Heuermann was served with divorce papers while he was in jail on September 22, after 27 years of marriage to Ellerup, Newsday reported.

Macedonio said in August that Ellerup had been battling skin and breast cancer, and was undergoing treatment. He said this week when asked how his client was doing that Ellerup is still dealing with health issues, but that “she’s doing better.”

This has become the new normal,” he told Fox News outside the courthouse. “She’s moving on with life as best she can for her and her children.”

After Heuermann’s arrest, Ellerup claimed she was left without a mattress following police’s initial search of the home she shared with her husband.

“I woke up in the middle of the night, shivering,” Ellerup said in a July 31 interview with the New York Post. “My children cry themselves to sleep. I mean, they’re not children. They’re grown adults but they’re my children, and my son has developmental disabilities and he cried himself to sleep.”

Heuermann, a former Manhattan architect, has been held without bond since his July arrest. Police linked him to the murders with a DNA match found on discarded pizza crust.

Prosecutors have determined that Ellerup and her two children were out of state at the time the murders were committed.

According to her attorney, Ellerup is now under contract with a production company, according to ABC News.

The news outlet also reported that Heuermann is due back in court February 6. Police recently widened their investigation to look into Heuermann’s potential involvement in two other murder victims found near Gilgo Beach.

  1. Change of venue: Citing the case’s pre-trial publicity and the high likelihood of a biased jury, especially after his son George’s conviction in the same courthouse last year, Wagner’s lawyers have been fighting fiercely to move the trial outside of Pike County. 

    “This case is happening in a county that has already heard and already decided [Wagner’s] case,” the defense stated in court documents ahead of oral hearings in the matter last month, according to WXIX.  

    They’ve specifically argued the case falls under presumed prejudice, noting the media coverage leading up to trial could influence jurors. 

    “[The coverage] has contained ‘blatantly prejudicial information’ that no reasonable viewer can be expected to shut from sight,” Wagner’s lawyers added.

    A Pike County judge has yet to render a decision in the matter.
     

  2. New judge: In January of 2023, Wagner’s trial was delayed over the need to appoint a new judge to the case following the retirement of Pike County Judge Randy Deering, WCMH-TV reported. 
     
  3. Conflict of Interest: The appointment of Judge Deering’s replacement, Pike County Prosecutor Rob Junk, further delayed trial proceedings.

    Since Junk served as one of the original prosecutors on the mass murder case, having him replace Deering would have been a conflict of interest.

    In March, Ohio Supreme Court Chief Justice Sharon Kennedy chose retired Brown County Common Pleas Court Judge R. Alan Corbin to preside over the case, according to WXIX.

The FBI and other law enforcement stopped Adelson and her husband, Harvey Adelson, at the airport, where they were in possession of tickets to Vietnam with a two-day stop in Dubai, according to State Attorney Jack Campbell, the Tallahassee Democrat reported. The U.S. does not have an extradition treaty with Vietnam, meaning the Asian country would have had no obligation to take part in sending Aldelson back to the U.S., had she been charged or found guilty of any extraditable offenses.

Campbell told the Democrat that the planned Vietnam trip prompted authorities “to make a decision quickly” on Adelson’s arrest, and speed up the state’s timing even though they say they’d already had enough evidence to take her into custody.

“That’s what forced our hand,” Campbell told the news outlet. “We started talking to some of our law enforcement partners about the complexities of trying to bring someone back from either Dubai or Vietnam. And that might be a very complicated and lengthy process. So that’s why we had to make a decision quickly.”

The state attorney added that Adelson’s attempt to get on a flight to Vietnam flight would be used in court if her case goes to trial. Adelson’s efforts to try to leave the U.S. on Monday came two days before a grand jury was set to meet at the Leon County Courthouse. Campbell told the Democrat that first-degree murder charges must go through a grand jury. 

Court records released Tuesday and obtained by the Democrat include phone calls between Adelson and her son Charles after his conviction. According to the affidavit, the calls, which were monitored, included conversations “in which Donna Sue Adelson is telling Charles Adelson that she is getting things in order, creating trusts, and making sure her grandchildren are taken care of.” The court records also state that, “Donna discusses plans for a suicide, but also discusses plans to flee to a non-extradition country,” according to the Democrat.

Campbell said that there’s not enough evidence to arrest Adelson’s husband, Harvey.

Charles was found guilty of the murder-for-hire plot of his brother-in-law on November 6, and faces up to life in prison. Prosecutors alleged he’d paid Sigfredo Garcia and Luis Rivera to kill Markel, and that Charles’ then-girlfriend, Katherine Magbanua, put him in touch with the men. 

Magbanua was found guilty last year of first-degree murder, conspiracy to commit murder and solicitation of murder and sentenced to life in prison, plus two 30-year sentences that would run consecutively with the life term. Garcia was convicted in 2019 of first-degree murder in the plot, along with conspiracy to commit murder, and was sentenced to life in prison. Rivera took a plea deal on second-degree murder charges in 2016 in exchange for testifying against Magbanua and Garcia, and he was sentenced to 19 years in prison in the case.

TALLAHASSEE, Fla. — Today, First Lady Casey DeSantis and the Florida Department of Juvenile Justice (DJJ) announced the investment of an additional $1 million to enhance and expand mentoring services for Florida’s youth. This investment further builds upon $12.8 million in mentorship funding at the Department of Children and Families as well as the recent expansion of First Lady Casey DeSantis’ Hope Florida initiative to the Statewide Guadian ad Litem Office.

“Investing in mentorship is an investment in Florida’s future and one that will empower and strengthen the next generation,” said First Lady Casey DeSantis. “Mentoring isn’t just about providing guidance to young people; it’s about unlocking their unique potential and helping them build skills and resilience that will shape them as our emerging leaders in Florida and our country.”

The One Mentor, One Child initiative was launched last year with the goal of building a statewide mentoring network to serve Florida’s youth in their local communities. Since that time, the need for mentors has increased, and this targeted investment will allow more youth to be matched with dedicated mentors who can serve as positive role models in their lives.

This additional funding will enhance and expand mentoring services among seven organizations that DJJ has partnered with through the One Mentor, One Child initiative. These organizations include Big Brothers Big Sisters Association of Florida, MaliVai Washington Youth Foundation in Duval County, Marion County Children’s Alliance, Unity Family Community Center in Levy County, Girls of Transformation Mentoring Program in Miami-Dade County, Character GPS in Hillsborough County, and the Center 4 Change in St. Lucie County.
