Mark Kelly Accuses Hegseth of Censoring Retired Military Voices

The Department of Justice made headlines on Tuesday by seeking to overturn the seditious conspiracy convictions of members of the Oath Keepers and Proud Boys, marking a significant move in the Trump administration’s ongoing narrative reshaping of the January 6 events. This action stems from former President Trump’s steadfast refusal to concede his defeat in the 2020 election. In a related development, retired Navy captain and Arizona Senator Mark Kelly has called on an appeals court to uphold a ruling that Defense Secretary Pete Hegseth acted unconstitutionally by labeling him a “sedition” artist for criticizing Trump.

In a detailed 48-page brief submitted to the D.C. Circuit, Kelly and five other Democrats were described as the “Seditious Six.” This label followed their appearance in a video last November where they condemned fatal boat strikes on suspected drug smugglers in international waters. Kelly, an astronaut, advised service members that they could refuse illegal orders, referencing the Uniform Code of Military Justice. The Trump administration, however, accused him of undermining the chain of command and engaging in conduct unbecoming of an officer, which led to a proposed reduction in his retirement rank and pay.

Through social media, Trump accused Kelly and fellow Democrats, including Rep. Jason Crow of Colorado, Rep. Maggie Goodlander of New Hampshire, Reps. Chris Deluzio and Chrissy Houlahan of Pennsylvania, and Sen. Elissa Slotkin of Michigan, of “SEDITIOUS BEHAVIOR, punishable by DEATH!” This message resonated with both Hegseth and the DOJ.

Amid the Defense Department’s continued disciplinary efforts, U.S. Attorney Jeanine Pirro, a contender for the role of U.S. Attorney General and currently serving in Washington, D.C., initiated a criminal probe into Kelly and his associates. However, this investigation concluded with grand jury no-bills, essentially bringing it to an unsuccessful end.

Following this outcome, Senior U.S. District Judge Richard Leon issued a ruling in February, blocking the disciplinary measures. He determined that the Trump administration had unlawfully retaliated against Senator Kelly for exercising his right to “unquestionably protected speech,” in clear violation of the First Amendment.

The judge took a bird’s-eye view of the situation and said that what Hegseth attempted against Kelly threatened the free speech rights of “millions” of military retirees. He pleaded with the defense secretary to course correct.

“Rather than trying to shrink the First Amendment liberties of retired servicemembers, Secretary Hegseth and his fellow Defendants might reflect and be grateful for the wisdom and expertise that retired servicemembers have brought to public discussions and debate on military matters in our Nation over the past 250 years,” Leon remarked.

Instead, Hegseth responded to the loss by falsely promising an immediate appeal and writing on X, “Sedition is sedition, ‘Captain.’”

Bold words on social media like these recently came back to bite Hegseth in Anthropic’s First Amendment lawsuit, and Kelly is looking for the same outcome at the D.C. Circuit now that the government has, in fact, appealed.

The senator took direct aim at the government’s contention that Hegseth has the power to censor military retirees at will if he determines their speech has “counseled disobedience to lawful orders[.]”

“On appeal, Defendants abandon most of their arguments from below—including justiciability, reviewability, irreparable harm, and the balance of equities—and leave the bulk of the district court’s analysis unchallenged. And even as they pay lip service to retirees’ speech rights, they continue to ignore ordinary First Amendment principles guarding against viewpoint discrimination and affording full protection to speech on matters of public concern,” the brief said. “Instead they argue that Senator Kelly’s speech was categorically ‘unprotected’ by the First Amendment based solely on an unprecedented, blanket rule: If the Secretary of Defense concludes that a military retiree has ‘counseled disobedience to lawful orders and undermined military discipline,’ the speech receives no constitutional protection under Parker v. Levy, 417 U.S. 733 (1974).”

Rather, Hegseth is a “politically appointed civilian officer” who has no “veto power over public debate” and no authority to make this “unprecedented demand for total secretarial deference,” the brief went on.

Oral argument is set for May 7. Law&Crime earlier explained why the judges on the case were not the panel Hegseth was hoping for as he tries to reverse a resounding loss on a straightforward issue.

When notorious Proud Boys leader Enrique Tarrio on Tuesday praised Pirro for moving to vacate the Jan. 6 seditious conspiracy convictions, he emphasized the recipients “won’t need a pardon anymore” and that “[f]ull rights [were] restored,” and that “full military benefits and back pay will be processed.”

The tragic incident in the Bay of Plenty, where a riverbank collapse claimed the lives of two young boys, has left the community mourning. The victims have been identified as local children, Luti Maui Mafi and Pauly Lloyd.

The boys, aged 10 and 11, lost their lives after being caught in the collapse at the Tarawera River in Kawerau. This heartbreaking event occurred during what was meant to be a joyful day spent fishing and playing with friends.

In a heartfelt Facebook tribute, Luti Mafi’s family described the 11-year-old as a cherished son, grandson, nephew, cousin, and friend. He touched many lives with his presence, even during his brief time on earth.

“He filled our lives with light, laughter, and kindness,” his family wrote.

“His vibrant spirit and gentle nature will remain in our hearts, and he will be profoundly missed.”

The whānau said a service would be held for immediate family on Saturday.

“Forever and always in our hearts.”

Tarawera High School in Kawerau said the death of one its students, who Stuff understands to be Luti, was “a heartbreaking loss” and that the school would close on Monday and Tuesday.

Kawerau Putauaki School also confirmed one of their students, who Stuff understands to be Pauly, 10, had died.

The school said it too would be closed on Monday and Tuesday.

Last night, a local junior rugby club shared a message identifying the boys and mourning the loss of two of its young members, describing them as “active and valued members” of their community.

“Kia ora whanau, for those of you who are unaware, today we lost two of our JAB tamaiti in a tragic accident,” the post read.

“Both boys lived in Kawerau and attended our local schools. They, along with their whanau were active and valued members of our JAB community.

“We extend our deepest aroha and awhi to their whanau at this incredible difficult time. Hold your tamaiti close and keep them near.

“Our hearts are breaking for these boys, their whanau, and for everyone who had the privilege of knowing them.

“Moe mai ra korua e nga tama. Kia okioki i te rangimarie.”

Emergency services were called to the Tarawera River near Boyce Park about 11.30am (9.30am AEST) yesterday.

Police said a group of children had been fishing and playing on the northern side of the river when the bank gave way.

A rescue operation was launched, with police and Fire and Emergency NZ working to locate two of the boys who had become trapped.

“Sadly, two people were located deceased a short time later,” Acting Eastern Bay of Plenty Area Commander Inspector Phil Gillbanks said.

Gillbanks said two police officers had swam across the river and attempted to dig for the children with their bare hands, but they could not be saved.

Local resident Kurūtia Tanoa said he rushed to the river after hearing a rescue helicopter.

“Our kids were in distress telling me their mate is stuck under the bank,” he said.

Tanoa said three children were involved in the collapse, but one managed to free himself.

“Parents of the deceased turned up and there was a lot of tears going around. We as a community are always saddened when our tamariki are involved in an accident,” he said.

Surf Life Saving New Zealand lifeguards in an IRB assisted emergency services to bring the boys and rescue personnel back across the river, where they were met by grieving whānau.

“I am extremely proud of the two police staff and the local volunteer fire brigade staff who did everything they could to locate the victims in perilous circumstances,” Gillbanks said.

Local kaumātua (Maori elders) have performed karakia (prayers) and placed a rāhui (restriction) on the Tarawera River.

“Tūwharetoa has placed a cultural rāhui on the Tarawera River following the tragic incident earlier today,” a statement from Tūwharetoa mai Kawerau ki te Tai said.

“The rāhui will remain in place until the 23 April 2026, and prohibits activities such as fishing, swimming, and all other recreational use of the river during this time.”

People wishing to pay respects could do so from a distance, on the western (town side) of the Tarawera River near the Judo Club, she said.

Access was not permitted on the Eastern (Manukorihi side) side of the river.

Kawerau mayor Faylene Tunui acknowledged the deaths of the children with “the heaviest heart” via a post on the Kawerau District Council Facebook page today.

“Together we stand in love and solidarity with the families who are in mourning for their precious loved ones.”

Tunui said the community would unite to support the families “where and when appropriate”.

“In these hardest of days we see the best of our community. Rest In Love.”

The deaths of the boys were referred to the coroner.

Authorities are leveraging advanced technology to assess the DNA for any match that could identify a suspect involved in the abduction that occurred on February 1. This development is particularly significant for the family of Nancy Guthrie, including her daughter, Savannah, a well-known figure on the Today show.

Previously, the Pima County Sheriff’s Department indicated that the DNA sample retrieved from Nancy’s home was not exclusive to a single individual, adding complexity to the investigation. This new forensic analysis could provide the clarity needed to untangle this perplexing case and offer hope for a resolution.

Sources told the outlet that Pima County Sheriff Chris Nanos recently revealed to a neighborhood watch group that it could take six more months to identify the sample.

The names of the facilities, what their roles are, and if there are additional DNA samples that are relevant to the case remain unclear, per the outlet.

Nancy’s puzzling disappearance quickly captivated the world, as she has not been seen or heard from since the evening of January 31. 

The ongoing investigation, which includes about two dozen Pima County and FBI investigators, has looked into a series of blackmail messages sent to the family and to media outlets demanding money in bitcoin in return for Nancy. 

None of the ransoms were ever paid as the Guthrie family demanded that they proof of life, but never got it. 

Authorities and the family also could not verify the authenticity of the ransom notes, despite their willingness to pay. 

Over the course of the investigation, only a few people have been taken in for questioning. No one has been arrested. 

Various pieces of evidence have also been found at the home and in the surrounding area, including drops of blood on Nancy’s front porch, a torn-down doorbell camera, and various gloves. 

Surveillance footage also captured a masked person outside her front door, appearing to tamper with the doorbell camera before it was snatched off. 

Her daughter Savannah has since made her way back to New York City and is back on-air at the Today show.

These were four players they earmarked to earn the club a billion reais (about £155m) – Endrick, Estevao, former West Ham player Luis Guilherme and 19-year-old forward Luighi, who is still at the club.

Palmeiras academy director Joao Paulo Sampaio believes Conceicao can join that group who made the leap to Europe.

‘Endrick and Estevao always had the spotlight from the age of 11,’ said Sampaio. ‘Eduardo is only getting that attention now — and we don’t know where he can go, which is a good doubt.’

Lucas Andrade, who coached Conceicao with Palmeiras Under 20s and is now with Brazil Under 20s, offers further insight.

‘Eduardo has the profile of a ball-carrying attacking midfielder,’ Andrade tells Daily Mail Sport. ‘He can also play as a left-sided winger, but his best performances come through the central corridor, as a No 10.

‘He has strong dribbling characteristics — similar, in today’s game, to Raphinha, and internationally to Ousmane Dembele — players who can break lines both with dribbling and vertical passes.’

Andrade also pointed to Conceicao’s physical readiness as a key factor behind the growing interest from English clubs.

The beloved musician succumbed to two heart attacks at the University of Miami hospital. His wife, Claudette Bailey-Smith, confirmed his passing and shared a heartfelt tribute.

Claudette expressed her profound sorrow through a Facebook post, accompanied by a cherished photo of the couple. “With a heart shattered by loss, yet overflowing with love and gratitude, I want to thank each and every person who prayed for my beloved husband, Ernie Smith. Your prayers, messages, kindness, and support from Jamaica and across the world have carried me and our family through the darkest hours of our lives. Ernie was not only my husband, he was the love of my life, my best friend, my safe place, my laughter, and my greatest blessing. He was the man who filled every room with light, joy, wisdom, and warmth. To the world, he was a legend whose music touched generations. To me, he was everything…Thank you for loving Ernie. Thank you for honoring him. Thank you for standing with us. Sleep peacefully, my love. Until we meet again,” she wrote.

The singer of “Life Is Just For Living” was admitted to the hospital on April 7, spending his last days in the Intensive Care Unit (ICU) after receiving dialysis treatment. Claudette commended the hospital staff for their outstanding care during this challenging time.

On April 9, two days into his hospital stay, Ernie underwent surgery. Though the procedure was successful, he remained heavily sedated and reliant on a ventilator. He also underwent a treatment to clear mucus from his lungs.

Throughout his illustrious career, Ernie Smith was recognized with numerous accolades, including the Badge of Honour for Meritorious Service in the Field of Music, awarded by the Jamaican government in 1973.

Tributes flooded in for the star as news of his death became public. Writing on Facebook one fan said: “Rest in power, Ernie Smith. You reminded us that ‘life is just for living’, and now that your race is run, your legacy lives on.”

Another recalled: “RIP Legend Ernie Smith. I will always cherish the moments when I watched you entertain people at World Cup 98′ at the Jamaica Village in Paris, France. You were such an Ambassador anywhere you went representing Jamaica and its culture. Walk good Bredrin. You will be greatly missed.”

A third chimed in: “Tonight I extend my sincere condolences to the family, friends, and many fans worldwide of the legendary Ernie Smith….this musical giant who gave us many hits including ‘Ride on Sammy’, ‘One Dream’, ‘Life Is Just For Living’ . ‘Pitta Patta’. ‘Duppy or Gunman’ ‘I for Jesus’ and many more….His voice, spirit, and legacy will live on forever….Rest peacefully, Legend. A fourth lamented: “Involuntary tears escaped my eyes as I absorbed the sad news of the passing of veteran and beloved Jamaican Musician Ernie Smith…I am so grateful for the memories and for his music! For me, he lives on. So take your well earned rest Ernie Smith, we will remember you, always.”

Meanwhile a fifth commented: “Tonight, my heart feels especially heavy, hearing of the passing of Ernie Smith. In the picturesque lakeside town of Rabuor, nestled in Kenya’s Kisumu region, Victor Ouma has carved out an unusual niche for himself: he’s a professional mourner.

Struggling to secure traditional employment, Ouma discovered a unique opportunity in the funeral industry. He offers his services to cry for those who lack family to mourn them, ensuring a dignified farewell for the departed.

“We saw it as a promising venture to generate income, steering clear of crime and idleness,” Ouma explained.

But shedding tears isn’t their only task. According to Francis Oyoo, another professional mourner, their services extend to organizing catering and setting up tents for the bereaved families.

The work commences as soon as the body is retrieved from the mortuary. These professionals then engage in wailing and singing dirges until the burial is complete.

Oyoo said his business was important for those with limited family.

“At times a person has no family, but has money, and at least they need somebody or people to come and be with them, stand with them, so that they can give their loved one a better send-off,” he said.

“It comes to a point where they need professional mourners and that is where we come in.”

‘We believe that his spirit is happy’

Georgina Achieng hired professional mourners to cry for her deceased uncle.

She’s a member of the Luo community, which views a crowded funeral procession as a status symbol.

“In our culture as Luo, we believe that if somebody is dead, if you don’t give him a good send-off, his spirit might hover around and maybe haunt some people, like the children or maybe even the family members,” said Achieng, whose late uncle had no immediate family of his own.

“So if you give him a good send-off, we believe that his spirit is happy.”

For the workers, emotions come easily even if the deceased is a stranger, according to Willis Omondi, who manages a group of professional mourners.

“We don’t have to be related to the person. We only have to get the feeling that a human being is dead and then start to cry,” Omondi said.

“Now we will be thinking if it were my relative. That is how it comes, that we can mourn someone who we are not related to.”

Owuor Olunga, a professor of anthropology at the University of Nairobi, said there has been a rise in the use of professional mourners, which reflects broader societal changes in Kenya.

“Urbanisation has sort of replaced our traditional roles,” she said, explaining that family sizes have shrunk as a result.

“So you find that when an individual passes on, the degree to which you have people related to you by blood in the urban centres may not be there,” Olunga said.

“So in such cases, depending on your standing in life, standing in position, in society, you may find that there are all manners of mourners, most of the time not hired by the family, but brought in by your friends or your social network to be able to show your worth.”

China Faces Scrutiny Over Alleged Crackdown on Underground Catholic Community: Report Highlights Escalating Pressures

According to a recent report by Human Rights Watch, the Chinese government is intensifying its efforts to compel underground Catholic communities to integrate into the state-controlled church. This move is accompanied by increased surveillance and stricter controls over the country’s estimated 12 million Catholics.

The report highlights that this pressure forms part of a long-standing campaign aimed at aligning religious organizations with the ideologies of the Communist Party.

The Associated Press noted that Beijing has dismissed these allegations, accusing Human Rights Watch of maintaining a “consistently biased” stance against China.

For many years, China’s Catholic community has been divided between a government-approved church and an underground church that remains faithful to the Vatican. In a bid to minimize these divisions, Pope Francis reached an agreement in 2018, allowing the Chinese government a say in the selection of bishops.

“A decade into Xi Jinping’s Sinicization campaign and nearly eight years since the 2018 Holy See-China agreement, Catholics in China face escalating repression that violates their religious freedoms,” Human Rights Watch researcher Yalkun Uluyol said in the report. 

“Pope Leo XIV should urgently review the agreement and press Beijing to end the persecution and intimidation of underground churches, clergy, and worshipers.”

The Chinese Foreign Ministry spokesperson’s office told The Associated Press that Human Rights Watch “fabricates all manner of lies and rumors and lacks any credibility whatsoever.”

The office added that the government “oversees religious affairs in accordance with the law and protects citizens’ freedom of religious belief and normal religious activities.”

Human Rights Watch said its researchers are not allowed into China and that the report is based on interviews with people outside the country who had firsthand knowledge of Catholic life in China, along with experts on Catholicism and religious freedom.

The 2018 agreement stipulates that Beijing proposes candidates for bishop, which the pope can veto, though the full text has never been made public.

In June 2025, Pope Leo XIV, who had just become the pope, appointed a Chinese bishop under the 2018 agreement and said he would continue to honor the deal “in the short term.”

“I’m also in ongoing dialogue with a number of people, Chinese, on both sides of some of the issues that are there,” Leo said. “It’s a very difficult situation. In the long term, I don’t pretend to say this is what I will and will not do, but after two months, I’ve already begun having discussions at several levels on that topic.”

Since 2018, Human Rights Watch says Chinese authorities have pressured underground Catholics to join the state-run church through detentions, disappearances and house arrests, citing accounts from unnamed individuals who have left China.

The report also said China has tightened ideological control, surveillance and restrictions on religious activity and foreign ties, including requiring state approval for clergy travel, while officially recognizing and closely overseeing five religions: Buddhism, Taoism, Catholicism, Protestantism and Islam.

Xi Jinping said in 2016 he would “Sinicize” the country’s religions, a policy aimed at aligning religious practices with Communist Party ideology.

Human Rights Watch said authorities have taken sweeping steps to curb religious practice, including tearing down churches and crosses, blocking gatherings at unregistered churches and seizing religious materials not approved by the state.

The group said the broader “Sinicization” campaign has also led to intensified crackdowns on Tibetan Buddhists and Muslims.

Authorities Report Wife Allegedly Ends Husband’s Life to Alleviate Suffering

A Michigan woman, aged 31, faces allegations of killing her husband, purportedly after shooting him several times within their home. Andrea Graham was detained on Monday and has been charged with open murder and a felony firearm offense related to the death of her husband, Alan Graham, as per court documents reviewed by Law&Crime.

In a statement released by the Battle Creek Police Department, officers were dispatched to a shooting incident at approximately 4:30 p.m. at a residence located on the 100 block of South Ridgeway Drive, roughly 120 miles west of Detroit.

Upon arrival, first responders discovered a man with visible gunshot wounds in his upper body, as detailed in the police department’s release. Andrea Graham, identified as the woman at the scene, directed officers inside where emergency personnel attempted to revive the man, who was later pronounced dead.

Andrea Graham was subsequently arrested and placed in the Calhoun County Jail while the investigation is ongoing, according to the release.

The Battle Creek Enquirer reported that court documents have shed more light on the circumstances surrounding the shooting.

According to the report, investigators said the shooting occurred in the basement hallway, where officers discovered Alan Graham dead from multiple gunshot wounds.

At the scene, Graham allegedly told responding officers she shot her husband during a violent encounter and described her actions in blunt terms, according to a report from Grand Rapids, Michigan, NBC affiliate WOOD.

“I shot him a couple of times to make sure he was out of his misery because I didn’t want him to suffer slowly,” she said.

Investigators recovered a 9 mm pistol and multiple shell casings from different areas of the home, and they found shattered glass from a picture frame on the victim’s body, the report said, suggesting the incident involved movement through several rooms.

Andrea Graham claimed she acted in self-defense, telling authorities her husband had been strangling her when she fired the weapon. Meanwhile, investigators said they did not observe injuries consistent with that claim and found evidence that did not support her account.

She later appeared in Calhoun County Court and entered a not guilty plea, declining to comment on the allegations, according to Kalamazoo, Michigan, CBS and CW affiliate WWMT. Her attorney described her as a stay-at-home mother of two and said she has no prior felony convictions.

Graham is currently being held without bond and is scheduled to return to court on April 22 for a probable cause conference, according to court records.

Authorities are reaching out to the public for assistance following a recent spate of suspicious fires targeting Melbourne’s hospitality venues. The incidents have sparked concern among residents and officials alike.

In the past week alone, the city’s metropolitan area has witnessed two fires, an arson attack, and two attempted arsons at licensed establishments. This alarming trend has prompted detectives to investigate any potential links between these events and to understand the motivations behind them.

Detective Inspector Chris Murray of the Arson and Explosives Squad emphasized the grave risks associated with such reckless acts. “We have repeatedly warned about the dangers of fire and the severe consequences for those who choose to start them,” he stated. “Unfortunately, we’ve seen individuals suffer life-altering or even fatal injuries for what is often a meager financial reward compared to the value of a human life.”

“We have issued repeated warnings about the dangers of fire and the potential for those lighting them to suffer life changing or fatal injuries,” Detective Inspector Chris Murray, Arson and Explosives Squad, said in a statement.

“Despite that, we have seen arsonists die or suffer serious and life changing injuries as a consequence of being paid very little money compared to the value of a life.

“Fire is incredibly unpredictable – those who are responsible are risking their lives, the lives of an innocent community around them as well as people’s livelihoods.”

The first incident was an attempted arson at a Londsdale Street just before 6am on Tuesday.

There was a fire around 3am on Wednesday at a venue on York Street in South Melbourne.

A 25-year-old Coburg man has been arrested in relation to the incident.

There was a fire at a venue on Commercial Road in South Yarra just after 4am yesterday, the same time as an attempted arson at a venue on Cecil Street in South Melbourne.

Two more incidents occurred this morning: a drive-by shooting at a venue on Lonsdale Street and an arson at a venue on Southbank Boulevard.

Both occurred within 10 minutes, just after 4am.

Two boys, aged 16 and 17, were arrested around 5am in relation to the arson.

Police are now calling on anyone with any information about the incidents – including who is responsible and what the motivation is – to come forward.

“I would implore anyone who knows anything about these incidents to visit us and tell us what you know before we visit them.”

“Please – if you’re out in metropolitan Melbourne and particularly entertainment precincts this weekend – call triple zero if you see anything suspicious,” Murray said.

Remains of Oregon’s Martin Family, Missing Since 1958, Identified After Discovery in Columbia River Car

Remains discovered in a submerged vehicle in the Columbia River have been confirmed through DNA analysis as belonging to an Oregon family that vanished in 1958 during a trip to gather Christmas greenery, officials announced on Thursday.

The Hood River County Sheriff’s Office revealed that the state medical examiner has positively identified the remains as those of Kenneth and Barbara Martin and their daughter, Barbie. The remains were recovered from the wreckage of their vehicle in the river.

Concluding their investigation, the sheriff’s office stated that there was no evidence pointing to foul play in the family’s disappearance.

The family’s Ford station wagon, long suspected to have gone missing with them, was finally located in 2024 by a dedicated diver who had been searching for the vehicle for several years.

In the subsequent year, authorities successfully retrieved a portion of the car from the river, bringing closure to the decades-old mystery.

The family vanished in December of 1958.

The bodies of two of the family’s children were found months after the disappearance, but the other members never turned up.

The search for the Martin family was a national news story at the time and led some to speculate about the possibility of foul play, with a $1,000 reward offered for information.

“Where do you search if you’ve already searched every place logic and fragmentary clues would suggest?” an Associated Press article asked in 1959, months after the disappearance.

Only the frame and some attached components were retrieved from the water because of the “extent to which the vehicle had been encased in sediment,” the sheriff’s office said.

Analysis of those items allowed investigators to conclude that it was indeed the Martin family’s car.

Later in 2025, the diver located human remains that were ultimately turned over to the state medical examiner’s office.

Scientists developed DNA extracts from the remains and generated a profile that was compared with relatives of the Martin family, allowing for the identifications, authorities said.
