Michigan Supreme Court Upholds Right to Attorney: Protects Citizens from Police Deception

Michigan’s highest judicial authority has intensified protections around the right to legal representation, declaring police deception tactics illegal when it comes to a suspect’s access to an attorney. This landmark ruling from the state’s Supreme Court fortifies the integrity of legal rights during police interrogations.

Delivering a decisive 6-1 opinion, the court underscored that any ambiguity exploited by law enforcement does not nullify a suspect’s claim to an attorney once it has been asserted. Any admissions made thereafter are disqualified from being admissible in court proceedings.

This critical decision emerged from the case People v. Fenderson, involving Daren D. Fenderson, who was taken into custody by Detroit police related to a murder case. Despite Fenderson’s persistent requests for legal counsel during detention, more than two hours into the questioning, Sgt. Reginald Beasley rebuffed him with the statement, “You don’t got one,” or “You don’t get one.”

The court emphasized that such breaches of constitutional rights extend beyond initial encounters, highlighting a troubling pattern of disregard for suspects’ legal protections during police interrogations.

“Defendant expressed confusion, and Beasley told defendant that police tried to call a lawyer but nobody was available and defendant had no money,” the court summary of the case explains. “Defendant asked whether he could use the money he had in his possession when he was arrested, and Beasley said that he couldn’t use that money.”

As the interrogation went on, Fenderson asked police why he was arrested. This time, Beasley kept mum and said he could not say anything since Fenderson had invoked his right to an attorney. Instead, police crafted an elaborate plan to get the defendant to give up his rights.

The court describes the police plan in detail:

Beasley stated that defendant had asked for an attorney and that he could not speak to defendant without one, “[s]o the story you got is the story we gon’ go with.” Defendant again expressed confusion, and Beasley asked defendant what he was confused about. Defendant responded that he didn’t know what was going on and that police hadn’t told him anything. Beasley stated that police would take defendant back to the Detroit Detention Center and submit a warrant that a prosecutor would review. Defendant told Beasley that he didn’t know what that meant, and Beasley responded that defendant had requested an attorney so he couldn’t speak to defendant about the case[.]

The law enforcement scheme ultimately worked as Fenderson repeatedly said he wanted “to get this over with,” while Beasley kept suggesting Fenderson had to waive his Miranda rights to talk at all.

Then another sergeant entered and made Fenderson, who by this point had started crying, waive his rights. After that, he made incriminating statements.

Such law enforcement efforts violate both the federal and state constitutions, the Wolverine State Supreme Court determined.

“Defendant’s Fifth Amendment rights under Miranda were violated,” the summary reads. “The statements police made in this case after defendant’s invocation of counsel can reasonably be understood as suggesting that defendant’s right to have an attorney present during questioning was dependent on his ability to retain counsel through his own funds; these statements are not consistent with Miranda’s assertions that suspects have a right to counsel and that, if they cannot afford counsel, counsel will be provided.”

At the trial court level, the statements were suppressed, but prosecutors appealed and had the suppression ruling overturned. The intervening court placed great emphasis on the police plan to return the defendant to jail and his written and verbal waivers.

The Supreme Court rejected these arguments, expressing its view in a chapter heading: “Defendant was not provided counsel and was told he did not have and could not obtain counsel.”

“Instead, after having defendant wait two and a half hours for an attorney, police engaged defendant in a conversation that the trial court described as a ‘scare tactic’ that undermined defendant’s assertion of the right to counsel,” the opinion reads. “We consider police statements ‘in their totality’ when assessing ‘whether the warnings reasonably convey to a suspect his rights as required.'”

In Fenderson’s case, the majority reasoned, police inexcusably exploited the defendant’s confusion and violated his rights.

“[T]he police here erred by suggesting that defendant could not be questioned with an attorney present because he did not have the money to hire one,” the opinion goes on. “This confusing and inaccurate information undermined the advice of rights previously read to defendant.”

The opinion also quotes from a New Jersey appellate case that states the relevant constitutional rule in plain language: “A police officer cannot directly contradict, out of one side of his mouth, the Miranda warnings just given out of the other.”

The ACLU of Michigan praised the ruling.

“Protections against self-incrimination and guaranteeing the right to counsel are fundamental to our criminal legal system,” Phil Mayor, the group’s deputy legal director, said in a press release.

Expressing his views on the event, Hegseth wrote on X, “The flyovers will continue until morale improves.”

Pentagon spokesman Sean Parnell shared a photo of one of the aircraft performing a maneuver during the flyover and wrote, “Carry on Patriots.”

Eric Trump also responded by sharing an ABC News report on X, writing, “Can’t stand the manufactured outrage by the low-T mainstream media. This was undoubtedly the highlight of these people’s day…”

The ABC News report Eric Trump shared said Navy officials confirmed in a statement to the outlet that Blue Angels leadership is “reviewing the circumstances surrounding the maneuver and conducting a thorough safety review.”

The Blue Angels did not immediately respond to News Media’s request for comment.

The flyover came during Wednesday morning’s annual “Breakfast with the Blues” event, which marks the start of Red, White and Blues Week and gives spectators a chance to watch the Navy’s flight demonstration squadron practice over the Gulf Coast.

Local news outlet WALA-TV reported that this year’s event drew one of its largest crowds in recent memory, with the Casino Beach and Quietwater parking lots filling by about 7 a.m. Thousands lined the beach as the Blue Angels spent about two hours practicing ahead of this weekend’s air show.

Brenda Bennett, who has attended the event for decades, told the newspaper she had never seen a crowd this large.

“I’ve been coming since 1997 and this is the best kept secret, but I think the secret’s out because there’s more people here than normally,” Bennett said.

Theresa Smith and Sheri Marinovich said they had to park farther away than usual because of the crowds but said the extra walk was worth it.

“They’re showing out,” the pair told the newspaper. “They love to put on a show for the breakfast crowd. You feel like they’re just so much closer and we get to hear them talking on the radio and they do different maneuvers than they do for the show.”

Many spectators told the outlet the event felt especially meaningful following the recent America 250 celebrations. Bennett said she hopes Americans continue celebrating “our freedom that we have here in the United States.”

The Blue Angels are scheduled to practice again Thursday before public performances Friday and Saturday.

Meta Introduces Parental Alerts for Child Safety in Suicide-Related AI Chats

Meta has unveiled a groundbreaking feature aimed at enhancing child safety through its AI chatbots. This initiative reflects a significant step in leveraging technology for protective measures.

The innovative update integrates with Instagram’s supervision tools to alert parents if their teenagers communicate about suicide or self-harm with Meta AI. This seamless connection strives to bolster parental guidance in critical situations.

This reinforcement enables Meta AI to guide teenagers towards a crisis helpline when alarming topics are mentioned in messages. It also prompts them to confide in a parent or a trusted adult, fortifying support networks for these sensitive discussions.

In potential risk scenarios, Meta will dispatch an alert to parents. This was developed in collaboration with experts, who helped identify key indicators that suggest risk levels. The sophisticated AI system meticulously flags both overt and nuanced references to self-harm, illustrating a careful balance between automation and human oversight.

Upon the system flagging a conversation, a manual review is conducted prior to sending out a notification. In instances of ambiguity, Meta has committed to prioritize safety by alerting parents, even at the risk of issuing false alarms. The decision underscores the company’s stance on preventative measures being a priority.

In a statement, Meta — Facebook’s parent company — said, “We understand how distressing these alerts may be for a parent to receive. That’s why, as we continue to improve our detection, all chats flagged by our AI will be manually reviewed before an alert is sent.”

Instagram already sends alerts to supervising parents if a teenager uses Instagram to search for suicide or self-harm content, which started in February. These AI alerts are now live for the parents who use Instagram parental supervision in the US, UK, Australia and Canada and will be available globally by the end of the year.

Meta also stated that they are building a plan to contact emergency services if a conversation suggests that the user is at imminent risk of suicide. Meta currently looks across Facebook and Instagram for posts suggesting a credible risk of suicide and alerts emergency services. 

Meta has already made over 19,000 referrals globally and helped first responders perform wellness checks on users who seemed at risk. 

This feature was developed with the help of more than 75 clinicians who specialize in teen mental health. They reviewed how AI responds to hundreds of prompts and worked with the AI Wellbeing Expert Council, Suicide and Self-Harm Advisory Group and Youth Advisors to provide feedback on appropriate responses and what was working, as well as improvements. 

The feedback included making sure Meta AI interacts with the teen in a way that acknowledges their feelings and doesn’t shut the conversation down too abruptly.

Parents will also be sent expert resources that can help them approach conversations about suicide and self-harm with teenagers. 

Meta is implementing various conversation tools on Teen Accounts, which are automatically placed into a 13+ content setting, designed to give age-appropriate responses and not comply with sexual or romantic conversations, as well as not provide any information that would direct teens towards alcohol. 

In October, Instagram also released a Limited Content feature as a stricter content setting for parents who want restrictive posts on their child’s feeds. This will now also apply to AI experiences, meaning Meta AI will decline to respond to certain topics to reduce the chance of inappropriate conversation. 

These announcements are all following the UK government’s announced ban on social media for under-16-year-olds. The ban is expected in spring 2027, which will cover Snapchat, TikTok, YouTube, Instagram, Facebook and X. An opt-out social media curfew, which will disable “addictive features” between midnight and 6 a.m., has been announced in the UK as well.

The public defender in question, Beth Bourdon, was representing 58-year-old Javier Rosado Martinez. Martinez faced serious charges, including murder and attempted rape, stemming from the brutal attack on his girlfriend’s 93-year-old mother in 2022.

With charges of murder and attempted sexual battery upheld by the court, Martinez was ultimately sentenced to life behind bars without the possibility of parole, as reported by WESH on Tuesday.

Following the verdict, Bourdon expressed her thoughts on social media, posting on X (formerly known as Twitter). Her since-deleted message stated, “Just got life verdict on a death penalty case,” accompanied by an image of Olympic figure skater Alysa Liu.

The celebratory tone of Bourdon’s post was not well-received on the platform, with many users quick to criticize her for highlighting the life sentence of a man found guilty of such heinous crimes.

Bourdon removed her original post, but doubled down on Wednesday, writing, ‘Yesterday i got a life verdict on a death penalty case. I’m very proud to have saved a life!

‘My original tweet has been deleted because it was past the time to edit it and there was a request from a dear friend to remove the gif.’

Bourdon continued to face criticism from people who felt her continued celebration was inappropriate and offensive to the victim’s family.

The public defender’s office told the Daily Mail that it is Bourdon’s job to help clients avoid the death penalty. 

‘We empathize with the family of the deceased and are sorry for their loss. As criminal defense attorneys, we do not celebrate the death of anyone and Ms. Bourdon did not intend to offend anyone with her post,’ the spokesperson said.

‘The Constitution has charged us with representing people accused of crimes, which includes death penalty cases. It is our job to obtain a life verdict for a client in lieu of the death penalty.

“The following night and into the next week, the intensity of operations against them will increase significantly, with strategic infrastructure such as power plants becoming targets,” Trump indicated. He further asserted that unless Iran agrees to surrender its nuclear ambitions, American efforts will escalate to targeting crucial infrastructure like bridges. Trump vowed that strikes would continue until his objectives are met. Late Tuesday, CENTCOM reported that additional rounds of strikes were executed, impacting numerous military installations near the Strait of Hormuz and along Iran’s coastline.

“U.S. fighter jets, drones, and naval vessels coordinated precision attacks on Iranian missile, drone launch sites, naval fortifications, and coastal defense systems during a seven-hour operation designed to thwart Iran’s potential to threaten commercial maritime routes,” the update detailed. In conjunction with resumed naval blockades on ships transitioning to or departing from Iranian waters, this intense U.S. bombing initiative follows Trump’s notification to Congress that warfare efforts continued due to Iran violating international agreements by attacking commercial vessels in the Strait of Hormuz.

The impeachment filing, identified as House Resolution 1431, charges Senior U.S. District Judge John E. Steele with “high crimes and misdemeanors.” The allegations stem from his decision to order the release of Miakel Guerra Morales, a convicted Cuban plane hijacker, from ICE custody.

Following the controversial ruling on July 8, Morales, an undocumented immigrant from Cuba, was allowed to depart from ICE custody, sparking significant public and political discourse.

In 2003, Morales and several others assaulted a flight crew and hijacked a Cuban commuter airplane that he boarded in Nueva Gerona, DHS says.

Morales forced the pilot to fly more than 100 miles north to Monroe County, Florida, where it eventually landed at Key West International Airport.

The U.S. Marshals Service arrested him and charged him with aircraft piracy and conspiracy to interfere with a flight crew when the flight arrived.

He was convicted and sentenced to 22 years behind bars.

Despite the conviction, Judge Steele, who was appointed by President Bill Clinton, ordered Morales’ release last week, citing a Supreme Court ruling governing the detention of foreign nationals whose removal cannot be carried out.

“The Government cannot lock individuals in a cell indefinitely as a workaround for a stalled deportation process,” the order said.

Trump’s Iran Warning: Power Plant Threats Explained by Expert

Recent American military actions against Iran signify President Trump’s determination to follow through on his promise to target Tehran’s critical infrastructure, including power plants and bridges, as highlighted in a new report.

Throughout a week-long offensive, the US primarily concentrated on military facilities posing threats around the Strait of Hormuz. However, Arab media reports suggest these strikes also impacted over 2,000 segments of Iran’s national electrical grid.

Analysts note the ensuing blackouts were anything but accidental, occurring just hours after Trump’s declaration that Tehran would experience power outages unless it re-engaged in diplomatic negotiations.

“The US targeted infrastructure with Trump’s looming threat to cut the power,” stated Sascha Bruchmann, a research fellow at the London-based International Institute for Strategic Studies in a conversation with The Daily Telegraph.

Consequently, there now appears to be an amplified atmospheric threat that extends beyond mere military objectives.

Mohammad Allah-Dad, the the head of Tavanir — Iran’s state-run Power Generation, Distribution, and Transmission Company — said the latest American strikes have caused about $1 billion in damages to the grid, digital news outlet Iran Wire reported.

The attacks have already put a great strain on the country’s power grid, with Tavanir forced to implement a 4.200-megawatt reduction in capacity due to the damages so far.

The situation would get much worse if the US follows through on Trump’s threats to decimate Iran’s power plants.

“I’ll save the energy targets for last, but ultimately we’ll hit energy targets,” Trump told Fox News’ “Special Report with Bret Baier” Tuesday.

The president has repeatedly made similar threats since April, warning that the US was willing to attack civilian infrastructure.

The UN’s human rights chief, Volker Türk, has warned that such attacks would constitute war crimes under the Geneva Conventions.

Regardless of the consequences, Danny Citrinowicz, the former head of the Iran division of Israel Defense Intelligence, said Trump will have to find a way to escalate the conflict to break the current stalemate over the Strait of Hormuz.

“The dilemma is quite simple: At the end of the day, if he wants to take control over the straits, he will need to take over the straits,” Citrinowicz told the Wall Street Journal.

“He is not able to reach his military or strategic objectives with the force he has now.”

While Iran has previously scoffed at US threats, Tehran has now ordered the Houthi rebel group in Yemen to close the critical Red Sea trade route should its civilian infrastructure be attacked, three sources told Reuters.

The Iran-backed terror group has reportedly completed such preparations, with drones and missiles deployed near the Bab el-Mandeb Strait and awaiting orders.

Attacks on the 20-mile strait that leads out of the Red Sea into the Indian Ocean would further throw oil and trade supplies in chaos, with the waterway responsible for the transport of $1 trillion worth of goods every year.

The Red Sea is also notably where Saudi Arabia has transferred the bulk of its oil trade due to the closure of the Strait of Hormuz, with the sea now carrying around 7% of the world’s global energy supply.

During an appearance on Fox and Friends on Thursday morning, the budding golfer said that while her mom is ‘doing better,’ the radiation has ‘taken a toll on her body.’

In a conversation with the teenager, the host inquired, ‘How is your mom doing since her breast cancer diagnosis?’

Kai responded, ‘She’s improving; naturally, radiation is harsh on the body, but she’s on the mend and feeling more positive.’

She went on to brand her mom a ‘fighter’ and said she was feeling hopeful, adding: ‘She’s been a little tired but she’s a fighter.

‘If anyone can go through it, she can definitely… she’s a fighter, she’ll be fine.’

On Wednesday evening at the ESPY Awards in New York, Kai reiterated that her mom was doing well amidst her diagnosis.

‘My mom’s doing good,’ she told Page Six on the red carpet. ‘She’s doing better.’

Throughout her health battle, sources have said that Vanessa has been heavily supported by her boyfriend, golf legend Tiger Woods, whom she started dating in 2025. 

An insider revealed to People recently that the 15-time major champion had been ‘staying focused’ on supporting Vanessa throughout her recovery. 

The 50-year-old ‘has been amazing during Vanessa’s recent diagnosis,’ the source said, adding that Woods has turned his full attention toward her battle after his own recent medical and legal issues. 

‘Vanessa’s needs and issues have taken Tiger’s thoughts outside of his own legal, medical and personal struggles, which has been good for him,’ the insider said.

‘He has given her a lot of love – even while away working on himself. It shows he has character.’ 

The source also told People the couple ‘are optimistic about her treatments.’

At the event, Kai also made a rare political statement while chatting with Sportico.

It came after the reporter asked Kai about her recent appearance at the UFC 250 event at the White House for President Donald Trump’s 80th birthday, and what she thought about the integration of politics and sports. 

‘Honestly, I kind of stay out of politics completely, it’s not my thing, but I think the UFC event was great and it was really cool being there,’ she said. 

‘Especially having veterans in the stadium as well, that’s where you can kind of combine the 250 point of view on it.’ 

Instead, the University of Miami freshman emphasized that her focus is on inspiring the next generation of female golfers. 

‘I just like showing my life and showing how you can still be an athlete, and you can still do a ton of cool things, enjoy a ton of other things,’ she added. ‘I kind of like just showing people that everything’s possible.’

Chicago Air Quality Alert: Wildfire Smoke Impacts Health

CHICAGO (WLS) — The National Weather Service has issued an Air Quality Alert across the Chicago area, citing an unhealthy mix of ozone and wildfire smoke. This alert highlights rising environmental concerns impacting the region’s air quality.

Residents should prepare for the alert to persist until Thursday night, as adverse conditions are expected to remain.

By 9 a.m., air quality on Chicago’s North Side as well as its northern suburbs had deteriorated to very unhealthy levels, reported the Environmental Protection Agency. Communities along the Wisconsin border, extending into southern Wisconsin, also reported severely poor air quality.

These conditions have been exacerbated by smoke migrating south from Canadian wildfires, bringing a thick haze into the city and beyond.

According to the NWS, the compromised air quality can lead to a slew of health issues, including headaches, eye and sinus irritation, fatigue, chest discomfort, breathing challenges, asthma flare-ups, throat irritation, and increased coughing.

The Chicago Park District said it may move activities indoors on Thursday due to the air quality.

“Chicago Park District programs may be moved indoors, have limited time outdoors, or be canceled,” an update read in part. “The Chicago Park District reminds visitors to take precautions while enjoying our parks, beaches, pools, and facilities during these conditions.”

Experts say the combination of the heat, humidity, and pollution loaded with particulates could put those with respiratory problems at risk.

To stay safe people with heart or lung disease, older adults, children and teens are being advised to:

-Avoid strenuous outdoor activities
-Keep outdoor activities short
-Consider moving physical activities indoors or rescheduling them.

For everyone else:
-Choose less strenuous activities like walking instead of running so you don’t breathe so hard (and)
-Be active outdoors when the air quality is better.

Health experts say under the current conditions, anyone suffering from a respiratory ailment or condition – would be advised to stay indoors.

“This smoke that is in the air, it’s very irritating,” Chicagoan Michelle Turner said. You can’t hardly breathe.”

Turner isn’t taking any chances.

“Burning in the eyes burning in the throat,” she said. “This is why I have my mask my glasses on to protect myself.”

She’s wearing a face mask just to stay safe.

Dave Rockovich is visiting from Colorado.

“Living in Colorado the whole states on fire right now, so,” he said.

Most of the city’s skyline is blanketed in a haze as toxic smoke from Canadian wildfires settles over the area.

Dave Rockovich and Irgrid Rockovich said not only can you see it, you can smell it too.

“We were curious about what was going on because we woke up,” Dave said Rockovich said.

“We thought it was just fog and he looked it up and saw his wildfires and I was like, ‘Oh geez, OK,'” Irgrid Rockovich said.

Plenty of people went to North Avenue Beach early to try and beat the heat.

Despite suffering from allergies, Daniel Ortiz still went for a run along the lakefront.

“It’s the wind and the Hayes because when I got out of the house this morning, I saw it.,” Ortiz said. “I thought it was gonna be a little tough one today, but either way we got a good sweat in.”

ABC7 Accuweather Meteorologist Tracy Butler said there is a small chance for a few isolated storms Thursday afternoon. Butler said rain chances increase Friday afternoon and evening as well as Saturday evening.

Tragic Loss: Missouri Teen Fatally Shot at Home; Friends Charged in Heartbreaking Case

In a tragic incident that echoes the ongoing concern over youth violence, a Missouri teenager was found dead in her own home, hours after being fatally shot. The girl’s mother made the heartbreaking discovery upon returning, which has led to charges being filed against three juveniles, according to local authorities.

The Jefferson County Sheriff’s Office reported that on a Saturday afternoon, deputies arrived at a residence on Tower Road, near Hillsboro. The location is approximately a 45-minute drive from St. Louis. They found the body of 16-year-old Gabbriana Boyster, who had suffered a gunshot wound to the head. It is believed that the shooting occurred on Friday evening while three acquaintances, all juveniles, were present inside the home.

These events have resulted in one of the juveniles being charged with involuntary manslaughter, unlawful use of a weapon resulting in death, armed criminal action, and abandonment of a corpse. Two other juveniles have been charged with abandonment of a corpse and were subsequently released. Due to their ages, the Jefferson County Juvenile Office has not disclosed their identities.

The Sheriff’s Office noted that at the time of the shooting, Candy G’Sell, Boyster’s mother, was not at home. She shared with KSDK that the last exchange with her daughter took place on Friday night, a conversation now forever etched in her memory.

“She told me she was staying home. I told her to lock the door,” G’Sell told the outlet.

When G’Sell returned home Saturday afternoon, she found her daughter’s body and called 911, according to the sheriff’s office. Paramedics pronounced the teen dead at the scene.

“I walked in the room and she was laying there … sitting up,” G’Sell said. “In the blink of an eye, you know. She didn’t deserve that.”

Investigators have not said what led to the shooting, though they say Boyster and the three suspects knew one another. G’Sell told the outlet that the boys were all friends of her daughter.

“It’s not a game. Guns are not toys,” G’Sell said.

Jefferson County Sheriff’s Office spokesman Grant Bissell said the case has left multiple families grieving.

“There’s no getting around the loss of life,” Bissell told KTVI. “You’ve got one family who is torn apart by the loss of their loved one. You’ve got three other families that are now potentially going to be torn apart by the consequences [of the] actions of these young people. It’s a no-win situation for anybody.”

Instead of getting ready for her daughter’s junior year at Hillsboro High School, G’Sell said she spent the week planning her daughter’s funeral.

“There’s no relief. My baby is gone,” G’Sell told the outlet. “What mother wants to bury their baby?”

The Hillsboro School District said grief counselors will be available for students and families following Boyster’s death.

“Our hearts are with the student’s family, friends, and everyone impacted by this unimaginable loss,” Superintendent Dr. Jon Isaacson said in a statement obtained by KMOV. “While words cannot take away the pain of this tragedy, we want our students, staff, and families to know they are not alone. We are committed to providing support and care for everyone who is grieving during this difficult time.”
