Tragic Loss: Montana Boy’s Death on Carnival Ride Sparks Lawsuit Over Missing Safety Restraints

0

In a tragic incident that unfolded last month, a 13-year-old boy lost his life after being ejected from a “Yo-Yo” carnival ride in Montana. A lawsuit has been filed, claiming that the carnival’s operators ignored crucial safety procedures, running the ride despite the absence of several seats and necessary restraints.

The case, brought forth by the estate of Clayton Phillips, contends that Midway West Amusements, the company behind the ride, was aware that at least ten of the ride’s chairs were missing pelvic safety belts, as well as crucial clips and connectors.

Instead of addressing these serious deficiencies, the company allegedly depended solely on employees’ memory and verbal guidance to ensure those malfunctioning chairs remained unoccupied, as outlined in the lawsuit.

The Phillips family has launched a legal battle, alleging that negligence by employees led to the tragedy. They claim that operators ran the “Yo-Yo” ride at the Butte carnival, placing young Clayton Phillips in a precarious seat despite missing critical safety components. (WireImage)

The lawsuit further asserts that, due to inadequate training, employees placed Phillips in one of the unsafe chairs, contributing to the fatal incident. Meanwhile, the claim sheds light on shocking oversights in addressing the ride’s safety issues.

“C.J.P. was thrown, ejected, and/or fell from the moving Yo-Yo … fell from a substantial height and violently struck the ground and/or surrounding surface,” the lawsuit states.

Designed to swing outward and elevate passengers as its rotational speed increases, the Yo-Yo ride hurled Phillips from his seat; he died from his injuries two weeks later.

The lawsuit names the government of Butte-Silver Bow, Midway West Amusements, ride inspection company Shady Acres Safety Services, and its owner, Dennis Sutherland, as defendants. They did not immediately respond to News Media’s requests for comment.

It also cites 20 unidentified individuals or entities — including managers, ride operators, maintenance personnel and contractors — whose specific roles and identities were unknown at filing.

According to the lawsuit, Midway West representative Michelle Jensen admitted to the ride’s mechanical deficiencies when interviewed by law enforcement after the crash.

Kyle Shanahan Hilariously Roasts Robert Saleh Over Bizarre 49ers Practice Moment

0

In a surprising display of sportsmanship, the San Francisco 49ers maintained calm during their joint practice session with the Los Angeles Chargers, all without needing a pep talk from head coach Kyle Shanahan about avoiding scuffles.

Unlike the previous week’s tumultuous encounter with the Tennessee Titans, Tuesday’s joint practice unfolded without a single altercation, lasting nearly two hours. This peaceful conduct marked a stark contrast to the chaos witnessed in Nashville.

When questioned on whether he advised his team on maintaining composure, Shanahan turned the conversation light-heartedly by poking fun at former 49ers defensive coordinator and current Titans head coach, Robert Saleh.

“No, their head coach [Jim Harbaugh] showed more discipline than Tennessee’s,” Shanahan quipped, playfully referencing his colleague’s leadership style.

However, Shanahan was quick to clarify that his comment was all in good humor, reinforcing the friendly rapport he shares with his longtime associate.

Shanahan explained that several incidents occurred early in the 49ers’ practice with Tennessee, causing tension to escalate throughout the session.

The Tennessee practice featured four fights during the opening 10 minutes of team drills. Titans offensive linemen Austin Deculus and Dan Moore Jr. were ejected for throwing punches, and Shanahan removed two of his own players from the session. The identity of those two 49ers was never divulged.

The difference against Los Angeles was striking. Reporters described Tuesday’s session as unusually peaceful by joint-practice standards, despite both teams working in full pads.

Saleh served as San Francisco’s defensive coordinator from 2017-2020 before leaving to become head coach of the New York Jets. He returned to the 49ers for the 2025 season and then received a second head-coaching opportunity with Tennessee.

The two coaches also worked together with the Houston Texans from 2006-2009.

Harbaugh also has ties to San Francisco, having led the 49ers to three consecutive NFC Championship Games and one Super Bowl appearance during his four seasons as head coach.

His Chargers may have been more disciplined than Saleh’s Titans, but they were certainly not more accommodating. Justin Herbert and the Chargers offense repeatedly exposed San Francisco’s secondary during the practice.

The 49ers did not throw any punches Tuesday.

But, Shanahan saved a shot for Saleh.

Hurricane Alert: Second Major Storm in Two Weeks Approaches US Coast

0

A powerful storm system has emerged in the Pacific Ocean, bearing down on Hawaii just days after the island was battered by Hurricane Lala, which tragically resulted in the loss of at least two lives and extensive damage.

Weather experts indicate that this newly developing storm has a strong likelihood, about 90 percent, of intensifying into a tropical cyclone by Friday.

Forecasts by AccuWeather predict that this colossal system will advance to hurricane strength by Saturday and could potentially come within 100 miles of Hawaii’s Big Island shortly thereafter.

Despite various projections, the spaghetti models, which illustrate a range of possible storm tracks, suggest a scenario where the storm could make a direct impact on the Big Island as soon as Sunday.

According to AccuWeather’s lead hurricane expert, Alex DaSilva, the Big Island is particularly vulnerable to flooding, given the recent severe flooding and mudslides caused by Lala over the previous weekend.

Early forecasts predict that the Big Island and its closest neighbor, Maui, could see between four and eight inches of rain as the hurricane passes. Some areas on the Big Island may see closer to 12 inches of rain, with AccuWeather warning of a worst-case scenario of 24 inches.

Police in Hawaii have blamed two deaths on Hurricane Lala, which struck Hawaii on August 15 and caused an estimated $3-5 billion in destruction, including 100 homes being damaged or washed away in floods and mudslides.

Currently named Invest 90, the developing storm is less than 1,400 miles from Hawaii. If a cyclone forms and it reaches sustained winds of 39 to 74 mph, the National Hurricane Center will rename it Tropical Storm Iselle or Moke, depending on its location in the Pacific at that time.

Officials with NHC described the approaching storm as ‘producing showers and thunderstorms that continue to show signs of organization.’

‘A tropical depression is likely to form during the next day or so as the system moves westward,’ the weather agency’s forecast revealed.

A tropical depression is the first stage of a tropical cyclone, where a low-pressure area forms with thunderstorms and relatively low winds.

However, these systems can quickly turn into a named tropical storm once those winds grow to a sustained speed of 39 mph with the classic swirling shape and defined center.

Currently, AccuWeather has predicted that Invest 90 will grow into a Category 1 hurricane, meaning it is expected to develop sustained winds of 75 to 95 mph.

Hurricane Lala struck Hawaii as a Category 1 storm, with it eye coming within 30 miles of the Big Island.

Spaghetti models suggest the new hurricane could take a very similar path, although several tracks predict it will stay farther south.

‘The rainfall amounts and location of the rain is going to be largely dependent on the storm track, which could move farther south and largely miss the islands. That doesn’t mean there wouldn’t be significant impacts to land, though,’ DaSilva warned.

Hawaii’s Governor Josh Green said that 100 homes were damaged or lost in floods and mudslides during Hurricane Lala last weekend

Governor Josh Green of Hawaii revealed that Lala damaged or destroyed over 100 homes on Hawaiʻi Island, better known as the Big Island, with most of the devastation coming during severe flooding and mudslides in the Kaʻū District on the southside of the island.

The Hawai‘i Police Department also announced that 93-year-old May Doi, who was found in the Kaʻū District, and another unidentified man were both killed during the hurricane.

This is a breaking story. More details to follow.

Boost Knee Strength Fast: 5 Essential Kitchen Counter Exercises for Over 60s

0

Concerned about knee safety after 60? Discover how these five simple exercises, performed at your kitchen counter, can help you rebuild strength with ease.

>

While leg presses are excellent for enhancing lower-body strength in a controlled manner, strengthening your knees requires movements that mimic everyday actions. Using your kitchen counter as a support can aid your legs in relearning essential motions—like bending, stepping, maintaining stability, and confidently pushing through the floor.

Having the counter as support makes a notable difference. Positioned right in front of you, it offers a convenient and less intimidating starting point for your workout routine. This setup allows you to adjust the range of movements and pace them slowly, providing your knees with the stability needed to build strength without a full-scale gym session.

As a coach, when dealing with clients who are apprehensive about their knees, I often recommend beginning with a counter for support before progressing to heavier-loaded movements. This approach allows them to relax into better repetitions. As the exercises become smoother, clients typically gain more confidence in their legs, transforming their training experience.

The following exercises utilize the kitchen counter as a stable base to enhance lower-body strength and overall balance. These movements focus on improving knee control, single-leg strength, and quad support, contributing to smoother and more effective overall mobility.

Counter-Supported Squat

The counter-supported squat helps rebuild knee strength through one of the most useful lower-body patterns. You’re training your knees to bend and straighten while your quads, glutes, and hips share the work. The counter adds confidence, which can help you get more quality reps without feeling like balance is the limiting factor. Over time, this exercise can make standing from a chair or moving up steps feel more controlled.

Muscles Trained: Quadriceps, glutes, hamstrings, core.

How to Do It

  1. Stand facing a sturdy kitchen counter.
  2. Place both hands lightly on the counter.
  3. Set your feet about shoulder-width apart.
  4. Bend your knees and lower into a comfortable squat.
  5. Press through your feet to stand tall.
  6. Repeat with steady control.

Recommended Sets and Reps: Perform 2 to 3 sets of 8 to 12 reps.

Best Variations: Smaller-range counter squats, slow-tempo counter squats, counter squat with a pause.

Form Tip: Keep your feet planted and use the counter for balance, not to pull yourself up.

5 Daily Moves That Make Getting Off the Floor Easier After 65

Counter-Supported Reverse Lunge

The counter-supported reverse lunge gives each leg focused strength work. That matters after 60 because one side often feels more reliable than the other, especially when the knees feel stiff or guarded. Stepping backward keeps the movement controlled, and the counter helps you stay steady while the front leg handles most of the effort. This move builds strength around the knee while also improving confidence with stepping patterns.

Muscles Trained: Quadriceps, glutes, hamstrings, calves, core.

How to Do It

  1. Stand facing the counter with both hands resting lightly on it.
  2. Stand tall with your feet about hip-width apart.
  3. Step one foot back.
  4. Bend both knees to a comfortable depth.
  5. Press through your front foot to return to standing.
  6. Alternate sides or complete all reps on one leg before switching.

Recommended Sets and Reps: Perform 2 to 3 sets of 6 to 10 reps per side.

Best Variations: Step-back taps, smaller-range reverse lunges, reverse lunge with a pause.

Form Tip: Keep most of your weight in the front leg as you return to standing.

Counter-Supported Split Squat

The counter-supported split squat builds knee strength by keeping one leg in a working position for the full set. That gives your front thigh steady tension and helps your hips support the movement. The counter makes the exercise easier to control, which is helpful when you’re building strength through a range that still feels new. It’s a strong bridge between basic squats and more demanding single-leg work.

Muscles Trained: Quadriceps, glutes, hamstrings, core.

How to Do It

  1. Stand beside or facing the counter.
  2. Step one foot back into a split stance.
  3. Hold the counter lightly for balance.
  4. Bend both knees and lower a few inches.
  5. Press through your front foot to rise.
  6. Complete all reps, then switch sides.

Recommended Sets and Reps: Perform 2 to 3 sets of 6 to 10 reps per side.

Best Variations: Smaller-range split squats, supported split squat holds, slow-tempo split squats.

Form Tip: Keep your front heel down through the full rep.

5 Nightly Stretches That Loosen Tight Hips Faster Than Foam Rolling After 60

Counter-Supported Standing Leg Extension

The counter-supported standing leg extension gives your quadriceps direct work, which is important for knee support after 60. Stronger quads can help the knee feel steadier during walking, stairs, and standing movement. This version keeps the setup simple because the counter handles balance while the working leg focuses on straightening and controlling the knee. It’s a useful way to train the front of the thigh without needing a leg-extension machine.

Muscles Trained: Quadriceps, hip flexors, core.

How to Do It

  1. Stand beside the counter and hold it lightly with one hand.
  2. Shift your weight onto one leg.
  3. Lift the opposite knee in front of you to a comfortable height.
  4. Straighten that knee until your leg extends forward.
  5. Bend the knee again with control.
  6. Complete all reps, then switch sides.

Recommended Sets and Reps: Perform 2 to 3 sets of 8 to 12 reps per side.

Best Variations: Smaller-range leg extensions, seated leg extensions, band-resisted leg extensions.

Form Tip: Keep the lifted thigh steady as the lower leg moves.

Shockwaves in WNBA: Sophie Cunningham Challenges Commissioner Cathy Engelbert’s Leadership

0

Indiana Fever guard Sophie Cunningham believes that a shift in leadership could positively impact the WNBA’s future.

In a recent conversation with USA Today, Cunningham, who has previously been at the center of discussions about transgender athletes in women’s sports, opened up about her views on commissioner Cathy Engelbert’s tenure. She suggested that Engelbert’s role might be up for grabs by the end of this year’s league activities.

“It’s crucial to have a leader who is courageous, confident, and prioritizes the players’ interests over personal gain,” Cunningham stated. “While I think this role could be available at year’s end, it’s ultimately not my decision to make.”

Engelbert, now in her seventh year steering the WNBA, is currently contracted to serve as commissioner until the conclusion of the 2026 season.

Acknowledging the inherent difficulties of any leadership role, Cunningham highlighted the significance of supportive leadership in fostering players’ development.

“(Cathy Engelbert’s) done a lot of good things, but with where our league is trying to go, I feel like you just want someone who also wants that,” Cunningham said. “That’s just a hard position to be in, in her shoes, us as players ― we always want more, more, more because we see how good it can be, but … that’s up to [NBA commissioner] Adam Silver at the end of the day.”

During a mid-July press conference at NBA Summer League, Silver was noncommittal on Engelbert’s future with the league.

“I think Cathy continues to do a strong job building that league,” Silver said, noting that he didn’t want to speak for Engelbert. “We’ll have ongoing discussions about what the future looks like.”

Silver added that he was “pleased” with the “tremendous progress” made under Engelbert — who was at the helm for a contentious CBA agreement in March, as well as six new expansion teams.

The Golden State Valkyries — the newly announced host for the 2027 WNBA All-Star game — joined the league in 2025.

Both the Toronto Tempo and Portland Fire launched in 2026. The Cleveland Sirens are set to begin play in 2028, followed by Detroit in 2029 and Philadelphia in 2030.

Despite the league’s growth, Engelbert came under fire for relationships with players, or lack there of, as well as the handling of social justice issues and treatment of players on and off of the court.

Other players, such as Minnesota Lynx star Napheesa Collier, have voiced their displeasure with Engelbert at the helm.

Tragic Loss: Infant Conceived via IVF Dies in Hot Car Incident Involving Doctor Grandmother

0

With a heart full of panic and despair, Stacey Fazenbaker raced across the parking lot of her medical practice toward her car.

Inside the vehicle was her ten-month-old granddaughter, Scottie Gwyn Crowell, who should have been dropped off at daycare eight hours earlier.

According to police reports, instead of heading to daycare, Fazenbaker drove to the Owensboro Health Multicare in Madisonville, Kentucky, where she works as a family doctor, apparently forgetting that Scottie was in the back seat.

The frantic effort to reach the car ended in heartbreak. Scottie was found unresponsive in her car seat as the day’s temperature had surged to 95 degrees Fahrenheit, far higher within the confines of the car, officials stated.

At 61, Fazenbaker had relocated to Madisonville just a year prior to be closer to her 33-year-old daughter, Sydni Crowell, who works as an OB/GYN at a nearby clinic.

Madisonville Police said Crowell had an early shift last Thursday, and asked Fazenbaker to pick up the baby girl and take her to daycare on her own way to work.

As a doting grandparent, she was eager to help ferry Scottie and her three-year-old brother around to give their working parents a break, and picked her up between 6.45 and 7am.

But like dozens of American parents, family and caregivers every year, police said this time she forgot the baby girl was right behind her.

No one realized what had happened to Scottie until her father, Micah Crowell, arrived at the daycare about 4pm and was told she was never dropped off.

Police said the confused dad called his wife, who rang Fazenbaker for the worst conversation of her life.

‘She (Fazenbaker) ran outside with some co-workers to get the child. But it was far too late by then,’ Madisonville Police Major Jason McKnight told reporters.

‘Officers arrived on scene, [paramedics] and the fire department arrived shortly after they did, and they found the infant.

‘The grandmother had already got the child, and so the officers tried some lifesaving measures, but unfortunately it was too late for that.’

Officers said they were investigating Scottie’s death and urged locals to leave the infant’s family alone while they do their jobs.

Scottie was born on September 20, 2025, via in vitro fertilization, after her parents failed to conceive when trying for a second child.

‘After a failed embryo transfer, this beautiful IVF baby has brought us such joy,’ Crowell wrote next to a photo of her swaddled newborn.

Crowell had only just started at Baptist Health Deaconess in February last year after completing her residency at Mercy Hospital in St Louis.

Photos on her social media accounts showed the adorable baby girl playing at the beach and being cuddled by her big brother.

Those posts have been replaced by announcements of Scottie’s funeral at Barnett-Strother Funeral Home on Thursday, with donations to a memorial fund.

‘We love you so much, our sweet baby girl,’ Sydni’s sister Emmy Fazenbaker, a sports reporter for Middle Tennessee State University, wrote.

Fazenbaker’s family did not answer calls from the Daily Mail.

No charges have been laid against Fazenbaker, and police said they were still investigating exactly what happened.

‘This case is actively being investigated by detectives as they gather video footage, interview coworkers, speak with daycare workers and look at phone records,’ McKnight said.

‘As the picture becomes clearer on how this could have possibly happened, there is a possibility charges are sought before the grand jury convenes.’

Fazenbaker had a blood test for drugs and alcohol that is still being processed, but police said they don’t expect it will come back positive.

An autopsy was done on Scottie’s body last week as part of the investigation.

Fazenbaker’s patients, both in Madisonville and her former practice in Owensboro, rallied to her defense online.

‘She is the most caring person and doctor I have ever met. She has helped thousands of people with her functional health knowledge,’ Angela Ocasio wrote.

‘She moved to Madisonville to be close to her family and grandchild. It was a mistake, we all make them, unfortunately this was a fatal one.

‘This is a life altering situation for many people. Praying hard for her, the family, and everyone else affected by this.’

Theresa Tichenor, who said she was a former patient, added: ‘She will spend the rest of her life with regrets. You’re not in her shoes, please don’t judge.’

Other patients recalled how Fazenbaker prayed with their husband when he was diagnosed with stage four cancer, and was ‘the only doctor who cared enough’ to diagnose and treat their son.

Police have said they wanted to fully investigate the incident before deciding whether Fazenbaker should face criminal charges.

‘We understand the emotions the community is feeling in this case… We are not sitting idle waiting to present this to the grand jury,’ McKnight said.

Police can level various charges from neglect to manslaughter after hot car deaths, depending on what harm comes to a child and the circumstances surrounding them being left.

However, parents who mistakenly believe their children were not in the car are often not charged as the pain of losing a child is considered punishment enough.

About 37 children die from being left in a hot car every year across the US, including at least 23 in Kentucky since 1998, according to statistics by No Heat Stroke.

Texas and Florida had by far the most deaths with 155 and 115, and the hot South and South West had the most per capita.

Children can’t regulate their temperature as efficiently as adults and their body temperatures warm three to five times faster.

Heatstroke sets in when body temperature reaches 104F and organs begin to shut down at 107F.

Temperatures inside a car can rise to 104F in just half an hour on a 70F day, and reach 115F in an hour. On a 95F day it would get to 140F in an hour.

Cracking the window only reduces the internal temperature by about 3F.

As difficult as it is to imagine forgetting your child in a car, experts explain that parents often function on autopilot and lose awareness that a child is there.

No Heat Stroke suggested putting a soft toy in the front seat to remind you there was a child in the car, or putting items you need in the back seat next to the child.

Vehicles should also be locked at all times and keys kept out of reach to stop curious children climbing in and getting locked inside.

Tucson Shooting: Urgent Manhunt for Killers of Police Recruit, Wounding of Corrections Officer

0

In Arizona, a manhunt is underway following a tragic early morning shooting that claimed the life of a 23-year-old Tucson police recruit. The victim’s 23-year-old partner, who works as a corrections officer in Pima County, was also injured, sustaining a gunshot wound that has left her hospitalized, according to official reports.

The Pima County Sheriff’s Department has disclosed that they are actively searching for several suspects. Described as Hispanic males, the suspects were last seen wearing black attire and ski masks. They were traveling in a gray Acura MDX, which is notably missing the piece covering the gas cap.

Originally reported as husband and wife, the couple’s relationship status is clarified as engaged by authorities, with the additional information that they share a child together, according to Sheriff Chris Nanos.

“This is a pretty sad day for law enforcement today,” Sheriff Nanos expressed solemnly during a Wednesday news briefing, highlighting the emotional impact of the incident on the community.

Authorities have described the suspect vehicle as a gray Acura MDX from between 2007 and 2013. The door over the gas cap may be missing. Two male suspects described as Hispanic, wearing all black with ski masks.

The initial call came in at 6 a.m. regarding a home in the 7700 block of South Enchanted Spring Drive, about 17 miles southwest of Tucson.

Responding deputies found the male victim, later identified as TPD recruit Carlos Ramirez, dead and rushed the female to a hospital, where she was in stable condition, the sheriff said.

Tucson Police Chief Monica Prieto is asking anyone with information to call 911.

Tragic Claustrophobic Death of Midwest Worker in Storm Drain

0

In a heart-wrenching incident in Ohio, a construction worker lost his life while laboring in a storm drain that became perilously “deep and dangerous,” as per the findings of federal investigators.

The worker, identified as 28-year-old Jose Alberto Barajas Martinez, tragically died during efforts to replace a storm drain within an eight-foot trench that succumbed to a collapse at a job site in Milford, according to official records.

This devastating event, which occurred on December 5, not only claimed Martinez’s life but also injured two colleagues who were laying down corrugated piping in a residential area, as reported by federal documents acquired by the Cincinnati Enquirer.

Miami Township Fire Chief Dave Jetter recounted to Fox News that emergency responders arrived to find one worker unconscious and completely entombed while the other two were partially buried yet conscious.

Faced with the treacherous instability of the trench, rescuers could not immediately enter the area. Instead, a painstaking effort unfolded as the earth was methodically removed, bucket by bucket, to reach and recover the trapped men.

Emergency responders told investigators that one victim suffered eight fractures while the other was left with two fractured ribs. Both suffered arterial, cardiac and lung injuries, according to the outlet.

They also developed rhabdomyolysis, in which damaged muscle tissue breaks down and releases harmful substances into the bloodstream.

Investigators with the Occupational Safety and Health Administration found that cave-in protections required by federal safety rules were lacking from the excavation, the outlet reported.

David Baumgardner, the owner of the 37-year-old company, said he thought of Barajas, whose memorial is pictured, as a friend

David Baumgardner, the owner of the 37-year-old company, said he thought of Barajas, whose memorial is pictured, as a friend

The company did not conduct acceptable inspections of the worksite and did not properly train workers to identify hazards or provide a safe exit and did not keep the excavated soil and equipment at a safe distance, investigators alleged, according to the outlet.

The Whispering Creek worksite was found to have had no ladders in the trench as the workers were rescued by emergency services, according to investigators.

Agency standards require worksites to use protective systems such as a trench box, sloping or shoring for all trenches deeper than five feet, the outlet reported.

The trench was found to have had none of these in place, investigators said.

Whispering Creek LLC, which provides landscaping and pool installation services, were served with five violations, proposing penalties totaling $231,714 before a settlement brought the total down to $49,000, records seen by the outlet showed.

David Baumgardner, the owner of the 37-year-old company, said he thought of Barajas as a friend.

‘I actually saved one of the workers myself,’ he told the outlet. ‘You try to provide an opportunity for people to make a better life for themselves, and it can ruin your whole life personally.’

Baumgardner allegedly had knowledge of the depth and layout of the collapse due to his being on the worksite, agency investigators found.

Records indicated that Whispering Creek had not been previously inspected or cited by the agency, according to the Enquirer.

Jaime Barajas, the father of Barajas Martinez, was identified as one of the survivors of the incident, a GoFundMe said.

Baumgardner told the outlet that the employees have been paid compensation and that he expected felony charges.

‘We helped them out as much as we can,’ he noted.

Baumgardner added that one survivor has since returned to work while the other is still recovering.

A police report from the incident lists possible charges of reckless homicide and negligent assault. No charges have yet been filed.

The Clermont County Prosecutor’s Office is reviewing the case.
