Chicago Mayor’s Veto Stands: Minimum Wage Increase for Tipped Workers Moves Forward

0

In a pivotal decision on Wednesday, the Chicago City Council was unable to overturn Mayor Brandon Johnson’s veto concerning a proposed pause on the scheduled increase in minimum wage for tipped workers. The council’s vote, which concluded at 30-19, fell short of the 34 votes necessary to override the mayor’s decision.

The ordinance, known as One Fair Wage, had originally been passed in 2023, aiming to ensure more equitable pay for restaurant workers by gradually eliminating the subminimum wage. Mayor Johnson, standing firm on his veto, hailed the outcome as a triumph for laborers striving for fair compensation.

However, not everyone is celebrating this development. Restaurant owners have expressed concerns, arguing that the rising wages are putting a strain on their financial stability, potentially affecting their business operations and profitability.

Despite the pushback from the business sector, Mayor Johnson’s stance reflects a broader commitment to economic justice for workers in the service industry, emphasizing the importance of fair wages as a fundamental right.

Mayor Brandon Johnson called it a victory for working people: an effort to eliminate subminimum wages for restaurant workers.

The Illinois Restaurant Association said in a statement, “While we are disappointed that the mayor vetoed the tip credit freeze, we are hopeful that the 60 percent of the Chicago City Council who stood up for our operators and servers will help us find a path forward that will protect restaurants and save our jobs. We urge the mayor to listen to the 30 aldermen who heard from hundreds of servers and operators from across the city that something needs to be done to support these restaurants. Their margins are slim and the risks are high for these businesses and inaction will only lead to more closures. Neighborhoods will slowly lose establishments that are integral to their communities, and the places that make this city special will eventually disappear. We seek a good faith effort from this administration to find a viable solution. Although there wasn’t enough support to override the mayor’s veto, the majority of the City Council recognized the urgent need for immediate action. We hope the mayor’s office acknowledges this widespread support, recognizes the significant concerns with the current plan, and commits to finding a solution that genuinely supports our restaurant workers, small businesses, and all 77 of the communities they serve.”

“We want to make sure that we’re supporting these small businesses because there is an opportunity to get to a compromise. We need the administration to stop talking about standing firm and actually get to the table so that we can land this negotiation,” 36th Ward Ald. Gilbert Villegas said.

Villegas said there will be a round two in his effort to freeze Johnson’s “One Fair Wage Ordinance.”

The measure gives tipped workers a bump in pay over a period of five years.

Villegas and the restaurant industry said 20% of Chicago’s neighborhood restaurants have gone out of businesses since the ordinance passed three years ago.

“I’m worried about our small independent restaurants and making sure we don’t see more empty storefronts throughout our great city,” said Sam Toia, with the Illinois Restaurant Association.

But, mayoral supporters say the ordinance has not stopped some new restaurants from opening. Northwest Side Alderman Jessie Fuentes led the way to successfully uphold Johnson’s veto of the freeze.

“It is not a moment to take away raises for people, raises for people when everything around them is more expensive and when people are struggling. Now than ever, we are watching people become homeless,” 26th Ward Alderman Fuentes said.

The mayor says he refuses to back down on his commitment to working people. He blames the struggles of small restaurant owners on Trump administration tariffs, not on his progressive policies.

“We’ve seen a well-organized corporate-funded effort to blame rising costs on Black and brown workers, while seeking to take a hard fought raises away from the very same workers,” Johnson said.

Johnson said it’s time to stop pitting workers against restaurant owners, but he appears to stand firm with the ordinance.

Progressive Alderwoman Jeanette Taylor says both sides must compromise.

“I want tip workers to get paid; I want them to make a living wage. But I also don’t want to see the Soulés and Virtue or small businesses close either,” Taylor said.

City Council approved a sizeable fare increase for taxis in Chicago.

The mayor is bumping up the cost of cabs by 20%, in both per mile and time charges.

It also includes new fees for rush hour and overnight rides and higher flat rates from airports to downtown.

Villegas was named chair of the Zoning Committee Wednesday, as well.

Police Report: Walmart Shopper Armed with Knife Attacks Toddler in Shopping Cart

Inset: Still images from an officer”s body camera show Noemi Guzman allegedly trying to stab a 3-year-old boy outside a Walmart in Nebraska (Omaha Police Department). Background: Cops investigate after officers shot Guzman dead (KETV).

In Omaha, Nebraska, law enforcement officials shot and killed a 31-year-old woman in a Walmart parking lot after she reportedly attempted to stab a child seated in a shopping cart. The incident took place on Tuesday morning, as confirmed by the authorities.

The chilling episode began shortly after 9 a.m. at the Walmart located at 1606 South 72nd Street, according to a statement from the Omaha Police Department. Initially, a 911 call was made requesting police presence, but the caller provided limited details. This was followed by another call reporting a woman armed with a “large kitchen knife” attacking a child.

Upon arrival, officers encountered Noemi Guzman, the 31-year-old suspect, who was armed and standing near the child in the cart, according to police reports. Despite commands to disarm, Guzman allegedly threatened and then injured the boy. The officers discharged their weapons, striking Guzman, who succumbed to her injuries at the scene.

The child was quickly taken to safety by his guardian and a passerby, and his injuries were later deemed non-life-threatening, police stated. Guzman was declared deceased on-site.

Surveillance footage revealed that Guzman had stolen the knife used in the attack. After taking the knife, she approached the child and guardian in an aisle and reportedly coerced the guardian to accompany her around the store with the child in the cart.

They eventually exited the store before encountering cops. Police released harrowing still images from the officer’s body camera of Guzman making a stabbing motion toward the boy.

“The responding officers acted with professionalism and direct action to intervene and save a child’s life,” said Omaha Police Chief Todd Schmaderer. “The community can be reassured in knowing that Omaha police officers stand ready to act with courage and decisiveness in the most serious situations to protect the public.”

Omaha Mayor John W. Ewing Jr. thanked police for quick action that prevented a “larger tragedy.”

“I am grateful for the department’s professionalism and transparency,” he said.

Officers say it’s unclear why Guzman allegedly targeted the guardian and child. The boy’s parents shared photos of his injuries with local ABC affiliate KETV which showed he suffered gashes along his face just above his ear and on his hand. He underwent surgery and is recovering at the hospital.

Terrifying Drive: Woman Clings to Car Bonnet as Vehicle Swerves on Road

0

A startling video has surfaced from the Gold Coast, capturing a woman desperately hanging onto the hood of a moving car amid what appears to be a road rage episode.

The incident unfolded when 22-year-old Natalie Alice Shaw was attempting to park her vehicle in July. According to Shaw, another driver, a woman, had been going the wrong way and obstructing her path.

Security footage reveals the tense moment as Shaw’s red car maneuvers into a drive-thru, where the confrontation escalates. The other woman approaches Shaw’s vehicle, attempting to open the car door.

The woman jumped onto the bonnet of the car before Shaw proceeded to drive out of the car park and onto Olsen Avenue in Molendinar. (Nine)

After initially leaving the scene, the unnamed woman returns, striding purposefully through the parking lot to reach the drive-thru exit once again.

In a video she recorded herself, Shaw recounts the encounter, saying, “She stands in front of my car and challenges me with, ‘What are you going to do? Hit me?’”

“And I was like, ‘Well, yeah if you’re in my way, I’m gonna get you to move out of my way’.”

The woman then jumped onto the bonnet of the car before Shaw proceeded to drive out of the car park and onto Olsen Avenue in Molendinar, a busy main road with a 60km/h speed limit.

“I’m like driving, trying to get her off … like swerving, trying to get her off,” Shaw said.

The woman clung to the windscreen wipers, telling Shaw to “slow the f— down” before eventually falling off the side.

The woman first appeared to block Shaw’s car. (Nine)
The vehicle continued along a busy road until the woman finally lost her grip. (Nine)

Shaw was charged with dangerous operation of a motor vehicle.

The ordeal was so strange, even Magistrate Sarah Thompson said “in 25 years of practice … I have never seen such bizarre behaviour”.

“The behaviour of the complainant was erratic, it was dangerous, it placed you in danger, you also placed her in danger,” Thompson said.

“It was a poor decision that you made in the circumstances, being confronted with what anyone objectively would see as a terrifying situation.”

Shaw was disqualified from driving for six months.

A rising para-athlete, her dreams of competing at the LA Paralympics in 2028 could be in jeopardy.

‘Good Boy’ (2025)

There have been over 100 years of cinema, but Good Boy just might be the very first horror movie that takes place almost entirely from the perspective of a dog. Director and cowriter Ben Leonberg cast his own dog, Indy, as the lead canine in this film. Indy and his owner, Todd (Shane Jensen), move into a remote cabin because the latter’s health is failing. Between the two, Indy is the only one who can perceive that something malevolent is in the cabin with them.

That’s the inherent problem facing Indy in the film. He can’t simply tell Todd about the disturbing things he sees and hears. And anytime Indy freaks out, Todd assumes it’s a behavioral issue. Todd’s grandfather (Larry Fessenden) died in this house, and so did his dog. Somehow, Indy has to make sure that he and Todd don’t meet the same fate.

Good Boy will stream on Hulu on April 25.

‘Cronos’ (1993)

The very first movie by Guillermo del Toro was a Mexican horror film called Cronos, and it was quite a debut for the director. The late Federico Luppi led the cast as Jesús Gris, an antiques dealer who has discovered a device created centuries earlier by an alchemist that can prolong life. It’s the closest thing that anyone has found to immortality, but it extracts a monstrous price. Jesús displays vampire-like symptoms, including an aversion to sunlight and a thirst for blood.

Ron Perlman, Selma Blair in Hellboy

Award-winning director Guillermo del Toro has been working with his signature blend of horror, fantasy and human drama for over thirty years. His newest film, an adaptation of Frankenstein, has been a passion project of his for many years. After a short theatrical run, it finally gets its premiere on Netflix this Friday. It stars […]

His granddaughter, Aurora Gris (Tamara Shanath), notices changes in Jesús’ behavior over time. But the real threat to his continued existence comes from a wealthy businessman, Dieter de la Guardia (Claudio Brook), and his nephew, Angel de la Guardia (Ron Perlman). Dieter knows about the device and wants it more than anything, and Angel has been ordered to kill anyone who stands in the way of that goal.

Cronos is streaming on HBO Max.

’28 Years Later: The Bone Temple’ (2026)

It’s probably a good idea to watch 28 Years Later before catching 28 Years Later: The Bone Temple. The good news is that both films are on Netflix and can be viewed back-to-back. Nearly three decades after the rage virus decimated the United Kingdom, Dr Ian Kelson (Ralph Fiennes) has made an extraordinary discovery while befriending Samson (Chi Lewis-Parry), one of the infected. It’s possible that the rage virus may be treatable after all.

The infected remain dangerous, but Spike (Alfie Williams) has bigger issues to deal with. Spike’s life was saved by Sir Lord Jimmy Crystal (Jack O’Connell), but the latter is a lunatic who is leading a group of Satan worshipers. If Spike wants to stay alive long enough to escape this group, then he’s going to have to learn how to kill at a moment’s notice.

28 Years Later: The Bone Temple is streaming on Netflix.

Swalwell and Gallego’s Lavish PR Spending Uncovered: Campaign Funds Under Scrutiny

0

During the same weekend as Senator Ruben Gallego’s wedding, both former Congressman Eric Swalwell and Gallego himself were found to have used campaign funds at resorts in Puerto Rico, as revealed by Federal Election Commission records.

Gallego has recently been attempting to put distance between himself and Swalwell, who was once a close ally. Swalwell, a former congressman and California gubernatorial candidate, stepped down amid severe sexual assault allegations.

However, details of their past relationship are now coming to light, according to insights from the Daily Mail.

The records indicate that Swalwell’s political campaign made two payments to the Hyatt Regency Grand Reserve Puerto Rico, amounting to $1,522.11 on June 7, 2021.

This date coincides with a wedding guest’s Instagram post, which tagged the same hotel as the venue for Gallego’s wedding.

The political operation of Gallego – the groom – spent $2,000 at the nearby Fairmont El San Juan that same day. Gallego, a congressman at the time, was elected to the Senate in November 2024.

Curiously, neither has ever posted photographs that include the other from the nuptials.

Gallego’s office did not immediately respond to a request for comment from the Daily Mail when asked if the then-congressman spent campaign funds on a hotel during his island nuptials or if Swalwell attended the event.

Politico reported in 2021 that Swalwell was present at the wedding in the Monday, June 7th, 2021, edition of Politico Playbook.

California Democratic Congresswoman Linda Sanchez, also in attendance at the event per Politico, spent campaign funds at the Hyatt Regency totaling $1,809.79. On May 18th of 2021, Sanchez spent an additional $540.93 for a ‘lodging deposit’ at the hotel.

The Daily Mail contacted Sanchez’s office for comment about the disbursement as well as Swalwell’s attendance at the event, and did not receive a response.

Under federal law, campaign funds cannot be used for personal expenses.

Gallego and Sydney Barron Gallego were legally married in December 2019 in Washington, DC, at the National Gallery of Art, but went public with their engagement in February of 2020 ahead of their ‘marriage’ ceremony in Puerto Rico in June 2021.

Sydney is the Director of Government Advocacy at the National Association of Realtors, a top lobbying group, focusing on legislative strategy targeting House Democrats on housing finance, fair housing, and related issues. She also worked on Hillary Clinton’s campaign and for the Senate Democrats campaign arm.

Gallego, Arizona’s junior senator, held a press conference in his office on Tuesday during which he claimed he had no knowledge of Swalwell’s inappropriate behavior, even though he had heard that Swalwell was ‘flirty.’

He broke down in tears at one point, insisting that he ‘trusted’ his friend.

‘And it hurts, the fact that he hurt a lot of people, and it pisses me off that now we all have to deal with all of his BS, his family, the poor victims that are still going to have to seek justice,’ Gallego said.

Turning on his longtime friend and colleague, he said that Swalwell ‘became very good at being a predator.’

He also noted that Swalwell ‘lied to all of us’ during his time on the House Judiciary Committee, where he was an active voice in the push to impeach Donald Trump.

The two men have been close throughout their time in Congress, with their families on friendly terms. Gallego said Tuesday he had reached out to Swalwell’s wife through a mutual friend over the mounting allegations against her husband.

At least five women have accused Swalwell of sexual misconduct, including rape, sexual assault, and sending unsolicited messages and photographs.

Swalwell announced Monday he would resign his seat in Congress after being engulfed by the scandal. The Democrat – who had suspended his campaign for California governor only the day before – apologized to his family and staff while insisting the claims are false.

Gallego’s own personal life came under scrutiny during his Senate race. He is now on his second marriage, having filed for divorce from his first wife – Phoenix Mayor Kate Gallego – while she was pregnant.

According to divorce records, he told Kate their marriage was over on December 15, 2016.

Although such records are normally public in Arizona, Gallego filed to have them sealed on the same day, citing the couple’s status as ‘high-profile public officials’ whose case would ‘likely receive intense scrutiny from the media.’

He later fought the conservative Washington Free Beacon in court to keep them sealed after the outlet sued for access.

In the filings, Kate appeared blindsided by Gallego’s claim that their marriage was ‘irretrievably broken’, responding that she was ‘without knowledge’ of his intentions.

The divorce was finalized in April 2017. Kate was then serving on the Phoenix City Council and went on to be elected Mayor of Phoenix in March 2019.

Carrie Underwood Astonishes ‘American Idol’ Contestant with Tiffany Jewelry and Personalized Note

Carrie Underwood is being praised for her thoughtful acts of kindness.

On Monday, a contestant from “American Idol” disclosed that the renowned judge had surprised her with a piece of Tiffany jewelry, along with a heartfelt handwritten note, as a token of congratulations for reaching the top 11 of the singing competition.

“Never imagined my first Tiffany & Co. jewelry would be a gift from Carrie Underwood,” Hannah Harper shared on Facebook, accompanied by a teary-eyed emoji.

She continued, “But honestly, the handwritten note touched me the most. That gesture meant everything. Her taking the time to write it… speaks volumes about her character. She’s truly down-to-earth and incredibly genuine. Just a wonderful, kind person. I have immense love for her,” Harper expressed.

Harper posted an image featuring the elegant Tiffany packaging and Underwood’s note. The note conveyed her congratulations, stating, “From the first moment I saw you, heard your story, and listened to your voice, I knew there was something extraordinary about you.”

She added that women and moms everywhere have related to Harper’s story, calling her an “inspiration.”

The aspiring singer sang an original song about her struggle with postpartum depression in her “American Idol” audition.

“You’re like my favorite person,” Underwood told Harper before she sang. “You’re wearing handmade clothes. You’re singing songs called ‘String Cheese.’”

Harper emotionally explained that she wrote “String Cheese” after the birth of her youngest son, who she said was now a year old.

“And my youngest son — I was just having a pity party, praying that the Lord would calm my spirit—” and my son kept coming up to me, and he said, ‘Hey, Mom, open this. Open my cheese.’”

And she said after she opened his string cheese, she realized God had put her in that position and “my house was the biggest ministry that I could ever have, and being a mom, so I gathered myself off the couch and I quit throwing a pity party, and I realized that was exactly what I wanted.”

She added that she “kicked the postpartum depression in the butt and I said, ‘I ain’t doing it.’”

Underwood started crying after Harper sang, calling “String Cheese” “about the most relatable song I’ve ever heard.”

Later, before they told her she was going to Hollywood to continue the competition, Underwood added, “You might be my favorite person who’s walked through those doors in the past three days. You’re gorgeous, like you look like someone who’s famous already. I think you just have a beautiful simplicity to your voice.”

The “Before He Cheats” singer added that she would be thinking about Harper and what song she plans to sing next in the competition.

“I feel like I’m just going to be rooting for you,” she admitted. “I loved everything about everything you just did.”

Dumpster Drama: Waste Removal Company Dumps Load on Customer’s Lawn Over Unpaid Bill Dispute

0

A trash removal service in California was captured on video unloading the contents of a dumpster onto a customer’s front lawn over a payment dispute. The incident involved a Bay Area business, Express Rental Dumpster, whose owner claimed the renters of a property in San Pablo failed to settle their bill.

According to KTVU, the tenants had rented a dumpster for clearing out debris, but the credit card they provided was problematic. Martin Perez, the owner, recounted the situation, saying, “The card was declined. They kept assuring us, ‘I’ll pay later,’ but it never happened. They promised to add funds to the card for charging, but on Monday, when we tried again, the response was, ‘Oh, I forgot.'”

Footage from a Ring doorbell camera revealed a truck driver conversing with someone out of view before opening the dump truck’s rear door, letting some trash spill onto the yard. The driver then reversed the truck into the property and unloaded the entire dumpster’s contents onto the lawn.

The action, reportedly captured by Julio via Storyful, highlights the ongoing conflict between the trash removal company and the tenants over the outstanding bill.

At one point, a man appears to emerge from the home and yell profanities in Spanish in the direction of the dump truck.

Perez said he already lost money on the dumpster delivery and pickup and would have to pay hundreds more in dumping fees if he took the trash to the dump, KTVU reported.

Police later responded to the scene and required the driver to remove debris from the edge of the sidewalk onto the property, the station added.

A neighbor told KTVU that the homeowner claimed to have paid for the dumpster.

“She says she paid $700 for it, and then, all of a sudden, I see him back up and dump it all on the ground. I don’t really know what that was about,” the neighbor said.

Examining the Controversial Moments that Define ‘Euphoria’s’ Impactful Narrative

0

Fans of “Euphoria” were left shocked by the much-anticipated debut of the third season, which depicted characters engaging in fetish work alongside scenes of vomiting and diarrhea.

This HBO series revisits the former students of East Highland High School after a five-year hiatus, exploring their journeys into adulthood.

Despite featuring a high-profile cast that includes Zendaya, Sydney Sweeney, and Jacob Elordi, the show has not met expectations with critics.

Known for pushing boundaries through its raw depiction of teenage drug use, sex, and violence, fans have voiced concerns that creator Sam Levinson’s latest storylines are ‘disturbing’ and ‘misogynistic,’ claiming they have ‘overstepped this time.’

Critics have slammed the new season for relying too heavily on ‘shock value’ elements like nudity and sexuality, arguing that it lacks substantial storytelling.

So, just how disturbing is Euphoria? And how does the brief glimpse at series three compare to the previous seasons?

Despite boasting a star-studded cast including Sydney Sweeney, pictured in season two, critics have not been impressed by the latest series of Euphoria

Substance abuse

Euphoria has a ‘severe’ rating for alcohol, drug and smoking content on the parents guide section of IMDB.

The first episode of season one wastes no time depicting drug use, with the show’s protagonist Rue (Zendaya) looking back on her battle with depression and how it led to her addiction and failed rehab stint.

Rue’s overdose is shown, with the disturbing scenes depicting her being found unconscious in a pool of her own vomit by her younger sister.

Another shot shows her being forced to take fentanyl by a dealer.

Other characters are also seen abusing drink and drugs across all three seasons.

Notably Cassie (Sydney Sweeney) has to be pulled out of a hot tub after drinking to the point where she projectile vomits on everyone.

By the end of season two, Rue has landed herself in debt with a local drug dealer, who puts her in a bathtub and injects her with morphine.

The Drug Abuse Resistance Education program, or D.A.R.E. was quick to criticise the show, claiming it ‘glamourises’ drug use.

D.A.R.E released a statement that read: ‘Rather than further each parent’s desire to keep their children safe from the potentially horrific consequences of drug abuse and other high-risk behavior, HBO’s television drama, Euphoria, chooses to misguidedly glorify and erroneously depict high school student drug use, addiction, anonymous sex, violence, and other destructive behaviors as common and widespread in today’s world.

‘It is unfortunate that HBO, social media, television program reviewers, and paid advertising have chosen to refer to the show as “groundbreaking,” rather than recognising the potential negative consequences on school age children who today face unparalleled risks and mental health challenges’.

In response to the criticism, Zendaya told Entertainment Weekly: ‘Our show is in no way a moral tale to teach people how to live their life or what they should be doing.

‘If anything, the feeling behind Euphoria, or whatever we have always been trying to do with it, is to hopefully help people feel a little bit less alone in their experience and their pain.

‘And maybe feel like they’re not the only one going through or dealing with what they’re dealing with.’

Violence

One of Cassie’s OnlyFans scenes has garnered criticism in particular – when she dresses up as a baby to shoot content

Viewers expressed their disgust after the season launch, revealing they’d been left feeling sick by characters throwing up and suffering with bouts of diarrhoea.

Particularly nauseating scenes include Rue and Faye (Chloe Cherry) – struggling to choke down lube-covered balloons of fentanyl in order to smuggle it over the Mexico-US border.

The characters are seen struggling for air and vomiting while forcing down the drugs – but the scenes for extracting the fentanyl are even more gruesome.

In order to obtain the drugs, the pair are forced to defecate in a strainer – which is later washed off and used to serve spaghetti.

While waiting for her turn to use the toilet, Faye struggles with a bout of explosive diarrhoea, with a dog eating the excrement.

While struggling to raise enough money for their dream wedding, Cassie turns to OnlyFans, shooting fetish content dressed as a dog and baby among other characters.

Engineer Alleges Rights Violation in Controversial DHS Detainment: A Deep Dive into the ‘Abduction’ Claims

A Maine resident has filed a lawsuit accusing federal agents of violating his civil rights through racial profiling and a violent arrest during an immigration enforcement effort. The lawsuit, initiated this week, sheds light on the alleged misconduct during the operation.

On January 22, agents from the Department of Homeland Security (DHS) were involved in an operation dubbed “Operation Catch of the Day” in Portland. During this mission, federal agents, armed and ready, apprehended Juan Sebastián Carvajal-Muñoz, a civil engineer holding a legitimate H-1B visa, as he was en route to work, according to the legal complaint.

Represented by the American Civil Liberties Union (ACLU), Carvajal-Muñoz claims that the actions of the immigration officers—some identified and others unnamed—were not only unjust but alarmingly harsh.

The complaint details a dramatic scene: “They cut in front of Sebastián’s car, smashed his window, forcibly removed him from the vehicle, handcuffed him, and abandoned his car still running in the middle of downtown Portland.”

Despite presenting his REAL ID and documentation proving his lawful immigration status, the lawsuit alleges that the agents disregarded Carvajal-Muñoz. Instead, they kept him in their unmarked van for several hours. The ordeal, as described in the lawsuit, only intensified from there.

“[The DHS agents] refused to release him despite instruction to do so, and instead locked him in a windowless cell in an ICE facility in Massachusetts,” the lawsuit reads. “As abruptly as the agents had abducted him, they released him in Burlington, Massachusetts, after 9 p.m. that night, leaving him to find his way back home.”

The nine-count lawsuit is premised on multiple legal theories including myriad alleged violations of the Fourth Amendment, the Fifth Amendment, and Maine’s own civil rights law.

At the heart of the 31-page complaint is the claim that Carvajal-Muñoz was “abducted” by DHS agents who “had no basis for the stop other than his apparent race, skin color or ethnicity.”

And such a reason for his stop, arrest, and subsequent detention, is a violation of the “Fifth Amendment equal protection guarantee, which requires that all people be treated equally under the law without regard to race, ethnicity, or national origin,” the lawsuit argues, as well as the Maine Civil Rights Act, which offers similar protections.

“Defendants intentionally interfered with Sebastián’s Fifth Amendment equal protection rights by physical force or violence, by damage to property, and by engaging in conduct that would cause a reasonable person to suffer emotional distress or fear bodily injury,” the complaint goes on.

The vast majority of the claims, however, are premised on Fourth Amendment violations. Such allegations dovetail with the argument that DHS agents abducted Carvajal-Muñoz for no reason other than his name — linked to his registered vehicle — and what he looked like.

The lawsuit explains how the enforcement operation in question, while premised on apprehending the “worst of the worst criminal illegal aliens who have terrorized communities,” ended up doing very little of the sort. In fact, “[o]ut of 192 people arrested during the operation, just 12 had criminal convictions,” the lawsuit notes.

The government hauling in Carvajal-Muñoz, who has a government job and no criminal record, was especially unsupported, the plaintiffs say.

From the filing, at length:

Sebastián specializes in conducting soil and foundation analyses for the construction and repair of bridges in communities across Maine. Sebastián oversees subsurface exploration for Maine Department of Transportation-operated bridges, solar projects, and residential areas and supports preparing geotechnical reports and calculation packages for these projects…

Sebastián has maintained lawful immigration status throughout his time in the United States, first on an F-1 student visa and then on an H-1B specialty occupation visa available to individuals who possess highly specialized skills.

But, the litigation is not simply an effort to vindicate the plaintiff’s own constitutional rights. Rather, the legal effort suggests Carvajal-Muñoz’s treatment by DHS agents is perhaps indicative of other such immigrant roundups across the country. The plaintiff himself said as much in a statement announcing the litigation.

“Federal agents came to Maine and terrorized entire communities, just as they have done throughout the country,” Carvajal-Muñoz said, his language echoing that used by Immigration and Customs Enforcement (ICE) to justify “Operation Catch of the Day.”

“All people should be free to move about their communities safely, knowing they will not be violently arrested by masked agents simply for driving while Latino,” the plaintiff’s statement goes on. “I came to Maine to study engineering and work hard. Even though I followed all the rules, federal agents targeted me based on my race. I hope this case can prevent agents from violating other people’s constitutional rights so the United States can fulfill its promise of being a beacon of freedom, opportunity, and safety for all people.”

The lawsuit also contains a subset of four “Bivens” claims attached to the alleged constitutional and state law violations.

A Bivens claim, based on a 1971 U.S. Supreme Court case involving a plaintiff of the same name, is a kind of lawsuit that allows citizens to sue federal government officials over constitutional violations. The path here, for the plaintiffs, however, is unclear as the Roberts court has all but overruled the Bivens doctrine.

The lawsuit seeks compensatory damages for the “physical, mental, financial, and reputational harms and other harms and losses” caused by the agents’ conduct, punitive damages, expungement of Carvajal-Muñoz’s arrest record — if one exists — and attorneys fees.

Again, the filing, at length:

This abduction profoundly harmed Sebastián. He continues to fear that he could again be racially profiled and unjustly arrested by federal agents. Given the utter unlawfulness of the arrest, he worries that no amount of proof or documentation can keep him safe. Sebastián seeks compensatory damages arising from the unlawful arrest and detention, and punitive damages to deter future unconstitutional conduct.

“People in the United States have the right to go about their daily lives without being suddenly and violently abducted because of their skin color or ethnicity, or for no reason at all,” the lawsuit reads. “This suit seeks to vindicate that right and to redress grave constitutional violations.”

Jude Bellingham and Vinicius Jr. Clash in Heated Exchange During Tense Champions League Match

On Wednesday night, Real Madrid’s Champions League journey came to an abrupt end at the hands of Bayern Munich, as tensions flared among the Madrid players, notably between Jude Bellingham and Vinicius Junior.

The clash at Allianz Arena saw Madrid holding a 3-2 lead, which brought the aggregate score to a 4-4 tie, setting the stage for potential extra time. However, the dynamics shifted dramatically in the 86th minute when Camavinga was sent off after receiving a second yellow card for delaying a free-kick.

Camavinga’s dismissal followed his first yellow card, issued just minutes earlier for a foul on Jamal Musiala. This critical sending-off allowed Bayern to capitalize swiftly, with Luis Diaz scoring a decisive goal shortly thereafter.

Even before Camavinga’s exit, tensions were already running high. A heated exchange between Bellingham and Vinicius Junior erupted just moments before the red card incident.

The altercation was sparked in the 83rd minute when Vinicius Junior, having gained possession, advanced towards the goal. Meanwhile, Bellingham made a determined run into the penalty area, urging his teammate to pass the ball to him in a promising position.

Vinicius Junior’s poor touch saw him quickly closed down by Dayot Upamecano and, unable to make the pass, he incensed Bellingham, who made his frustrations clear to the Brazilian.

Vinicius Junior was then caught on camera responding to Bellingham angrily: ‘What do you want? What do you want? Shut up and close your mouth.’

After the final whistle Vincic was harangued by players as he marched towards the tunnel with Guler, who had scored two brilliant goals on the night, having to be restrained by staff as he yelled in the Slovenian official’s face.

Vincic then decided enough was enough and gave the Turkish youngster a red card.

Antonio Rudiger and Vinicius Junior were among the chief antagonists, with both seen leading the pursuit and lambasting Vincic. Dani Carvajal, who didn’t even make it on to the pitch, was also caught shouting at the referee: ‘It’s your f*****g fault.’

The angry protests continued into the tunnel in chaotic scenes, with Bellingham criticising Camavinga’s sending off in the mixed zone with a three-word verdict: ‘It’s a joke.’

Beaten Real boss Alvaro Arbeloa also accused the referee of ‘ruining the game’.

He told Spanish press: ‘Obviously, you can’t send off a player for something like that. The referee didn’t even know he had a card and he ruined a very exciting, very evenly matched tie, a real battle, and that’s how the game ended.’

When asked how Camavinga was, he added: ‘Like everyone else.’

Arbeloa then added on TNT Sport: ‘I think with the red card, everything was over. It is really unbelievable that you send off a player for this action, it’s not possible in a match like that to be sent off for this.

‘We feel really, really upset, angry and disappointed and I think all of this is a little bit unfair.’

The Bayern Munich players unsurprisingly had a slightly different take on events however, with Diaz telling El Chiringuito TV: ‘I think the referee was right to send him off. We wanted to take the free kick quickly and he didn’t release the ball.’

The post-match chaos overshadowed what was otherwise a terrific game, including Harry Kane netting his 50th goal of the season in all competitions. He is the first Englishman to rack up this tally since Aston Villa’s Tom ‘Pongo’ waring in 1930-31.

Kane insisted his side are up for the challenge against the current holders in the semi-final, saying: ‘We feel strong, we feel like we can beat anyone when we’re at our highest level – we’re going to need that to beat PSG.’

Meanwhile the record 15-time champions are not used to failure in this competition, and Arbeloa accepted responsibility for the defeat, while admitting that he would ‘understand’ any decision the club may make over his future.

‘I am the one responsible for the defeats and I will always take the consequences from that,’ he said.

‘I will understand any decision the club makes. I’m a Real Madrid man through and through. I care about this club, the players and the supporters a lot more than I care about myself.

‘I will respect the club’s decision. But I’m not thinking about that. It’s a decision of the club. I’m a man of the club and all I want is for Madrid to win, regardless of who their coach is.’
