In a significant turn of events, Manhattan prosecutors petitioned a judge on Monday, seeking to counter what they identified as misleading statements made by Mangione’s defense about media access. They are also reminding the defense of their ethical responsibilities in this high-stakes case.

The legal maneuver follows closely behind claims from Mangione’s legal team that the current framework for media and public attendance violates his right to an open trial. The attorneys further contend that the Manhattan District Attorney’s Office played a role in deciding which media outlets gain access to cover the proceedings.

Manhattan prosecutors firmly rejected these claims, stating their office had no involvement in deciding the New York State Office of Court Administration’s strategy for media access or in selecting which journalists would get to report on the trial.

Senior Trial Counsel Joel J. Seidemann addressed Judge Gregory Carro directly, noting that, “The defense’s baseless accusation thus appears to be nothing more than an attempt to spread misinformation about this case and delegitimize the proceedings.”

The Manhattan District Attorney’s Office asked Carro to remind Mangione’s attorneys of their ethical obligations not to knowingly make false statements to a court or third parties, citing New York’s Rules of Professional Conduct.

In Friday’s filing, defense attorneys Karen Friedman Agnifilo, Marc Agnifilo and Jacob Kaplan argued the court’s media access restrictions amount to a partial closure of the proceedings in violation of the First, Sixth and Fourteenth Amendments.

The attorneys objected to the lack of an overflow courtroom, limits on jury selection coverage and what they described as a process allowing only a select group of reporters to attend the trial.

They also claimed they were told only 68 journalists would receive general access to the proceedings and that the selection process had effectively been outsourced to a private attorney representing several legacy media organizations.

Mangione’s attorneys asked the court to hold a public hearing, identify the journalists selected to cover jury selection and the broader trial, explain how those reporters were chosen and detail efforts to secure an overflow courtroom.

They also asked the court to either broadcast the proceedings live or explain why that would not be permitted.

Prosecutors responded Monday that the defense had wrongly implicated the district attorney’s office in decisions made by the Office of Court Administration.

“The District Attorney’s Office had no role in developing the Office of Court Administration’s media access plan for this trial, and will have no role in selecting which news reporters attend the trial, as defense counsel surely knows from her long prior association with this office,” Seidemann wrote in the filing.

News Media has reached out to Friedman Agnifilo and Mangione’s spokesperson for comment on the matter.

Mangione is charged in New York state court with murder and terrorism-related offenses in the Dec. 4, 2024, fatal shooting of UnitedHealthcare CEO Brian Thompson outside a Manhattan hotel. He has pleaded not guilty.

A heated dispute has emerged in Santa Barbara, centering around a proposed mansion perched on a scenic cliff, which many worry could point to a trend of “McMansionization” transforming the city’s delicate coastal landscapes.

In a recent meeting, the Santa Barbara City Council decided, in a narrow 4-2 vote, to dismiss an appeal that sought to contest the plans for a two-story residence along with its accompanying structures in the Mesa neighborhood.

With this decision, the project is set to move forward despite vocal opposition from locals concerned about its considerable size, potential threats to emergency response access, complications with utility connections, privacy issues, and the integrity of the bluff, which suffered a partial collapse in the winter of 2023, according to Noozhawk.

The appeal against this cliffside development was put forth following the Santa Barbara Planning Commission’s initial approval of the plan.

Reportedly, Councilwomen Kristen Sneddon and Wendy Santamaria stood in favor of the appeal, while Councilman Mike Jordan abstained due to his proximity to the proposed building site.

Although the council allowed the project to move forward, several members voiced concern over the growing number of oversized homes along Santa Barbara’s blufftops.

Sneddon questioned the Single Family Design Board’s decision to approve the project, saying it seemed to go against the board’s original purpose.

“The whole reason (the Single Family Design Board was) formed was to prevent McMansionization, and these, to me, are the example of what should not be on the bluff,” she said.

Neighbor Alexandra Hack, who filed the appeal, argued that the size of the home could block emergency access to her property and affect an existing utility connection.

Santa Barbara Fire Marshal Ryan DiGuilio told the council both properties would keep emergency access, explaining the planned 16-foot driveway would let fire engine hoses reach the farthest edge of the property from the street.

Hack also raised concerns that relocating a proposed utility pole could interrupt service.

Jarret Gorin of Vanguard Planning, representing the property owners, said they would coordinate with neighbors to ensure their power was not cut off.

The property drew additional scrutiny because part of the bluff collapsed during the winter of 2023.

Gorin told the council the owners completed a stabilization project and the home would be built about 38 feet from the bluff’s edge.

Other neighbors also urged the council to reject the development.

Kelly Boker argued the home’s size and the removal of privacy foliage would make it intrusive and called the project “vastly out of proportion and out of character” for the Mesa neighborhood.

“The fact that the size of the construction and pool on a bluff that has already been compromised is even being considered is mind-boggling,” Boker said.

Councilman Eric Friedman said he understood where neighbors were coming from but believed the council lacked the technical evidence needed to overturn the Planning Commission’s approval.

Meanwhile, Councilwoman Meagan Harmon said she shared concerns about continued development along Santa Barbara’s bluffs but argued the issue should be addressed through broader policy—not individual appeals.

“To me, that’s a recipe, frankly, for more disaster to not look holistically at the bluff face, and instead to start doing it piecemeal on a parcel-by-parcel basis, not in accordance with any set standards, but rather just a gut feeling that I think some of us certainly share,” Harmon said.

Kohberger is now being represented by a new attorney, as he moves forward with his petition for post-conviction relief. This motion aims to retract his self-filed guilty plea, which he submitted approximately a year following his admission to the fatal stabbings of the students in November 2022.

The 30-year-old Kohberger has enlisted the help of attorney Greg Rauch from Moscow, Idaho, to take on his legal defense.

Rauch, in a statement to News Media, mentioned that he has not yet had the opportunity to review the petition or the case file, nor has he spoken with Kohberger. Having just been appointed on Monday morning, Rauch anticipates an initial phone conversation with Kohberger, followed by a personal visit to the prison for further discussion.

“Today, my goal is to set up phone contact with him,” Rauch said. “I gotta read the case file…I gotta check out the police reports. I gotta talk to him.”

Kohberger is being held in the J-Block unit of the Idaho Maximum Security Institution in Kuna, about 300 miles south of where the crimes took place in Moscow, near the University of Idaho campus.

Kohberger pleaded guilty in July 2025 to four counts of first-degree murder as well as a charge of burglary. Judge Steven Hippler sentenced him to four consecutive terms of life without the possibility of parole, plus another 10 years.

The plea deal required Kohberger to waive his right to appeal, however, that doesn’t block him from seeking post-conviction relief, which could reopen the case if successful.

If he succeeds in withdrawing his guilty plea, the case could go to trial, where he would face the potential death penalty.

Kohberger, in a handwritten petition on July 27, 2026, claimed that he was “convinced to falsely confess,” by his high-profile defense team of Anne Taylor, Elisa Massoth and Bicka Barlow. He alleged that they didn’t tell him about “exculpatory discovery” — hair found at the scene that was not tested for DNA. It was excluded as Kohberger’s by a physical analysis.

Idaho Attorney General Raúl Labrador told News Media shortly after Kohberger’s petition was filed that his office is “ready to do whatever is necessary to ensure justice is fully carried out.” 

Police found Kohberger’s DNA on a knife sheath in a bed with two of the four victims, Mogen and Goncalves. They also tracked his vehicle coming and going, and forensic investigators were prepared to testify about how, although he shut his phone off during the murders, the evidence suggested he drove to and from the crime scene anyway. 

Separately, Sy Ray, a former expert witness working for Kohberger’s defense team, last week alleged that there is additional damaging evidence that investigators hadn’t introduced before Kohberger’s guilty plea.

“They’ve got to release this report, because the report that changes everything has not been released,” Ray told News Media Sunday. “It hasn’t been unsealed.”

Ray said that document, known as the location database of record or LOCDBOR report, contains “pattern of life” location data that he alleges shows Kohberger stalked the victims, that he may have been inside the victims’ home before the murders and contains clues as to where he may have disposed of evidence.

“If he ever does walk, he will kill again,” he said.

A group of disgruntled subway commuters claims they’ve been unfairly charged and fined without reason, thanks to issues with their MTA-issued OMNY cards. They are urging New York State’s leading legal authority to dive into what they describe as a major mismanagement, sources reveal.

Passengers United, committed to standing up for everyday city travelers, informed The Post of their plans to gather outside Attorney General Letitia James’ office. Their goal is to demand an investigation into the tap-and-go fare system. The group asserts that this system has mistakenly overcharged countless New Yorkers and improperly levied fees against them.

Charlton D’Souza, president of Passengers United, expressed their concerns to The Post, emphasizing the need for a thorough examination of Cubic, the developer of OMNY. “We are pushing for an inquiry into its flaws, such as overbilling and not displaying payments, which leads to mistaken penalties by fare inspectors,” D’Souza explained.

The organization isn’t stopping there; they’ve sent letters to the Attorney General, city officials, and state lawmakers. These documents include their grievances, along with a petition calling for the Metropolitan Transportation Authority to rectify OMNY problems and bring back unlimited transit passes.

“The patience of New Yorkers has worn thin. We’ve reached our limit,” stated D’Souza, voicing the collective frustration.

MTA head honcho Janno Lieber was pressed on the allegations at the agency’s July 29 board meeting, pledging to fix the issue even while downplaying social media complaints.

“If anybody has an issue where they feel like they’ve been unfairly charged at the turnstile or, God forbid, handed a ticket unfairly, we want to know about it, and we will fix it,” Lieber said.

The MTA and the AG’s office did not immediately respond to requests for comment.

In a fiery appearance on ESPN’s Pat McAfee Show, Aaron Rodgers didn’t mince words, fiercely criticizing Anthony Fauci. His comments were anything but restrained as he took the opportunity to launch a verbal assault.

Known for his skepticism towards vaccines and vocal stance during the Covid-19 pandemic, Rodgers unleashed a scathing critique of Fauci’s actions, particularly following his frequent invocation of the fifth amendment during a tense senate hearing.

As he joined McAfee on set, Rodgers casually inquired about the remaining time on air, to which McAfee mentioned they had a strict cutoff after just eight minutes.

That brief window seemed to be all Rodgers required, as he replied to a question about football by remarking, “I’m going to plead the fifth… just like that complete coward Tony Fauci.”

What followed was an unbroken 13-minute tirade, with Rodgers dominating the conversation, as McAfee and his four co-hosts broadcast live from the Steelers training camp, offered minimal interruptions.

‘Absolute coward,’ he continued of Fauci. ‘Are you kidding me? You got a pardon and you pleaded over 100 times? What are you scared of, Tony? I thought you were the science?

‘You get up there and you can’t answer a question? And how much time did the network spend on that? How much time did they spend on my responses every week? On my vaccination status? On Taylor and Travis’ wedding? Did they do even a minute on Tony Fauci? No, I bet they didn’t.

‘Go back to the coward Tony Fauci, who’s spending the entire time writing in his diary about how fun it is to be famous? What are you going to say about me now? What are you going to say about me now?

‘No, seriously, now that you can’t talk about the Covid stuff, because obviously that was made in a lab in China… that’s not even questionable any more. Tony Fauci is an absolute criminal, I’m on good terms with my family, what are you going to say now?

‘I thought you had a pardon there, Tony. Why couldn’t you answer one question? We got four more minutes, let’s keep this s*** going.’

Rodgers’ furious tirade comes after he was widely criticized in the media and by fans throughout the Covid pandemic due to his skepticism over the vaccine rollout.

He told reporters he was ‘immunized’, leading to question marks over whether he had received the jabs, and he openly criticized the NFL’s protocol to deal with the virus.

Last week, Fauci appeared before the Senate Homeland Security and Governmental Affairs Committee for a volatile hearing on COVID-19.

Fauci refused to answer questions, invoking his Fifth Amendment right not to incriminate himself more than 100 times.

He had been called in front of the committee to be questioned on the origins of Covid, including whether a lab leak from the Wuhan Institute of Virology was more likely than previously acknowledged.

Rodgers, in his appearance on ESPN, claimed that was ‘obviously’ the origin, though the truth is far more unclear and investigations are still ongoing.  

‘I’ve got to give flowers to Stephen A. Smith, my old friend Stephen A,’ Rodgers continued on McAfee’s show. ‘Because he was man enough to actually admit and apologize to Kyrie Irving. So I gotta give a shoutout to my guy Stephen A, you are not a coward. I appreciate you.

‘Other than that, there’s been a lot of silence… 19 seconds on one subject, oh no don’t talk about that. We can talk about Rex Ryan’s foot fetish, but please don’t talk about anything else right now, any scandals. Talk about Taylor and Travis’ wedding, yeah what do insiders know about that?

‘I was endangering my teammates? Now look what happened. They suppressed early treatments, they lied about where it came from. Tony Fauci is writing in his journal, “I don’t want to create any vaccine hesitancy if I tell them what the actual stats are.”

‘Tony Fauci pushing his medicine, just like he did back in the 80s, and now he has an autopen pardon and you can’t answer one question? Not even your name?

At times during the blistering rant, McAfee covered his eyes as the live audience laughed and co-hosts looked on stunned at what they were hearing.

Rodgers, it seems, had been waiting a while for a chance to air his grievances to a national audience.

‘”I Am Science” said six foot of distancing, that’ll be a good thing,’ the Steelers quarterback continued. ‘”If we can scare them enough, they’ll probably take this vaccine that’s had zero trials done for it, we have no idea what the consequences are, there’s no informed consent, you can’t even look at the insert to know what you’re doing, they’re not even pulling the plunger back to make sure they’ve got the right spot in the arm. The insanity!

‘What are you even talking about here? I sat here among a lot of brave Americans who avoided the trillion-dollar propaganda campaign that was hijacked on the American public… and look at us now! Do you have anything to say?’

McAfee then quickly ended the broadcast on ESPN, moving to the YouTube-only portion of the show, and told Rodgers: ‘Now we’re digital, now we continue.’ A co-host joked: ‘Now you can really let loose!’

A resilient grandmother from Tucson, who had previously triumphed over cancer twice, met a tragic end after an alleged assault by a felon near her apartment, according to authorities.

The Tucson Police Department reported that Susan Gehrke, aged 61, succumbed to her injuries four days after being attacked on July 24 at her apartment complex.

Dahseir Edward Jefferson, 27, was taken into custody four days post-incident. Initially charged with two counts of aggravated assault, the charges were elevated to second-degree murder following Gehrke’s passing. He remains detained on a $650,000 bond.

In the aftermath, Gehrke’s family shared with KOLD that her injuries rendered her “unrecognizable.”

“She’s an old lady that literally worked her whole life to support her family, and that’s the most memorable thing that anybody could do,” Gehrke’s grandson, Frankie Zills, told the outlet.

Tucson police officers and firefighters responded at approximately 10 p.m. July 24 to reports of a fight at the apartment complex at 1201 N. Alvernon Way.

Officers discovered Gehrke and a man suffering from injuries, police said. Gehrke was taken to a hospital in life-threatening condition while the unidentified attacker fled before officers arrived.

Investigators learned that Gehrke and the man had been on an apartment patio when Jefferson allegedly approached the area, became confrontational and assaulted both of them, according to police.

The male victim was allegedly punched first and suffered serious injuries after falling to the ground.

Detectives identified Jefferson during the initial investigation and began searching for him, police said. Members of the Tucson Police Department’s community engagement squad located him on July 28 near Speedway Boulevard and Country Club Road and arrested him.

Jefferson had previously served time in an Arizona prison for aggravated assault, according to state records.

He was sentenced to five years in 2021 and released in October 2024. He also had an earlier burglary conviction.

“Susan was a beacon of light to everyone who knew her,” the family said. “She spent her entire life working tirelessly, pouring her heart into her family, and putting others before herself. She was just on the brink of retiring — a milestone she had worked so hard for and was so excited to finally enjoy.”

Her family said that she beat cancer two times.

“Words cannot describe the pain and shock our family is navigating right now. After beating cancer twice, her life was taken by a violent individual with prior criminal charges of violence,” family said.

Detectives with the department’s Robbery Assault Unit and Homicide Unit are continuing to investigate.

In an unexpected move on trade deadline day, the Dodgers have made headlines with a significant deal.
