The Public Prosecution Service (PPS) notified the family of Daniel Hegarty, who was slain in July 1972, on Friday that the veteran, also known as “Soldier B,” had passed away on Thursday.

On July 31, 1972, while the British Army was conducting Operation Motorman in the city’s Creggan neighborhood, Soldier B was in danger of going to jail.

An operation to recover alleged “no-go areas” established by republican paramilitaries in towns and cities throughout Northern Ireland was given the codename.

The PPS declared in July 2021 that it was abandoning the soldier’s case. Still, the decision was overturned by the Court of Appeal in August 2023 after the Hegarty family filed a lawsuit.

The Hegarty family criticized the PPS for “dragging out the case” in a statement released on Tuesday, claiming “they took no delight” in Solider B’s passing.

A spokesperson said, “They never really wanted to prosecute Soldier B for killing a child. They had to be dragged by us through nearly 15 years of grueling litigation to that position.”

According to Stephen Herron, director of public prosecutions, “any potential prosecution in relation to them is over when a defendant passes away.”

“We vehemently refute any allegations that the PPS engaged in conduct prejudicial to the administration of justice or improperly sought to halt or postpone any prosecution of Soldier B,” he continued.

He stated, “I understand that this is a very trying time for the family of Daniel Hegarty who had sought and pushed for a criminal justice conclusion in this matter for many decades.

He continued that it was “complex and challenging” to make decisions in the case against Soldier B. He claimed that “relevant evidential and public interest considerations” had further complicated the situation.

The lengthy nature of the multiple sets of legal processes, Mr. Herron said, “caused additional distress to the Hegarty family and resulted in a series of judicial review challenges to decisions that were taken.”

Colum Eastwood, a Foyle MP, noted the Hegarty family’s “grace in their response to this news.” No one has won in any of this, I repeat. According to the SDLP leader, families like the Hegartys merit justice and the truth.
