Appeals Court Directs Clarification from Judge on Security Fixtures After Inconsistencies in Trump DOJ’s Account

The Department of Justice quickly responded by appealing after a federal judge halted the construction of Donald Trump’s much-publicized $400 million East Wing ballroom. Now, a panel from the U.S. Court of Appeals for the District of Columbia Circuit has instructed that judge to provide clarity on a specific accommodation in the injunction that stopped the ballroom project.

Judges Patricia Millett and Bradley Garcia, appointed by Presidents Obama and Biden respectively, cited the Trump administration’s shifting “representations” in court as the cause of confusion about the “scope of the exception.” In a 2-1 decision, they decided to send the case back to U.S. District Judge Richard Leon for him to “clarify” whether the construction of the ballroom and the security-related work beneath it can proceed independently.

The appellate judges have asked Judge Leon to assess whether the injunction sufficiently considers the government’s concerns about national security and the safety of the President.

The panel highlighted that the National Trust for Historic Preservation had filed a lawsuit to stop the construction, leading to Judge Leon’s injunction at the end of March. Known for his emphatic style, Leon frequently uses exclamation points in his rulings, as he did when blocking actions against Sen. Mark Kelly, D-Ariz., and when opposing an executive order targeting Robert Mueller’s former law firm.

In his ruling, Leon used more than a dozen exclamation marks, repeatedly writing “Please!” to dismiss DOJ arguments. Appointed by George W. Bush, the judge acknowledged the seriousness of the government’s national security concerns but refused to let those “bald assertions” justify bypassing the law or shielding those actions from judicial scrutiny.

“[T]he existence of a ‘large hole’ beside the White House is, of course, a problem of the President’s own making!” Leon observed.

Relevantly, the judge’s injunction still permitted “actions strictly necessary to ensure the safety and security of the White House and its grounds, including the ballroom construction site, and provide for the personal safety of the President and his staff.”

After the plaintiff National Trust for Historic Preservation in the United States won the first round, the DOJ appealed to the D.C. Circuit, but on Friday the panel only extended the stay Leon self-imposed on his order until April 17 — believing that more information was needed to determine if the government will be harmed absent a stay pending appeal it sought. After all, the Trump administration’s story has already changed, the judges said.

“To start, much of Defendants’ discussion of national-security risks concerns security fixtures that are, or will be, installed beneath the planned ballroom. But the district court’s injunction runs only against the ‘physical development of the proposed ballroom,’” the order said. “And Defendants have repeatedly represented to the district court that any below-ground work was distinct from construction of the ballroom itself and could proceed independently.”

“Yet Defendants now seem to suggest that below-ground ‘national security upgrades are inseparable from the rest of the Project,’” the majority went on. “As a result, it remains unclear whether and to what extent the development of certain aspects of the proposed ballroom is necessary to ensure the safety and security of those below-ground national security upgrades or otherwise to ensure the safety of the White House and its occupants while the appeal proceeds.”

Without downplaying the “importance of ensuring the safety of the White House, the President, staff, and visitors,” and supporting Leon’s treatment of those claims, the panel wanted to hear more.

“We cannot fairly determine, on this hurried record, whether and to what extent the district court’s ‘necessary for safety and security’ exception addresses Defendants’ claims of irreparable harm, insofar as it may accommodate the Defendants’ asserted safety and security need for the ballroom itself or other temporary measures to secure the safety and security of the White House, the President, staff, and visitors while this appeal proceeds. We thus remand these cases to the district court with instructions to promptly address the pending motion to clarify how the injunction and its exception will ensure safety and security pending litigation,” the court said.

U.S. Circuit Judge Neomi Rao, a Trump appointee, penned the lone dissent to say she would have granted the stay and “allow[ed] construction of the ballroom and related security facilities to continue during the pendency of an appeal.” Rao took aim at how Leon found the plaintiff had standing, based on the declaration of one member complaining of monthly “aesthetic harm” of having to look at an eyesore.

“[T]he Trust identifies no member with standing to sue. The declaration of the Trust’s sole identified member, Alison Hoagland, relies on the claim that she will suffer aesthetic harm if the East Wing project is completed. Aesthetic harm to a plaintiff’s recreational activities may qualify as injury in fact, but ‘mere incidental viewership’ of an unpleasant sight does not,” the dissent said. “[Alison] Hoagland’s declaration claims that ‘[a]s a resident of Washington D.C.’ she will walk by and ‘be impressed’ with the White House (but displeased with the new ballroom) ‘about once a month.’”

“Such vague and infrequent viewing supports ‘nothing more than [a] generalized grievance[],’ which is insufficient for Article III standing,” Rao concluded, calling the government’s evidence “credible” and of “clearly a weightier interest than the generalized aesthetic harms identified by a single member of the Trust.”

Qantas Group has emphasized its collaboration with government officials and jet fuel suppliers, who remain optimistic about maintaining a stable fuel supply through the end of April and extending into May.

“Given the ongoing uncertainties in global fuel supply chains, we are keeping a vigilant eye on developments,” the update stated.

The group has implemented various strategies to cushion the effects of the Middle Eastern conflict, including alterations to its international routes, adjustments in flight capacity, and increased ticket prices.

Passengers on impacted Qantas and Jetstar domestic flights will be contacted about new flights.

Despite the brutal hit to the compay’s cashflow, Qantas said it has seen a strong spike in demand for international travel to Europe as travellers book alternative routes.

The airline has redeployed capacity from domestic and US legs to service more flights to Paris and Rome.

Qantas subsidiary Jetstar has already slashed flights between Sydney and Auckland and Brisbane and Auckland by 12 per cent, around 55 flights, as jet fuel costs bite.

The actress aims to present a 2017 interview clip to the jury, where Baldoni recounts approaching Britney Spears for a hug, despite being strangers at the time.

During the incident, Spears was on the set of “Jane the Virgin,” a series in which Baldoni had a starring role. She was visibly surprised by his unexpected gesture.

In the video, Baldoni openly questions his own actions, wondering aloud, “Did I just harass Britney Spears?”

Lively seeks to leverage this footage to highlight a pattern of behavior, drawing comparisons to Baldoni’s conduct during the filming of “It Ends With Us,” a 2024 film where they both collaborated, with him serving as director.

In the lawsuit, she claims that Baldoni sexually harassed her and then launched an online ‘smear campaign’ when she stood up for herself.

The judge in the case, due to go to trial on May 18 at Federal court in Manhattan, has already dismissed all of Lively’s sexual harassment claims against Baldoni. But released documents suggest those claims will still be part of her case.

Baldoni told Fuse TV: ‘The guest I was most excited to work with was Britney Spears. And then, it turned out, I didn’t get to work with her. There were zero scenes with Rafael and Britney Spears, probably at her request, because I had tweeted her, I was gonna bring (to the set) a poster from her Live in Las Vegas tour.’

Baldoni said he didn’t bring the poster because he didn’t actually have one and was joking, but Britney apparently ‘thought it was serious’.

‘I was a huge Britney Spears fan in high school,’ Baldoni said.

According to Baldoni, he and a few others went to see Britney film her scenes on set.

Squirming as he recounted the episode, Baldoni said: ‘Because I had tweeted her, and she had tweeted me back, and I’d gone up to her, and so, in my mind, we were friends.

Leaning back in his chair to show how Britney recoiled, Baldoni said: ‘And then I just kind of had this awkward moment of: ‘Did I just harass Britney Spears?’

As Baldoni told it, his co-stars thought it was hilarious, and he looked over to see them ‘on the floor, laughing.’

Other exhibits that Lively mentioned on her list – which runs to more than 800 items – include videos and photos apparently intended to expose Baldoni as a hypocrite.

Before making It Ends With Us, Baldoni cast himself as a feminist man and wrote a book called ‘Man Enough: Undefining My Masculinity’ to show how ‘woke’ he was.

The 34-year-old athlete had initially taken to social media to express his anger after a confrontation involving a security guard left his 11-year-old stepdaughter in tears.

The incident unfolded when Jorginho’s stepdaughter, Ada Law—daughter of actor Jude Law—spotted Roan during breakfast at an upscale Sao Paulo hotel. The young girl was allegedly approached in a manner described as ‘extremely aggressive.’

In a move to put the matter to rest, Jorginho published a comprehensive statement on Instagram, clarifying that Chappell Roan was not involved in the altercation.

“Chappell Roan made a public statement, reached out privately to Catherine, and our teams also communicated directly,” Jorginho explained, signaling that the issue has been resolved.

‘She did not direct her personal security or anyone on her team to interact with them,’ Roan’s spokesperson has said. 

Ada and her mother had been planning to attend Roan’s performance at the Lollapalooza music festival.

Butler Resident Pleads Guilty After FBI Uncovers Online Threats Against Trump

A resident of Butler, Pennsylvania, has confessed to making threats against President Donald Trump, various U.S. officials, and agents from U.S. Immigration and Customs Enforcement (ICE). The Department of Justice (DOJ) confirmed this development.

Shawn Monper, aged 32, admitted guilt on Monday to two charges of threatening to assault and murder federal officials and law enforcement officers. These threats were made with the intent to impede or retaliate against them as they performed their duties.

Monper’s arrest took place on April 9, 2025, following an investigation into threatening messages posted on YouTube by a user named “Mr Satan.” The Federal Bureau of Investigation (FBI) received a tip-off about this account on April 8, 2025, and subsequently traced it back to Monper’s residence in Butler.

He made several threatening statements between Jan. 15 and April 5, including that he was “going to assassinate” Trump “myself,” that “ICE are terrorist people, we need to start killing them,” and that “eventually im going to do a mass shooting.”

On Feb. 17, he wrote: “Nah, we just need to start killing people, Trump, Elon [Musk], all the heads of agencies Trump appointed, and anyone who stands in the way. Remember, we are the majority, MAGA is a minority of the country, and by the time its time to make the move, they will be weakened, many will be crushed by these policies, and they will want revenge too. American Revolution 2.0.”

The FBI investigation also found that Monper obtained a firearms permit after Trump’s inauguration, which he referenced on his YouTube account.

“I have bought several guns and been stocking up on ammo since Trump got in office,” he wrote after Trump’s second inauguration. In March, he added, “I have been buying 1 gun a month since the election, body armor, and ammo.”

Monper threatened ICE again on April 1, writing, “If I see an armed ICE agent, I will consider it a domestic terrorist, and an active shooter and open fire on them.”

The Butler Township Police Department in Pennsylvania investigated the case alongside the FBI.

U.S. District Judge W. Scott Hardy scheduled Monper’s sentencing for August 12, 2026.

Monper faces a maximum sentence of up to 10 years in prison on each count, a fine of up to $250,000, or both.

Trump was shot in the ear during a campaign rally in Butler on July 13, 2024. The shooter was killed by the Secret Service.

In a tragic incident, an Oregon day care operator is facing serious charges after a toddler under her care drowned. According to police and the victim’s family, the operator allowed the child to wander into a livestock water trough, leading to the child’s death. The operator was reportedly overseeing more than a dozen children at her home without the necessary licensing.

Tralina Fulton, 67, has been indicted on charges including second-degree manslaughter, criminally negligent homicide, and second-degree child neglect following the death of 20-month-old Heath Rictor. The incident occurred on September 9, 2025, at Fulton’s residence in Crook County.

In a heartfelt statement shared via their attorney, Russell Button, Heath’s parents, Zachary and Donna Rictor, expressed their profound grief over their son’s untimely passing, describing it as a “preventable death.” They conveyed the indescribable agony of losing their child under such circumstances.

The indictment accuses Fulton of leaving Heath unattended in her backyard, where he tragically fell into the water trough and drowned. Authorities have labeled her actions as unlawful, citing criminal negligence. At the time, Fulton was allegedly supervising 14 children, a number that surpasses the state guidelines for unlicensed child care providers.

In an interview with the Central Oregon Daily News, Button emphasized the fundamental lapses in child safety. “You don’t let a toddler wander off alone for any period of time. You don’t have a water hazard in an area where a little kid could drown and you don’t watch more kids than you’re safely capable of watching,” he stated, highlighting the preventable nature of this tragic event.

In a statement to Law&Crime, Button said, “When you assume the responsibility of caring for a toddler, there is no margin for error. Leaving a young child unsupervised, with access to a drowning hazard, while outnumbered by other children, is inexcusable negligence. This was Babysitting 101, and the failure to follow it cost a little boy his life.”

Heath’s parents said they hope Fulton’s manslaughter case can “serve as a reminder of basic child care safety” and what to avoid.

“Parents must be able to trust that their children are being closely watched,” the family said. “Caregivers should never take on more children than they can safely manage, and they must make sure children are never put in dangerous situations like our Heath was.”

The 14 kids Fulton was said to be watching at the time of Heath’s death were taken out of the home that day after it was discovered that she didn’t have the proper license to watch so many children, according to the Prineville Review. Fulton allegedly admitted to caring for 14 children on the day Heath died, per the Review.

Oregon’s Department of Early Learning and Care says the case is under investigation.

“We recognize the grand jury’s manslaughter indictment was a crucial first step toward accountability and justice for our son,” Heath’s parents said in their statement. “We are grateful to the district attorney’s office, law enforcement, and first responders for their diligent work to honor Heath’s life. We place our trust in the legal process to get justice for Heath as we prepare for the arraignment on May 6.”

Attempts by Law&Crime and the Prineville Review to reach Fulton for comment have been unsuccessful. Fulton’s lawyer declined to comment.

Authorities responded to an urgent call on January 24 at a short-term rental property in Keilor East, Belle Vista, after a cleaner discovered a cache of suspicious items. Among the findings were explosives, firearms, $1 million in cash, and a significant amount of drugs.

Police suspect that these items are connected to organized crime activities.

The Bomb Response Unit was dispatched to the site, where they successfully neutralized several explosive devices.

The property had been rented for several weeks in January. During this time, investigators noted the frequent presence of a rented white Toyota Camry, which was seen traveling to and from the location.

Security footage captured an individual refueling the Camry at a gas station on Western Ring Road in Ardeer South on December 25.

Police want to speak to the man seen in the footage and urge anybody who recognises him to come forward.

The Camry was seized by police on January 24 and returned to the hire company.

The man in the CCTV is not the man who hired the car, police added.

Investigators said the man who hired the car has been spoken to but “has not been co-operative”.

“I would urge anyone out there who recognises this man or who has any information on the items located at this accommodation to do the right thing and come forward,” Major Drug Squad Detective Inspector Jamie Walker said.

“This was not a run-of-the-mill seizure of drugs and cash – there were incendiary devices and a large quantity of firearms.

“This is organised crime.

“We will track down those responsible and hold them to account. It would be in your best interests to tell us what you know now.”

On Monday, Congressman Tony Gonzales announced his resignation following a scandal revealed by The Daily Mail, which involved a staff member who tragically set herself on fire.

Gonzales, a Republican who had earlier decided not to seek reelection, shared his thoughts on social media platform X, stating, “There is a season for everything and God has a plan for us all.”

He subsequently declared his plans to step down from his congressional role.

“When Congress reconvenes tomorrow, I will submit my resignation,” Gonzales stated. “Serving the wonderful people of Texas has been my honor.”

His departure comes on the heels of Democrat Eric Swalwell’s resignation, with both lawmakers facing ethics investigations.

The announcement is a month after Gonzales announced he would end his reelection bid after he finished in second place in the jungle primary.

Republican House Speaker Mike Johnson and others had called for Gonzales to drop out. 

He had initially promised that for the rest of his term, he would show ‘the same commitment I’ve always had to my district.’ 

However, Politico reported Monday that Gonzales was set to face an expulsion vote before the House alongside Swalwell, who quit minutes earlier.

For months, speculation has swirled over whether or not the Texan would fess up to the allegation, which was first reported in October 2025. And he came under mounting pressure to resign from his position of power after sexually charged texts between Gonzales and Aviles were released. 

The bombshell correspondence showed the married congressman petitioning his staffer for inappropriate pictures and asking her about sexual preferences. 

‘We have encouraged him to address these very serious allegations directly with his constituents and his colleagues,’ the joint statement continued. 

One day after his primary race, and as calls for his resignation from Republicans and Democrats reached a boiling point, Gonzales admitted to the affair. 

He called it a ‘mistake’ and a ‘lapse in judgment.’ He added: ‘I take full responsibility for those actions. Since then, I have reconciled with my wife, Angel. I’ve asked God to forgive me, which he has. And my faith is as strong as ever.’

His admission came just after the House Ethics Committee announced an investigation into the Texan’s conduct following a report from the Office of Congressional Conduct (OCC) indicating ‘substantial reason to believe’ Gonzales was embroiled in the affair. It is against congressional rules for a member to have an affair with a subordinate.

When pressed about Gonzales’s admission, Johnson did not let much slip but admitted it was ‘not against the law.’

‘I’m not going to get into private conversations,’ Johnson told Punchbowl News. ‘But I’ve told him to be forthright. Apparently now he’s doing that.’ 

When asked whether Gonzales should remain in Congress, given the scandal, the top Republican – and devout Christian – played coy. 

‘Marital infidelity is not against the law,’ Johnson said. 

Reminded that it’s against House rules for a member to have an affair with a staffer, Johnson admitted it was. 

‘Well, of course, yeah. That’s being addressed. There is an investigation at Ethics. The OCC is on it. All those steps have already been taken and apparently were underway.’

‘I’ve always been consistent, whether you’re talking about Republicans or Democrats, we let the processes play out,’ the speaker added. 

Both Democrats and Republicans have called on Gonzales to resign, or at a minimum, drop his bid for reelection.

Republican Congresswoman Nancy Mace of South Carolina accused Gonzales of ‘harassing his own staffer in the middle of the night’ and has called on him to ‘resign immediately and be held fully accountable for what he’s done.’

Mace filed a resolution to force the House Ethics Committee to release its reports on sexual misconduct by members. 

However, the House decisively voted to send the resolution to committee – a move that effectively killed Mace’s effort to expose the reports. 

‘I think it’s really disgusting how this institution protects itself,’ Republican Congresswoman Anna Paulina Luna of Florida fumed. 

‘We just had a Member of Congress literally sexually harass a woman that then lit herself on fire and you all protected him!’ she decried at a committee hearing. ‘You guys all protected him! My own side, your side.’

This week, Luna filed a censure resolution – one of the most severe punishments in Congress outside of expulsion – against Gonzales for his misconduct. 

Chairman of the Congressional Democratic Women’s Caucus, Teresa Leger Fernandez, in addition to scores of other liberal lawmakers, has also called for Gonzales’s resignation.

‘Representative Tony Gonzales’s actions would result in a termination and investigation in any other workplace.’

‘Representative Gonzales should resign,’ she added, noting his ‘abuse of power.’ 

Gonzales’s position seemed even more tenuous after he finished second in the Republican Primary to return to his seat to Brandon Herrera, a conservative YouTuber known as ‘The AK Guy.’ 

His competitor finished first with 43.3 percent of the vote to Gonzales’s 41.7 percent. 

The two of them would have faced a run-off election in late May to determine the Republican nominee in the November midterms.
