone has some minimal exposure to lead through diet.

The FSE stated that inquiries into the circumstances behind the increased lead levels are “ongoing.”

The affected parents and guardians are obviously concerned about this situation, according to Junior Johnson, head of operations at the FSA. In order to assess the risk to health, which is probably modest, we worked closely with the public health authorities and the NHS.

“The company recalled the products on the recommendation of the FSA and Trading Standards, and we made sure to contact customers and patients.

“Retail consumers and families whose children received the items have received additional support.

“We continue to collaborate with Trading Standards to make sure that the public is not at further risk for food safety.”

Lead has been discovered in a small number of NeoKare Nutrition products, so we have been collaborating with the local government and the Food Standards Agency.

We have adopted the cautious approach to recall all the items made by NeoKare Ltd. because we place the public’s health first.
