The fallout from this incident was swift. Public outrage led to the Washington County Board of Education voting to censure Ervin on April 8. Following that, the Washington County Commission expressed its disapproval by passing a vote of no confidence in Ervin on April 27.
Despite the backlash, Ervin has defended his actions, claiming that the video does not portray the full context of the situation. He asserts that his intentions were merely to compliment the student on her articulate questioning during the meeting.
The incident continues to stir debate, with calls for accountability and discussions on the appropriate conduct expected from public officials.
Washington County Schools Superintendent Jerry Boyd provided News Channel 11 with an official statement from the board of education. In the statement, the board acknowledges that it is aware that a charge of simple assault has been filed against Ervin in relation to the incident.
“Board chair Annette Buchannan previously stated that Mr. Ervin’s comments and actions were ‘shocking’ and that he ‘objectified and diminished a young woman,’” the statement reads. “The Board reiterates that Mr. Ervin’s actions do not reflect the standards, policies, or values of the school district. The Board remains committed to ensuring a safe, respectful, and appropriate environment for all students and staff.”
News Channel 11, spoke with Jerry Boyd on Tuesday regarding the impact the situation has had on the school system.
“It’s certainly been a tremendous burden. But none of the burden is placed on the board members or myself or any district member. Compares to probably what the individual student feels,” said Boyd. “So every board member has been concerned about her and how this has impacted her and will impact her. Every board member wishes her the best. And as I said, both her and any student or any staff member that needs some additional supports, we’ll be prepared and are prepared to provide whatever we can.”
Boyd went on to say that they want their students to feel safe and comfortable and that their voices are heard and that they are taking measures to be preventative in th future and ensuring board members are maintaining certain levels of prefessionalism.
“I definitely believe we need to be more mindful about our procedures during our board meetings. Being more strict in following the Robert’s Rules of Order as a structure that will ensure that the level of our board meetings are what they should be,” said Boyd. “But certainly in any situation, you always reflect, you certainly consider what you could have done differently during the moment, but you also focus on what can you do now. And, I know every board member has been in the process of reflecting and acting on how they need to improve our board meetings, what their responsibility is and also what my role will be and how I can support that.”
Boyd said that the situation is a board issue, that they don’t have the authority to take action or to discipline or dismiss an individual board member other than the level of discipline that they have applied and unanimously passing a censure is the extent of their authority against an individual board member.
“We recognize, I recognize both as a most importantly, a father of girls and as a superintendent and a lifelong educator. This is a situation none of us anticipated, the student definitely didn’t anticipate that she would be in that kind of situation in a formal board meeting and honestly, nobody else did either. So we’re taking measures to be preventative in the future, including ensuring that our board members always maintain a certain level of professionalism,” said Boyd.
The school board stated that it will defer to law enforcement and the judicial system regarding the charges against Ervin.
In the statement, the school board also reiterated that it lacks the ability to remove Ervin from office, as he is an elected official.

The Board will defer to law enforcement and the judicial system for the resolution of these charges. Under Tennessee law, school board members are independently elected officials, and so the Board lacks the statutory authority to remove a sitting member from office.
Since this is an open legal matter, neither the Board nor any district official has any further comment. The district’s primary focus remains on the education and well-being of its students, and standard support resources are available to any student or staff member affected by this situation.

The father of the student involved in the April 2 incident shared the family’s thoughts publicly on social media, saying Ervin should not “be anywhere near students” and calling the lack of action by the other board members on the night of the ordeal “equally disturbing.”
The student herself addressed the school board, including Ervin, on May 7. She called the board “cowards” and said Ervin’s actions were “not only unwelcome, but sexist and derogatory.”
Ervin was previously censured in 2009 after reportedly making a lewd gesture of a sexual nature in front of a class at David Crockett High School.
