Tragic Incident: Nephew Fatally Shoots Uncle Over Misunderstood Question

A teenager from South Carolina has been sentenced to prison for the fatal shooting of his uncle, which occurred when the uncle allegedly invited him to “take a shot” with a firearm.

Damarion Nealy, now 18, admitted guilt to involuntary manslaughter regarding the 2025 death of his 20-year-old uncle, Gregory Johnson II, in Horry County, as reported by the 15th Judicial Circuit Solicitor’s Office. At the time of the incident, Nealy was 17 and has been sentenced under the youthful offender act, meaning his imprisonment will not exceed five years.

According to the prosecution, Nealy was a passenger in Johnson’s vehicle while his uncle was shooting a pistol at deer in a wooded area. Johnson then gave the firearm to Nealy, asking if he wanted to try shooting. Given Nealy’s age, this was illegal.

Prosecutors detailed that Nealy aimed the gun at Johnson’s head, applying enough pressure to the trigger to fire the weapon, which resulted in Johnson being struck in the head. Subsequently, Nealy left the scene, and Johnson succumbed to his injuries shortly thereafter.

Nealy pointed the gun at Johnson’s head with “his finger on the trigger with enough pressure to discharge the weapon,” according to prosecutors. The shot hit Johnson in the head. Nealy then fled the scene and Johnson died a short time later.

Nealy later admitted that he was holding the gun and it “went off.”

“The fact and the evidence of the case showed involuntary manslaughter was the appropriate charge in these circumstances,” James D. Stanko, a violent crimes assistant solicitor, said in a statement. “We feel this was a fair resolution to these tragic events.”

According to his obituary, Johnson had recently started a landscaping business with his father.

“Gregory’s entrepreneurial spirit convinced his dad to help him develop a landscaping business so that he could supplement his income. Gregory talked about doing other projects around the house like rebuilding Grandma’s old barn, renovating the shed, and adding to his house.”

Brian Williams, Former NBC Anchor, to Launch Podcast on Netflix Following Past Controversies

Brian Williams, once a prominent figure at “NBC Nightly News” and “MSNBC 11th Hour,” is now collaborating with Netflix despite his past controversies.

Williams is set to host a video podcast titled, “We’re Back! With Brian Williams,” on the streaming platform. This show will feature conversations with influential personalities, including newsmakers, actors, musicians, and journalists, discussing their careers, personal stories, and the current times we are experiencing, according to Netflix.

The streaming service has yet to reveal when the podcast will premiere.

In a light-hearted statement, Williams remarked, “With predictions that by 2030 every American might have their own podcast, I figured it’s time to join the fun.”

Reflecting on his four decades in journalism, Williams stated, “In the news business, in-depth interviews often receive just four minutes. I am eager to engage in meaningful discussions with creative, witty, intelligent, talented, and impactful individuals—similar to the programs we all cherished growing up. Netflix offers the ideal platform for this venture,” he concluded.

The deal marks a renewed attempted for Williams to return to the spotlight after he was ousted from NBC News in 2015 over exaggerations and falsehoods that were found in some of his reporting — including stories from Iraq and from New Orleans after it was ravaged by Hurricane Katrina.

Williams worked at NBC for nearly three decades, including an 11-year run at “NBC Nightly News.” After his fall from grace, he moved to the Peacock Network’s then-sister outlet MSNBC, now called MS Now, to anchor “The 11th Hour” from 2016 to 2021, finishing out his contract.

He returned to the small screen for one night in 2024 to anchor a live election special for Amazon Prime Video.

Thursday’s Netflix announcement appeared to signal a steadier gig for the former anchor.

The podcast will be executive produced by Jonathan Wald, who produced the Amazon special and previously worked with Williams at NBC, Netflix said.

Breaking: Historic 10-Day Ceasefire Agreed Between Israel and Lebanon, Announces Donald Trump

Israel and Lebanon have agreed to a 10-day ceasefire, US President Donald Trump has announced, two days after the countries held their first direct diplomatic talks in decades in Washington.
The truce that Trump said was scheduled to begin at 5pm Eastern Time (7am Friday AEST) follows more than a month of war between Israel and the Iran-backed Hezbollah militant group in Lebanon.

Lebanon is calling for an immediate ceasefire to halt the ongoing conflict with Israel and Hezbollah, as a prerequisite for further negotiations. The country is also pledging to address the disarmament of Hezbollah.

In a bid to foster dialogue, the president has extended an invitation to the leaders of both Israel and Lebanon to convene at the White House. He described this as an opportunity for “the first meaningful talks” between the nations since 1983.

Expressing optimism, Trump shared on his Truth Social platform, “Both sides want to see PEACE, and I believe that will happen, quickly.”

Back in 1983, Lebanon and Israel reached an agreement that included Lebanon’s formal recognition of Israel and Israel’s commitment to withdraw its forces from Lebanon.

However, this agreement unraveled amidst Lebanon’s civil war and was officially annulled the following year.

Trump said the pause in fighting followed “excellent” conversations with Lebanese President Joseph Aoun and Israeli Prime Minister Benjamin Netanyahu.

Lebanese president refuses to speak with Israeli PM

During the fragile ceasefire with Iran, fighting has continued in Lebanon between Israel and the Iran-backed militant group Hezbollah.

Trump had announced that the leaders of Israel and Lebanon would speak about halting the fighting. If that were to occur, it would be the first direct conversation between the leaders of the two countries in more than 30 years.

But at one point on Thursday, Aoun refused to speak to Netanyahu, a government official familiar with the developments told The Associated Press.

The government official, who spoke on condition of anonymity in line with regulations, said the remarks were made during a call with US Secretary of State Marco Rubio and that Washington “understands Lebanon’s position”.

Washington has not publicly stated its support of a ceasefire as a precondition, and the Israeli government has framed the talks as peace negotiations with a focus on disarming Hezbollah.

Israel and Hezbollah exchanged fire across the border, with Hezbollah targeting towns in northern Israel with rockets and drones. Israeli fire against southern Lebanon intensified, especially around the cities of Tyre, Nabatieh and the strategic town of Bint Jbeil near the border with Israel.

Israel and Lebanon have technically been at war since Israel was established in 1948, and Lebanon remains deeply divided more than diplomatic engagement with Israel.

Israeli troops have pushed deeper into southern Lebanon to create what officials have called a “security zone,” which Netanyahu has said will extend at least eight to 10 kilometres into Lebanon.

Pakistan army chief meets with Iranian parliament speaker

Meanwhile, Pakistan’s powerful army chief met on Thursday with Iran’s parliament speaker as part of international efforts to press for an extension to a ceasefire that has paused more than seven weeks of war between Israel, the US and the Islamic Republic.

It was unclear whether the frantic diplomacy could lead to a lasting deal as the two-week ceasefire passes the halfway mark. The Iran war has killed thousands of people and upended global markets by disrupting the flow of oil.

Iranian state television did not provide details on the meeting between Pakistani Army General Asim Munir and Iranian Parliament Speaker Mohammad Bagher Qalibaf, who has emerged as his country’s chief negotiator.

There was no immediate comment from Pakistan, which has become a key mediator after hosting direct talks between the US and Iran that authorities said helped narrow differences between the sides. Mediators are seeking a new round before the ceasefire expires next week.

The White House said any further talks regarding Iran would likely take place in the Pakistani capital of Islamabad, though no decision had been made on whether to resume negotiations. The fragile ceasefire is holding despite a US naval blockade of Iranian ports and Iranian counter-threats to target regional ports across the Red Sea.

The war has jolted markets and rattled the global economy as shipping has been cut off and airstrikes have pounded military and civilian infrastructure. Oil prices have fallen amid hopes for an end to fighting, and US stocks on Wednesday surpassed records set in January.

Officials say US and Iran making progress

Even as the US blockade on Iranian ports and renewed Iranian threats strained the ceasefire, regional officials reported progress, telling AP that the United States and Iran had an “in-principle agreement” to extend it to allow for more diplomacy. They spoke on condition of anonymity to discuss sensitive negotiations.

The commander of Iran’s joint military command, Ali Abdollahi, threatened to halt trade in the region if the US does not lift its naval blockade, and a newly appointed military adviser to Iranian Supreme Leader Mojtaba Khamenei said he does not support extending the ceasefire.

However, if their age gap at the time of the lip lock doesn’t induce a double-take — Kutcher was 19 when it happened, while Kunis was just 14 — the circumstances surrounding it surely will.

While guesting on “The Rosie O’Donnell Show” in 2002, the future couple claimed that their “That ’70s Show” co-star Danny Masterson nudged Kutcher to get the most out of the moment, offering him a questionable proposition. “I’ve never kissed a guy,” Kunis recalled (via Variety). “I was a 14-year-old little girl and I was extremely scared for my life. [Kutcher] was very nice about it, like, ‘Don’t worry about it.’ Then Danny goes to him and goes, ‘Dude, I’ll give you $10 if you French kiss her.’” Kutcher confirmed during the 2002 interview that he and Masterson did indeed have a “side bet.” However, he and Kunis quibbled about whether Kutcher did enough to win the bet.

For his part, Kutcher starred alongside Natalie Portman in “No Strings Attached” while Kunis and Justin Timberlake led the cast of “Friends with Benefits.” And in a bizarre case of life imitating art, the former TV co-stars engaged in exactly the kind of relationship that was portrayed in those films around the time of their release.

“If we just paid attention to these movies, we should know that s*** like this does not work out in real life,” Kunis said on “The Howard Stern Show” in 2016 (via SiriusXM). “Well, we clearly didn’t pay attention, and we shook hands and were like, ‘Let’s just have fun.’ I mean, literally, we lived out our movies.” Kunis made it clear that, to that point, even though they had remained friends after “That ’70s Show” came to an end, she had never considered getting into a relationship with him, until a chance encounter at an awards show where the two caught the love bug. After the show, the two decided to keep the party going. 

“Long story short, I didn’t leave ’til the next morning,” Kunis added. “Then we ended up having a lot of talks about how this is a huge mistake and how he needs to go and be single, and I need to go and be single.”

Kutcher allegedly cheated on ex-wife Demi Moore

Trust, loyalty, and faithfulness are key pillars to any successful relationship, and Ashton Kutcher may have entered his partnership with Mila Kunis at a deficit in those areas, if some of the allegations made by his ex-wife and Golden Globe-winning actress Demi Moore are to be believed. In her 2019 memoir, “Inside Out,” Moore wrote that Kutcher talked her into two threesomes that left her feeling shame for having participated. She further alleged that Kutcher later used these experiences to justify his extramarital activity.

“Because we had brought in a third party into our relationship, Ashton said, that blurred the lines and, to some extent, justified what he’s done,” Moore wrote (via People). Moore further noted that Kutcher admitted to having been unfaithful when she confronted him with the claims of a 21-year-old woman who said she had been with Kutcher. For her part, Kunis apparently left little mystery regarding her feelings while discussing Kutcher’s reported infidelity after the fact.

“You were an a**hole,” Kutcher recalled Kunis telling him afterward (via an Esquire feature). “Was I?” Kutcher remembered asking her in response, to which Kunis reportedly replied, “Yeah, you were an a**hole for a good two years.”

Kutcher’s commentary on a young Hilary Duff aged like milk

Before he had ascended to the ranks of Hollywood’s A-list, one of Ashton Kutcher’s claims to fame following his initial “That ’70s Show” breakout was his work on MTV’s “Punk’d,” which saw Kutcher and his co-conspirators (including a young Dax Shepard) play elaborate pranks on celebs. One of the more notable targets during the show’s multi-season run was Hilary Duff, who appeared on the show’s Season 2 premiere at the height of her Disney fame.

And while fans may or may not recall the prank they pulled on her, Kutcher has been dragged on social media in recent years for a comment he made about Duff (who was then just 15 years old) on the show. As he’s setting up the segment with Duff, Kutcher refers to the “Lizzie McGuire” star (via Mr. Pop on X) as “one of those girls that we’re all waiting for to turn 18. Along with the Olsen twins.” Needless to say, some of the modern reactions to that sentiment have been pretty negative.

“Disgusting then and disgusting now,” wrote one X user in response to the clip. “All the Kutcher lovers jump on the ‘it wasn’t that bad’ bandwagon, just because he is who he is,” another user commented. “It was not an appropriate comment, then or now.” Regardless of the fan responses, though, it’s not the kind of statement someone wants to see in connection with their spouse.

They entered their relationship with some baggage

When Ashton Kutcher and Mila Kunis finally started dating in 2012, they didn’t exactly enter the situation as cleanly as they could have. Rather, both parties were carrying the baggage of their very serious and very public previous relationships. For her part, Kunis had recently split with “Home Alone” star Macaulay Culkin, with whom she had spent the better part of a decade before hooking up with Kutcher. Their split wasn’t a happy one, either.

“I had a horrible, horrible, horrible breakup,” Kunis revealed during a 2018 appearance on Dax Shepard’s “Armchair Expert” podcast. “I f***ed up. Like, I was an a**hole in my 20s, and I’ll be the first to admit it. And that’s something that took me a long time to come out and be like, ‘Yeah, you know what, I was a d***,’ and I accept it, and I own it now.” Of course, Kunis wasn’t the only one who had experienced a messy exit with their previous partner.

Kutcher and Demi Moore officially separated in 2011 — their divorce wasn’t finalized until 2013 — and had gone through a lot during their time together. In addition to the alleged infidelity that occurred, Moore reportedly broke her longtime sobriety while they were together. Moreover, the ex-couple suffered through the pain of a miscarriage and years of failed IVF treatments together.

They kept their nuptials surprisingly quiet

While one might have expected a young couple in love to shout from the rooftops about their relationship, that wasn’t the case with Ashton Kutcher and Mila Kunis. As reported by Entertainment Tonight, the couple wed in secret in July 2015 after Kunis had previously been spotted wearing what appeared to be a wedding band. Months earlier, James Corden inquired about the ring on the “Forgetting Sarah Marshall” star’s finger when she appeared on “The Late Late Show.” But Kunis offered only a “maybe” when Corden asked whether she and Kutcher had tied the knot. 

By that point, the couple had already started their family (despite vastly different parenting styles). It would be almost a full year, though, before Kutcher and Kunis actually acknowledged that they had gotten married. Nevertheless, Kunis maintained that there was no hidden agenda or funny business going on with their relationship during a 2016 interview with Glamour. “We never denied it; we just never talked about it. It was something that didn’t have anything to do with anybody else,” Kunis told the outlet.

People in Mila’s life were shocked by their marriage

When Ashton Kutcher and Mila Kunis began dating — and later when they started having children together and eventually got married — it was like a Hollywood love story come true. Fans had already seen their electric chemistry as Kelso and Jackie on “That ’70s Show;” now, there were real-life fireworks happening.

While the press and the actors’ fans were fully on board with the A-list pairing from the jump, though, people in Kunis’ life were reportedly taken aback when she and Kutcher escalated their relationship. While guesting on “Armchair Expert,” Kunis recounted her mother’s NSFW response when the “Jupiter Ascending” star first told her she was dating Kutcher (via Glamour). “We were driving up Laurel Canyon, and I was like, ‘Mom, I have to tell you, I’m dating somebody.’ And she was like, ‘Oh, tell me! Who are you dating?’ And I was like, ‘You’ve got to brace yourself for this one. I’m dating Ashton Kutcher.’ And she literally was like, ‘Shut the f*** up,’ in Russian.”

More recently, Kunis told the Wall Street Journal (via Q107.5) that her parents “were in shock” when they started dating, leaving us to speculate about what potential red flags may have cropped up in the beginning. At the very least, it is another strange thing about their relationship.

Ashton was rumored to have cheated on Mila while dating and during their marriage

The infidelity that cropped up during Ashton Kutcher’s previous marriage to “G.I. Jane” star Demi Moore is practically public record at this point. For her part, Moore spoke out about the darker aspects of their relationship, including extramarital activity, in her memoir “Inside Out.” Kutcher, meanwhile, was forthcoming about his bad boy period in the aforementioned Esquire feature. However, the cheating allegations didn’t end with Kutcher’s divorce from Moore.

In 2013, when Kutcher’s romantic relationship with Mila Kunis was still in its nascent stages, one of the women who he was said to have cheated on Moore with reportedly spilled the beans on a new affair. As reported by Hollywood Life, the woman, Sara Leal, was shown a compromising photo of Kutcher by a friend. The picture was said to be accompanied by claims of a relationship between Kutcher and another woman. “It could just be an innocent picture, but I think it’s also possible he’s not dating Mila exclusively. Not just because of that photo, but because he’s cheated before,” Leal told Star Magazine (via Hollywood Life). “That would definitely be a red flag for me, if I were dating someone who’d cheated on their wife.”

Whether or not those rumblings resulted from true events is difficult to say. A few years later, Star Magazine reported on a potential affair that turned out to be Kutcher hanging out with a relative. “You should have heard how upset Mila was that I spent the day with our cousin,” Kutcher later quipped on X. “Sorry Aunt Jodie these magazines lack integrity.”

Their support of Danny Masterson is still shocking

When footage of Ashton Kutcher’s inappropriate commentary on Hilary Duff and also the interview where he confessed to trying to tongue-kiss a very young Mila Kunis on a bet resurfaced, it didn’t happen randomly. Rather, old skeletons were being pulled from the closet in response to Kutcher and Kunis’ move to write letters of support for their former “That ’70s Show” co-star and friend Danny Masterson.

In 2023, Masterson, who played Hyde on “That ’70s Show,” was convicted on two counts of rape and sentenced to 30 years in prison. Despite the heinous crimes he was accused of and the guilty verdict, Kutcher and Kunis both wrote letters to the judge in the case to be used as he weighed the actor’s punishment. As noted by The Hollywood Reporter, which obtained the letters, Kutcher called Masterson a “role model” and praised his character, while Kunis referred to him as an “exceptional older brother figure.”

Their support of the convicted rapist ignited a firestorm, prompting the couple to post an apology video via Instagram. “[The letters] were intended for the judge to read and not to undermine the testimony of the victims or re-traumatize them in any way. We would never want to do that. And we’re sorry if that has taken place,” Kutcher said in the video (via “Good Morning America”).

Ashton’s longtime friendship with Diddy is problematic

Ashton Kutcher’s close relationship with convicted rapist Danny Masterson isn’t the only problematic friendship from his past. The “What Happens in Vegas” star also has an extensive history with rapper and music mogul Sean “Diddy” Combs. While many celebrity friendships are, at worst, fodder for the occasional tabloid blurb, Combs was sentenced in 2025 to 50 months in prison after being convicted on two counts of transportation for prostitution. And Kutcher’s connection to him and past attendance of Diddy’s infamous White Parties, which have been described (via Grazia) as “elaborate and produced sex performances,” has raised eyebrows.

During his 2019 appearance on “Hot Ones,” Kutcher did little to dispel the mythos surrounding Diddy’s parties when he was asked about them, telling host Sean Evans, “Wow, okay, I’ve got a lot [of stories] I can’t tell,” Kutcher said. “Diddy parties stories. Man, that was, like, some weird memory lane.” In the years since the interview was uploaded to YouTube, fans have raised questions about what the actor may have seen or been involved in.

This much is certain — between Kutcher’s friendship with Diddy, attendance at the rapper’s parties, and his association with and support of Masterson, there’s no shortage of potential red flags.

Divorce rumors have followed them around

Trump Secures 10-Day Truce Between Israel and Lebanon

In a significant development on the international stage, President Donald Trump announced on Thursday a temporary ceasefire between Israel and Lebanon, set to last ten days. This truce, as Trump described, is a crucial first move towards achieving a lasting peace between the two nations.

Trump extended an invitation to both the Israeli Prime Minister and the Lebanese President to engage in further discussions at the White House, aiming to build on this initial progress.

The announcement was made on Trump’s Truth Social platform, coming on the heels of high-level talks that took place in Washington earlier this week. The ceasefire is slated to commence today at 5 p.m. EST.

This agreement marks a milestone, achieved after direct conversations with leaders from both countries. Notably, it also signifies the first diplomatic meeting in Washington between Israeli and Lebanese representatives in over three decades, which occurred this past Tuesday.

‘I just had excellent conversations with the highly respected President Joseph Aoun of Lebanon and Prime Minister Bibi Netanyahu of Israel,’ Trump shared. ‘These two leaders have agreed to initiate a ten-day ceasefire at 5 p.m. EST to pave the way for peace between their countries.’

Trump explains further that the administration has tasked a senior delegation to oversee the transition from a temporary truce to a long–term agreement. This team includes Vice President JD Vance, Secretary of State Marco Rubio and the Chairman of the Joint Chiefs of Staff, General Dan ‘Razin’ Caine.

The President added: ‘It has been my honor to solve nine wars across the world, and this will be my tenth, so let’s get it done!’

This ceasefire comes amid heightened regional tension and follows months of diplomatic maneuvering by the White House.

While the ten–day window is brief, the pause is intended to provide the necessary space for formal negotiations regarding long–term stability.

The military campaign between Lebanon and Israel has become a major sticking point in Trump’s quest to bring an end to the war in Iran.

The Israeli-US strikes against Iran on March 2 intensified already frayed relationships in the region. 

Hezbollah, the Iranian-backed militant group in Lebanon, has been participating in the armed conflict by launching missile attacks against Israel. 

Israel’s retaliation in Lebanon has resulted in a catastrophic death toll, with estimates exceeding 2,000 Lebanese casualties. More than one million people have also been forced to flee their homes. 

Earlier this month, Israeli defense minister Israel Katz said the nation was planning to set up a security zone on Lebanese territory, which would prevent thousands from returning to their homes. 

In an effort to broker peace, several Lebanese and Israeli officials met at the US Department of State headquarters in Washington, DC, on Tuesday. 

Rubio hosted the meeting, which included Lebanese Ambassador to the US Nada Hamadeh, Israeli Ambassador to the US Yechiel Leiter and US Ambassador to Lebanon Michel Issa. 

‘We discovered today that we’re on the same side of the equation, and that’s the most positive thing we could have come away with,’ Leiter said after the meeting.

He added that the discussion focused on a ‘clearly delineated border’ between Israel and Lebanon.

‘The security of our civilians is not up for negotiation. This was a victory for sanity, for responsibility and for peace,’ Leiter said.

Leiter also declared that both nations were ‘united in liberating Lebanon’ from Hezbollah.  

Lebanon’s Ambassador to the US, Nada Hamadeh Moawad, called the meeting ‘productive’ while Rubio noted that the talks are a ‘process.’ 

Rubio added: ‘It’s a historic gathering that we hope to build on.’

Instability between Lebanon and Israel has contributed to the enduring conflict in the region. 

Lebanon and Israel have engaged in peace negotiations in 1983 and 1993. However, following the Hamas-led attack in Israel on October 7, 2023, the conflict drastically escalated.

A fragile cease-fire was implemented at the end of 2024, but was never fully enforced.

The body discovered in the waters of Long Island Sound has been confirmed as that of Brittany Kritis-Garip, aged 32, as announced by New York’s Suffolk County Police Department. The tragic incident has led detectives to conclude that her death does not involve any criminal activity.

In a statement, the department clarified, “Brittany Kritis-Garip, 32, from Oyster Bay, has been identified as the woman found deceased in the Long Island Sound near Lloyd Harbor on April 13. The investigation suggests her death was non-criminal in nature.”

Kritis-Garip had been missing since last month, a disappearance that was marked by troubling circumstances. She was last spotted on a Friday in Long Island, New York, according to information shared by her family and friends.

Biden Administration Lawyer Challenges DOJ’s Stance on Trump Records: A Legal Showdown Unfolds

A lawyer from the Biden administration, known for dismissing Donald Trump’s objections regarding the release of former Special Counsel Jack Smith’s January 6 report, has issued a critique of a controversial Department of Justice memorandum. This memorandum boldly diverges from established Supreme Court precedent, which the lawyer described as “astonishing.”

Christopher Fonzone, a former Assistant Attorney General with the Office of Legal Counsel (OLC), shared his detailed analysis on the Just Security blog on Wednesday. He expressed serious concerns over the Trump administration’s April Fools’ Day memo that declared the Presidential Records Act (PRA) entirely invalid, stressing that this issue is far from humorous.

Fonzone warned of the significant implications, noting that the OLC’s opinion on the PRA essentially permits Executive Branch officials to destroy presidential records. This stance has sparked numerous lawsuits, as these legal actions aim to protect Congress’s measures against abuses of power reminiscent of the Nixon era.

In his analysis, Fonzone summarized the legal stakes, pointing out that the Trump administration seems to wish to revert the law to its pre-PRA state. He criticized the memo for failing to effectively address, let alone challenge, the Supreme Court precedents from the Watergate era, despite its argument for the PRA’s complete invalidation.

“It’s truly astonishing that the Executive Branch claims the freedom to disregard an important statutory framework simply because the OLC has decided that a supposedly binding Supreme Court precedent is ‘wrong,'” Fonzone remarked. He acknowledged that while it’s not unheard of for the OLC to deem a statute unconstitutional, it is exceedingly rare. To his knowledge, no previous OLC opinion has reached such a sweeping constitutional conclusion that contradicts both Supreme Court and longstanding Executive Branch precedents.

Once tasked with advising Attorney General Merrick Garland on a legal question of significance, Fonzone, in January 2025 and before a change in administrations, rejected Trump’s “objections” to the release of Volume I of Smith’s report.

Trump had argued that immunity and one judge’s conclusion that Smith was unconstitutionally appointed and funded meant Volume I could not go public, but Fonzone said otherwise and the Jan. 6 part of the special counsel’s probe was released. The same cannot be said of Volume II, the final report on the Espionage Act and obstruction case against Trump, his valet, and a Mar-a-Lago property manager.

Law&Crime noted previously that current assistant attorney general T. Elliot Gaiser’s memo referenced Trump’s dismissed Mar-a-Lago classified documents case and slammed “attempts […] to subject a former President to criminal liability for his handling of presidential records that, for most of this Nation’s history, would have been subject to his complete discretion.”

That helped contextualize the attempt to nullify the PRA, which Congress enacted in 1978 — four years after Nixon lost the Watergate tapes case at SCOTUS and resigned in disgrace. The act gave the United States “complete ownership, possession, and control” over presidential records, requiring that the chief executive “adequately” document “activities, deliberations, decisions, and policies that reflect the performance of the President’s constitutional, statutory, or other official or ceremonial duties” for their submission to the National Archives.

During the classified-documents prosecution, then-defense attorney Todd Blanche memorably failed to convince Judge Aileen Cannon that the presidential-records-are-personal tradition, which started with George Washington and should be extended to Trump to exempt him from the criminal process, regardless of intervening SCOTUS precedent.

Cannon, a Trump appointee, nuked the case on other aforementioned grounds and went on to bar the DOJ and Smith from “releasing, sharing, or transmitting Volume II” or “any information or conclusions” about it publicly.

Most recently, Cannon approved the Trump argument that Fonzone expressly rejected as applied to Volume I. She berated Smith for having the audacity to create Volume II in the first place, given that she invalidated his authority, calling that a “concerning breach of the spirit of the Dismissal Order,” if not an “outright violation[.]”

Now, the department that Blanche leads as acting attorney general has cited the tossed case as a reason the PRA must be disregarded and challenged out of existence.

“The seeming acquiescence of the Executive Branch since the PRA’s enactment may be motivated by nothing more than discretionary choices to avoid an interbranch conflict. But, over time, it has subtly reshaped how the political branches and the public perceive the separation of powers,” the memo said. “This shift has already gone so far that attempts have been made to subject a former President to criminal liability for his handling of presidential records that, for most of this Nation’s history, would have been subject to his complete discretion.”

Jack Goldsmith is a Harvard Law professor remembered for his time in President George W. Bush’s administration, heading the OLC in the wake of 9/11, only to resign after less than a year on the job and immediately following his withdrawal of the “torture memos.” Given that history, Goldsmith has at times weighed in on OLC-related matters, most recently with an analysis on the legal basis for the U.S. operation to arrest Nicolas Maduro in Venezuela.

Upon reading Fonzone’s piece, Goldsmith deemed it a “quietly devastating” articulation of the law as it is.

NYU Law Professor Ryan Goodman, also co-editor-in-chief of Just Security, similarly praised the analysis as the “gold-standard,” while calling attention to the assessment of another OLC alum.

Georgetown University Law Center Professor and former Obama administration deputy assistant attorney general Marty Lederman slammed Gaiser, 36, for producing “what might be the most unprofessional and embarrassing opinion OLC has written in recent years (yes, worse even than the Venezuela opinion, even if the stakes aren’t quite as great).”
